Purpose of these Application Materials This application from the Roaring Fork Water and Sanitation District (RFWSD) requests Garfield Countys review of proposed water and sewer facilities pursuant to the Location and Extent (L&E) 30-28-110, C.R.S., and sections 4-112 and 7-102 of the Garfield County Unified provisions of sections Land Use Resolution of 2008, as amended (including Resolution 2010-75) (ULUR). The RFWSD and its engineer, in consultation with the developers of the River Edge Colorado PUD (REC), have determined that the facilities described in this application are necessary to provide water and wastewater service to the REC and other properties located in the northwest portion of the RFWSDs extended service area. The proposed utilities will use and enhance existing capacity in the RFWSDs water and wastewater system and create redundant, reliable service to all customers in the Districts approved service area without increasing the burden on existing customers. Background of the RFWSD The RFWSD was created and called the Aspen Glen Water & Sanitation District in 1994 by decree entered in Civil Action No. 94CV29 and by approval of the Servic Sanitation District by Garfield County in Resolution 94-008. As first organized, the Aspen Glen Water & Sanitation District was to provide domestic water only to the Aspen Glen PUD but be the regional wastewater service provider for a service area that was larger than the Aspen Glen PUD. Then, as a result of other developments in the region, Garfield ed that the RFWSD should also be recognized as the Regional Service Provider for both water and wastewater services. This is memorialized by the Roaring Fork Water and Sanitation Di Garfield Countys approval of the Service Plan Amendment in Resolution No. 2001-28. Copies of these documents are attached as Exhibit A, which includes a map of the RFWSD expanded service area. The expanded service area boundary stretches from the Coryell Ranch and Midland Point subdivision on the southern end, north to the Ironbridge development on the west side of the Roaring Fork River and the Sanders Ranch, CMC turnoff area on th River. This expanded service area boundary includes the REC, whwned by Carbondale Investments, LLC (CI). CI has obtained planned unit development approval for the REC from Garfield County on its property. Pre-Inclusion Agreement The RFWSD has entered into a Pre-inclusion Agreement with CI and Garfield County Commercial Investments, LLC (GCCI). Pursuant to that Agreement, the RFWSD will agree to provide water and wastewater services upon the construction of certain facilities the REC and any potential development of the GCCI property. It also requires that certain of those facilities be oversized in order to accommodate the regional EQR properties. These projections are provided in Exhibit B and are based upon the anticipated development of the area based upon present uses and zoning of these properties. The facilities proposed for review in this application are for utility improvements necessary in the opinion of the RFWSD to provide water and sewer service to the REC. While an expansion of the RFWSDs wastewater treatment plant (WWTP) is also planned by the RFWSD to serve REC, the timing and nature of the expansion have not yet been determined by the the WWTP will be processed by the RFWSD at a subsequent date. Additionally, the future development of the GCCI property north of the REC or changes in drinking water standards may necessitate the construction of a surface water treatment plant (SWTP). Like the WWTP, the SWTP will be processed at a later date when determined to be necessary to supply RFWSD customers. Section 2. Location and Extent Application The required supplemental and supporting materials identified inL&E Application are provided in Section 3 and attached hereto. Certain information identified on the application form would not fit in the space application form so is provided below: General Legal Description: Water and sewer lines are proposed to be located in CR 110, 113 Highway 82 rights-of-way within Sections 17, 18, 19, 20 of T7S R88W. Lines will also in proposed rights-of-way and easements within REC and within existing access and util easements and rights held by the RFWSD along the Roaring Fork Riv Aspen Glen Homeowners Association in Section 18 of T7S R88W and Section 13 of T7S R89W, and along a sewer line utility easement within Section 12 of T7S the Teller Springs Homeowners Association along the western edge of the Roa WWTP site and Ironbridge. The water tanks and associated water l Gremel Holdings, LLC Easement (Exhibit C). The lift station will be located within the proposed Tract AO within REC (Exhibit D). A location map is provided as Exhibit E. Supplemental and Supporting Materials a. Description of Use Proposed as Part of L&E (and Site Development Plan) The facilities subject to this L&E application and review are shown on the Site Development Plan (Exhibit F). The following provides a detailed description of each proposed water and sewer facility: RFWSD 2 Location and Extent Application Materials Water System Facilities: Item A - Highway 82 Water Transmission Line: A water transmission line connecting the water line connecting the Aspen Glen Tank to Aspen Glen near where the line crosses Highway 82 immediately below the Aspen Glen Tanks north to the CR 113 intersection with Highway 82. The line will be located east of the centerline of Highway 82 within Colorado Department of Transportation (CDOT) Highway 82/Frontage Road rights-of- way and, potentially, BLM lands where CDOT right-of-way does not formally exist. The water transmission line will provide interconnection between the existing RFWSD system