FINDINGS OF FACT, RULING OF REFEREE AND DECREE OF COURT
Creekside Ranch ("Applicant") filed an Application for Underground Water Rights,
Surface Water Rights, Storage Water Right, Change of Water Rights, and Plan for
Augmentation on December 28, 2000. In accordance with C.R.S. §37-92-203(7), the Water
Judge referred the subject Application to the Water Referee for Water Division No. 5, State
of Colorado.
The Referee has made such investigations as are necessary to determine whether or
not the statements in the Application are true, has become fully advised with respect to the
subject matter of the Application, and has consulted with the Division Engineer for Water
Division No. 5. He hereby makes the following determinations and ruling as the Referee
in this matter.
FINDINGS OF FACT
1. The statements in the Application are true.
2. Creekside Ranch is the Applicant herein.
3. Neither the subject water rights nor their sources are located within a
designated groundwater basin.

24. Historic Use: Applicant's share of the Oak Grove Ditch has historically
irrigated 13.6 acres of Applicant's lands.
25. Proposed change: Applicant intends to dry up 2.93 acres of land historically
irrigated by the Oak Grove Ditch and use the historic consumptive use
associated with the dry up for augmentation. A historic consumptive use
analysis is attached as Exhibit A. A map of the dry up area is attached as
Exhibit B.
26. Claim for Augmentation Plan: Applicant claims the following plan for
augmentation:

27. Previous decree for water rights to be used for augmentation: Dry up credits
from Applicant's interest in the Oak Grove Ditch and Creekside Ranch Pond
described above.
28. Statement of plan for augmentation: The Stark Well, Creekside Ranch Well
No. 1 and Creekside Ranch Well No. 2 will divert under their own junior
water rights while in priority. When out of priority, consumptive use
depletions from the Stark Well, Creekside Ranch Well No. 1 and Creekside
Ranch Well No. 2 will be augmented using consumptive use credits from the
Oak Grove Ditch and by releases from the Creekside Ranch Pond.
REQUIREMENTS
The Creekside Ranch water supply will support three single family dwellings,
commercial uses, and a livestock facility for up to 75 head of livestock. The
in-house use for each residential dwelling is assumed to be 350 gallons per
day. Wastewater treatment will be by septic tank and leach field. In-house
depletions to the stream system is estimated to be 15 percent of diversions.
It is estimated that each head of livestock will consume 10 gallons per day.
Commercial use of the property includes employee and public use of
restrooms and kitchen/snack bar facilities. We have assumed an average
daily use of 25 people requiring 10 gallons per day.
Existing irrigation on the property is from senior irrigation rights and no
irrigation is proposed from the potable water supply wells. Monthly
estimated water requirements are shown on the attached Table 1.
A 0.15 -acre pond is proposed on the property for augmentation purposes.
Net evaporation loses are estimated at 2.37 feet, and monthly distribution for
0.15 acre is shown on Table 2.
AUGMENTATION
The Elk Creek, and Colorado River systems are over -appropriated at some
times of the year. This plan provides for year-round augmentation, if

needed, in an extreme dry year. When out -of -priority, stream depletions will
be augmented using either consumptive use credits from the dry up of 2.93
acres under the Oak Grove Ditch or releases from the Creekside Ranch Pond.
An augmentation schedule is attached as Table 3.
RULING OF REFEREE AND DECREE OF COURT
The Referee has examined the information submitted by the Applicant and has
become advised with respect to the subject matter of the Application.
He Rules as follows:
1. The foregoing Findings are incorporated herein and made part of the Ruling
of Referee.
2. The Court has exclusive jurisdiction over the subject matter of this
proceedings pursuant to C.R.S. 337-92-203, and over all persons or entities
affected thereby, whether or not they have appeared.
3. The Application for Underground Water Rights, Surface Water Rights,
Storage Water Right, Change of Water Rights, and Plan for Augmentation
proposed by Applicant is such as is contemplated by law. If implemented
and administered in accordance with this decree, the Underground Water
Rights, Surface Water Rights, Storage Water Right, Change of Water Rights
and Plan for Augmentation described herein will provide water to the
Applicant without adversely affecting the owners or users of vested water
rights or decreed conditional water rights. The plan for augmentation
described herein may be lawfully decreed by this Court.
4. The State and Division Engineers may lawfully be required under the terms
of this ruling to:
a. Administer the plan for augmentation in the manner set forth herein.

b. Refrain from curtailing out -of -priority diversions of the Applicant's
augmented water rights when the depletions are offset by the
operation of the plan for augmentation approved herein.
5. The Referee rules that the Underground Water Rights, Surface Water Rights,
Storage Water Right, Change of Water Rights and Plan for Augmentation
described herein are approved.
6. Pursuant to C.R.S. §37-92-305(8), the State Engineer shall curtail all out -of -
priority diversions, the depletions from which are not so replaced as to
prevent injury to vested water rights.
7 The Applicant shall install measuring devices, provide accounting, and
supply calculations regarding the timing of depletions as required by the
Division Engineer for the operation of this plan. The Applicant shall also file
an annual report with the Division Engineer by November 15th of each year
summarizing diversions and replacements made under this plan.
8. The Applicant shall establish a homeowners association which shall be
responsible for ensuring that the terms and conditions of this decree are met.
9. In consideration of the specific findings and conclusions made herein and in
conformance with Colo. Rev. Stat. §37-92-304(6)(1990), as amended, the
approval of the Change of Water Rights and Plan for Augmentation decreed
herein shall be subject to reconsideration by the Water Judge on the question
of injury to the vested water rights of others for a period of five (5) calendar
years after 75% buildout of the development. If no petition for
reconsideration is filed within those five (5) years, retention of jurisdiction for
this purpose shall automatically expire.
10. Until the conditional water rights awarded herein are made absolute or
otherwise disposed of, Applicant shall file an Application for Finding of
Reasonable Diligence in every sixth calendar year after the calendar year in
which the conditional rights are herein decreed. Applicant is ordered to file
its first Application for Finding of Reasonable Diligence in the month of
DECEMBER , in the year 20 07 ,

IT IS ACCORDINGLY ORDERED that this Ruling shall be filed with the Water Clark
subject to judicial review pursuant to Colo. Rev. Stat. §37-92-304.

Engineer and the Division Engineer for Water Division No. 5.
