HomeMy WebLinkAbout1.01 Letter of RequestWe hereby request a waiver of standards for Section 7-203. Protection of Waterbodies, A. Minimum Setback of 35 feet. According to the Garfield County Land Use and Development Code, it is understood that a ‘waterbody’ includes Wetlands. In order to build a residence within the building envelope that was platted as part of the Ranch at Roaring Fork development, we are requesting a 5-foot setback from the ACOE/ERO Wetlands Delineation, as shown on the 2017 Updated Improvement Survey Plat (see Survey attached). Within the parameters of the building envelope, the proposed structure will adhere to the greatest setback distance possible from the wetlands boundary. Only one floating corner of one deck - without a column - will be 5 feet from the wetlands boundary. Otherwise, the concrete piers will be distanced at 8 feet, 10 feet, 13 feet, 15 feet, and 21 feet respectively (see Site Plans attached). Moreover, the residence will be elevated 5-7 feet from the existing ground level to avoid any impact near the wetland area. Pursuant to the Army Corps of Engineers (ACOE) 404 Permit # 199101233, the ACOE/ ERO Wetlands Delineation pertains to the approved application dated March 10, 1992 submitted by Mr. John Elder (see page 6 of Elder application documents attached). It also reflects the wetlands boundary depicted on the Elder Plat recorded April 13, 1995 AS reception No. 476659 (see Elder Plat attached), as referenced in Exhibit A of the Deed of Trust (see Deed of Trust attached). The ACOE 404 permit allowed for the development of ten single family residential lots, including Lot 6, with compensatory mitigation consisting of a tree and shrub buffer of 0.48 acres and the creation of .30 acres of emergent wetland (see Page 2, Secion III-1. of Elder application documents attached). In compliance with these permit conditions, the development thereby obtained all necessary permissions from both ACOE and Garfield County for development of residential Lot 6 adjacent to the wetland area. It is also our objective to protect the adjacent wetlands through the following measures: -Fencing will be installed at the time of construction along the wetland delineation to assure protection -No waste materials of any kind will be dumped or stored in the wetland area -To avoid any fill and excavation near the wetland area, the foundations will be built on concrete stilts/piers.