and the areas north and east of the Roaring Fork River completing a loop to: (1) support development of REC; (2) help provide water service redundancy within the District along with the Items C, D, E, and F; and (3) support extending future water service to the north of REC. This line is required to provide water system redundancy and service to REC. The line will be sized based on water system modeling to accommodate planned growth and development of the area utilizing the projections in Exhibit B. Item B - CR110 Water Line: A water line serving the 400,000 Gallon Water Storage Tank (Item H). The water line will follow the CR 110 right-of-way from the intersection of CR 113 and Highway 82 and connect to the Highway 82 Water Transmission Line (Item A) and REC East Water Line Connection (Item C). This alignment will include a water tank overflow line to transmit any water released from the water tank to Cattle Creek. This line is required to provide a connection to the water tank site and achieve required fire flows and pressures. The line will be sized based on water system modeling to accommodate planned growth and development of the area utilizing the projections in Exhibit B. Item C - REC East Water Line Connection: A water line connecting the 400,000 Gallon Water Storage Tank (Item H) and water transmission lines on the east side of Highway 82 with REC. The line crosses Highway 82 at the intersection of to enter the REC and connect to the water lines planned and reviREC property as part of the REC development approvals. This line is required to provide water service to REC and complete the loop to Aspen Glen and Ironbridge. The line will be specifically sized based on water system modeling to accommod and development of the area utilizing the projections in Exhibit B. Item D - CR109 Water Transmission Line: A water line connecting the existing water line between Aspen Glen and CR 109 and through Aspen Glen with the Ironbridge Water Line (Item F) and REC West Water Line Connection (Item E) to complete the loop through REC and provide redundancy within the District. The water line will follow the access and utility easement that currently provides access to the WWTP. This line is required to provide redundancy to Ironbridge, REC and Aspen Glen and completes the water system loop between the eastern and western sides of the R. The line will be specifically sized based on water system modeli planned growth and development of the area utilizing the projections in Exhibit B. Item E - REC West Water Line Connection: A water line connecting the water lines on the west side of the Roaring Fork River to those on the east side through REC. The line RFWSD 3 Location and Extent Application Materials crosses the Roaring Fork River near the WWTP site to connect to the water lines planned and reviewed as part of the REC development approvals. This line is required to provide redundant water service to REC and complete the loop to Aspen Glen and Ironbridge and east side development areas including REC. The line will be specifically sized based on water system modeling to accommodate planned grow development of the area utilizing the projections in Exhibit B. The crossing location will be selected in coordination with the USFWS and Roaring Fork Conservancy within the identified corridor pursuant to existing agreements and coincide with the REC Sewer Line Connection (Item H). The line will be buried. Item F - Ironbridge Water Line: A water line connecting the the REC South Waterline Connection (Item E) with Ironbridge. The line will traverse through Teller Springs to improve water flows and pressures to both sides of the Roaring F. The line is proposed to generally follow an existing utility easement througTeller Springs. The line will be specifically sized based on water system modeling to acc growth and development of the area. Item G- 400,000 Gallon Water Storage Tank: A maximum 400,000 gallon water tank located on the Gremel Holdings, LLC Easement (Exhibit C) at 314 County Rd 110. The tank will be buried. The tank is sized based on fire flow requir Sewer System Facilities Item H - REC Sewer Line Connection: A sewer force main (or mains) designed to provide connection between the areas north and east of the Roaring Fork The line (or lines) will be pressurized utilizing a lift station (Item I) located on Tract AO at REC and generally follow the existing drive and proposed easement onC property approved as part of the REC development approvals down the bank to the river crossing location. The line is necessary to service the eastern areas of the RFWSD line will be specifically sized based on wastewater system modeling to accommodate planned growth and development of the area utilizing the projections in Exhibit B. The crossing location will be selected in coordination with the USCOE, USFWS and Roaring Fork Conservancy within the identified corridor pursuant to exiseements and coincide with the REC West Water Line Connection (Item E). The line will be buried. Item I - Lift Station: A lift station designed to provide service to the areas to be se sewer north and east of the Roaring Fork River. The lift station will be planned and sized to serve the the projected growth within the RFWSD service boundAlthough not specifically known at this point, minimal operational and equalization storage will be provided in Tract AO where the lift station will be sited with the bulk of any equalization provided on the WWTP site. The lift station is required to move waste across the Roaring Fork River to the WWTP. The system will involve the construction of a small building meeting the requirements of the approved REC PUD Guide and Development Plan. Other Permitting