I. DESCRTPTION OF THE PROPOSAL
The Applicant is requesting an Amended Plat to amend the building envelope of Lot E-L0 of Filing
No. 1 of the Aspen Glen Subdivision in order to build an addition onto the existing house. The lot
is 0.542 acres in size. Access to the parcel is by way of Puma within the PUD. The lot is currently
improved with a 3,805 square foot house. The parcel is situated near an artificial (man-made)
pond to the wesU as the Land Use and Development Code does not consider artificial ponds to
be waterbodies, the 35-foot waterbody setback does not apply. No other changes are being
proposed with the plat amendment and no other adjustments to the affected property lines are
being requested. ln addition, no noncomforming conditions have been noted which would result
from the lot line adjustment. The Aspen Glen Design Review Committee has reviewed and
approved the proposed plat amendment.
The Applicant is requesting a waiver from the submittal requirements for an lmprovements
Agreement. This request is deemed appropriate for the Application as no new improvements are
proposed or required as a result of the Amended Plat.

The parcel is located in the Aspen Glen Planned Unit Development northwest of the Town of
Carbondale. lt is accessed via private roads from Highway 82 or County Road 1-09. The parcel is
situated adjacent to an artificial pond and the topography is generally flat.

ItI. AUTHORITY - APPLICABLE REGULATIONS
The Amended Final Plat Application is processed in accordance with Section 5-305, Amended
Final Plat Review and Tables 5-103 Common Review Procedures. Section 4-LO3 and 4-10L address
details of the review procedures.
The Application has been determined to be complete including the waiver requests addressing
the fact that an lmprovements Agreement is not warranted for the Plat Amendment Request.
Public notice was required for the Director's Decision in accordance with Sections 4-103 and 4-
101.
IV. PUBLIC AND REFERRAL COMMENTS
The Applicant has provided documentation that all required notice mailings have been
completed in accordance with the LUDC. No public comments were received. Referral Comments
received on the Application are attached as Exhibits and summarized below:
1. Garfield County Surveyor (Exhibit 7): The purpose of the plat should be stated in the
heading or notes.
2. Aspen Glen Design Review Committee (Exhibits 8-L0): Recommends approvalof the plat
amendment with conditions.
V. STAFF ANALYSIS AND CRITERIA
1. The Applicant's proposalwas reviewed against the Amended Final Plat Criteria contained
in Section 5-305 (C), as follows:
a. Does not increase the number of lots
- The proposed Amended Plat will not increose the number of lots.
b. Does not result in a major relocation of a road or add any new roads; or
- The proposed Amended Plot will not result in a mojor relocation of a rood or add
new roads.
c. Will correct technical errors such as surveying or drafting errors.
- The Amended Plot has not been proposed to correct technical errors.
2. No conflicts with the existing underlying zoning have been noted including lot size and
setbacks.
3. No changes to existing utility locations or access are proposed as part of the amended
plat process.
4. The Application was referred to the County Surveyor who had one minor edit for the plat.
5. The property is located in the Residential Medium Hieh (2 to <6 acres per dwelling unit)
designation on the Future land Use Map in the Garfield County Comprehensive Plan 2030.
No new development is proposed which would affect the existing density in the PUD as a
result of the modification of the building envelope.
VI. SUGGESTED FINDINGS AND RECOMMENDATION
Staff supports a finding that the Aspen Glen Filing No. 1 Lot E-10 Amended Final Plat Application
meets the requirements and standards of the Garfield County Land Use and Development Code
as amended and is recommended for Administrative Approval by the Director of the Community
Development Department subject to the following conditions of approval:
Suggested Findings
1. That proper public notice was provided as required for the Director's Decision.
2. Consideration of the Application was extensive and complete, that all pertinent facts,
matters and issues were submitted and that all interested parties were given an
opportunity to provide input prior to the Director's decision.
3. That for the above stated and other reasons, the proposed amended plat is in the best
interest of the health, safety, convenience, order, prosperity and welfare of the citizens
of Garfield County.
4. That the application is in general conformance with the 2030 Comprehensive Plan, as
amended.
5. That with the adoption of conditions and for the above stated and other reasons the
application has adequately met the requirements of the Garfield County Land Use and
Development Code, as amended.
Recommended Conditions of Approval
7. All representations of the Applicant contained in the Application submittals shall be
conditions of approval unless specifically amended or modified by the conditions
contained herein.
2. The proposed plat shall be updated and edited as follows prior to submittal for final
review by the County:
a. ln order for roof overhangs to be fully within the new building envelope, the final
plat shall incorporate the minor building envelope modification submitted to Staff
on June 9,2OL9.
b. Edit the plat so that the distinction between the original building envelope, the
current expansion of the building envelope and any other prior modifications to
the building envelope are more apparen! as submitted it is very difficult to
decipher.
c. All improvements shall be removed from the plat.

d. Move the purpose statement in the plat notes to beneath the plat title.
e. Reference the first amended plat (Reception No. 803496) in the plat notes.
f. Remove "20' County Rear Setback" label and line from the plat.
g. lnclude "0.542 acres" above the parcel square footage label.
h. Add the Lienholder Consent and Subordination signature block to the plat.
i. All plat certificates shall match standard certificate format from Section 3-02.D of
the County Resource Guide; please correct Certificate of Dedication and
Ownership and County Com missioner's Certificate.
j. The plat should reference the submitted title commitment and state that all
easements and encumbrances are shown.
3. The Plat shall be subject to final review and approval by County Staff, including Garfield
County Attorney's Office and Garfield County Surveyor, prior to submittal of the Mylar
plat for final execution, BOCC signature and recording.
4. The Applicant has 90 days within which to satisfy conditions of approval and provide the
following documentation for BOCC signature and recordation:
a. A plat Mylar with signed Certificates that include Dedication, Ownership, Title,
Taxes, Applicant's Surveyor, Lienholders and any mortgagees.
b. Recording fees.

Dear Tricia,
This letter is to confitm that the Aspen GIen Design Review Comrnittee (DRC) reviewed
the proposed plat amendment to adjust the building envelope on lot E-10, to
accommodate the addition of an enclosed living space and overhang within an adjusted
building envelope. The DRC reviewed the plat amendment at the April 3rd, 2019 r'egular
meeting.
The DRC noticed property owners within the vicinity of the property and there were no
objections.
The DRC recomnends apptoval to the Garfield County Board of County Commissioners
with the following conditions:
L A copy of the recorded amended plat shall be provided to the Aspen Glen DRC.
2- It is the responsibility of the property owler to ensure that this building envelope
adjustment does not negatively affect the drainage easement or the pond.
3. The DRC is with the understanding that the architect, Tim Hagman, reviewed the
project with the groundskeeper, Jake Falke at ClubCorp , on 4ll5ll9 and received
approval in regard to proximity to adjacent pond.
4. The DRC has only approved the building envelope modification. Any further
improvements to the property require final DRC review and approval.

Dear Ms. Dalby:
The Aspen Glen Design Review Committee (DRC) received your notification that the DRC approved and
submitted Building Envelope Adjustment for lot E-10 needs to be revised to accommodate the L8" roof
overhangs. Bruce Upton of Bear Creek Construction brought this to the attention of the DRC at our
regular meeting on Weds, July 10 along with the newly amended plat revised by Lines in Space
Surveyors (attached).
The DRC unanimously approved the newly amended plat for the Butler Residence based on the reason
stated above. Please consider this letter as your formal notification of approval.
