GENERAL PROJECT DESCRIPTION The Applicant is requesting a waiver from SectionT-203(AX1) minimum setback of 35 ft. from a waterbody. The Land Use and Development Code includes wetlands as a waterbody subject to the setback requirement.. The Applicant's lot was platted and approved with a building envelope that.precluded development from in wetlands areas, however, it only established at 5 ft. setback from the delineated wetlands area. The great majority of the 0.588 acre lot is prectuded from development based on the wetlands. The limited width of the building envelope at approximately 42ft. supports the Applicant's request. The applicant is requesting a reduction in the setback to 5 ft. consistent with the approved building envelope. The site has a previously approved Floodplain Development Permit and the Applicant is in process to obtain a building permit for construction of a single family residence. II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS Garfield County Land Use and Development Code, as amended (LUDC) including the following Sections: Section 4-118 Waiver from Standards including review criteria 1 a o Table 4-102 - Common Review Procedures and Required Noticeo Table 4-201- Submittal Requirementso Section 4-203 - Submittal Requirements as appropriateo Section 7-203(A) - Protection of Water Bodies, Minimum Setbackso Article 15, Definition of a Waterbody III. REVIEW PROCESS The Waiver Request will be processed in processed pursuant to Section 4-103, Administrative Review Process and consistent with Table 4-102 Common Review procedures as follows: Pre-application Conference Application Submittal Determination of Completeness Schedule the Director's Decision Date Application sent to referral agencies as appropriate Public Notice for the Director's Decision completed. lncludes mailing to adjacent property owners within 200 ft. and mineral rights owners on the applicant's property. Evaluation by Director/Staff resulting in a Staff Report Director's Decision 10 day call up period, after which the Director's Decision become final unless the decision is called up the BOCC for their review Once all conditions of approval have been satisfied the Waiver Approval shall be final. IV. PUBLIC HEARINGS AND NOTICE Public Hearing notices shall be posted, mailed and published pursuant to Section 4-101.E X No Public Hearing (Director's Decision with mailed notice only) Planning Commission _Board of County Commissioners _Board of Adjustment Referral agencies may include but are not limited to: Garfield County Consulting Engineer, Garfield County Attorney, FEMA, and Army Corp of Engineers. V SUBMITTAL REQUIREMENTS General Application Materials including. Application Form including signatures. Site Plan - to applicable scale, including all proposed improvements and significant features, including the wetlands delineation' D. The Application will need to include details and plans for the proposed improvements.E. The submittals need to address compliance with the Review Criteria contained in Section 4-118. F. The submittals need to include any other existing reports, studies, and permits including but not limited to any past review by the Army Corp of Engineers, wetlands analyses and floodplain development permits. Follow-up conversations with Staff and/or our Consulting Engineering are options if additional questions come up regarding the submittal requirements. The Application submittal needs to include 3 hard copies of the entire Application and 1 Digital PDF Copy of the entire Application (on a CD or USB Stick). Both the paper and digital coþies should be split into individual sections and properly labelled. Please refer to this pre- application summary for submittal requirements that are appropriate for your Application' VI. APPLICATION REVIEW FEES This application will be subject to the following fees and deposit requirements: Planning Review Fees: $ 250 (Additional Staff time charged at hourly rate of $40.50) ReferraiAgency Fees: $ tOO (Review fees associated with consulting engineer review) Total Deposit: $ 250 (additional fees to be determined by hourly rates) VII. GENERALAPPLICATIONPROCESSING The foregoing summary is advisory in nature only and is not binding on the County. The summary is básed on current zoning, which is subject to change in the future, and upon factual representations that may or may not be accurate. This summary does not create a legal or vested right. The summary is valid for a six month period, after which an update should be requesteá. The Applicant is advised that the Application submittal once accepted by the County becomes public information and will be available (including electronically) for review by the public.