and Approvals The following permits and approvals will be required for constru: 1.Colorado Department of Transportation Utility/Special Use Permit RFWSD 4 Location and Extent Application Materials 2.Various Reviews and Approvals of Water Transmission Lines and Mains, Water Storage Tanks, Lift Stations, and Sewer Mains by the Colorado De Public Health and the Environment depending on the exact nature and type of each facility 3.Colorado Department of Public Health and the Environment Storm Water Management Permit 4.US Army Corp of Engineers Nationwide Section 404 Permit 5.Section 7 Consultation with US Fish and Wildlife Service 6.Garfield County Utility Permits 7.BLM Temporary Use Permit 8.RFTA/PUC Utility Crossing Permits b. Governing Body and Site Development Plan The governing body for the project is the Roaring Fork Water and Directors. The Site Development Plan is provided as Exhibit F. c. Road Vacation No road vacation is proposed. d. Project Review Pursuant to ULUR Section 7-102 (and Section 4-112(C)) Standards The standard for review involves a determination that the land use change is consistent with applicable provisions of the Garfield County Comprehensive Plan agreements between the County and a municipality that applies to the area wh occur. The area which will be served by the water and sewer improvement review is included in the RFWSDs extended service area boundaries as described in the Service Plan Amendment approved by the Garfield County Commissioners by -28. The Service Plan is a component of the Garfield County ComprehensiveThe approving resolution and Service Plan are attached hereto as Exhibit A. The exhibit indicates the countys intent that the RFWSD provide water and wastewater service to this area and surrounding areas. A detailed map of the Service Area approved by the Commissioners Exhibit A. The RFWSD approved a Pre-Inclusion Agreement with CI and GCCI concerning the construction of the facilities identified herein. CI will petition for inclusion within the RFWSD boundaries upon the approval of a final plat pursuant to the terms of that Pre-Inclusion Agreement. GCCI will petition for inclusion upon approval of a development plan for the property. In addition to the recognition of the approved Service Plan as p Comprehensive Plan, the Comprehensive Plan states: The Plan recognizes new major subdivisions may occur, but encourages them to be more self-sufficient (having, or being near, convenience services). In order to be more self-sufficient, new major subdivisions will require...central water and sewer is provided through a special -public, not private) (pg 21-22). The proposed expansion of RFWSD facilities within the approved Service Plan Area and designated Unincorporated Community (pg 20, pg 29, and map designation of area within RFWSD Service Plan Area on Future Land Use Map) faciitates the development of RFWSD 5 Location and Extent Application Materials the Unincorporated Community and provision of service to propert site in coordination with the goals of the Comprehensive Plan. The RFWSD has included in the design parameters over-sizing requirements to provide for anticipated build-out within the Amended Service Plan Area (Exhibit B) in an effort to meet the Countys goals and objectives. Additionally the Comprehensive Plan states as policies and strat Policies- 1. Development located adjacent to municipalities or sanitation districts with capacity in their central water/sewer systems will be encouraged systems. 2. County will strongly discourage the proliferation of private cen systems. Special district or metro districts should only be consider circumstances and only after other option with municipal governm unfeasible after an objective review process. Strategies- 1.Work with existing special districts to coordinate their plans with county policies and plans. 2.Encourage special districts to expand services to development o the unincorporated areas. The proposed facilities will allow the REC development to tie into the existing RFWSD sy and expand that system to new development in an unincorporated a It is also consistent with the RFWSD Amended Service Plan and Ga the RFWSD as the Regional Service Provider for the area. e. Other Applicable Review Standards (Section 7-106) Part A.1 of this Section states: Central Water Distribution System Preferred. Where water service through a water supply entity is not physically or economically feasible, a central well and distribution system is preferred over individual wells (Resoluti-29). The facilities identified are necessary components of an expande RFWSD Service Area and provide for the RFWSD to meet the needs of property owners for economically feasible water supply within the RFWSD Service Water will be provided to the REC through a central water distribution syst Part A.3 of this Section states: The water distribution system shall be designed by a qualified professional engineer licensed by the State of Colorado and shal Department of Public Health and Environment and the County and including The water distribution system shall be sized to meet both the initial and future demands of the proposed development. The system components will also be reviewed and permitted by the Colorado Department of Public Health and Environment in accordance with their standards. Part B.1 of this Section states: Every effort shall be made to secure a public sewer extension. Where connections to an existing public sewer are not physically or economically feasible, a central collection system and treatment plant is preferred. Certain of the facilities contemplated in this Application are f sewer extension to connect to the REC to the RFWSDs existing wastewater treatment plant.
