DESCRIPTION OF PROPOSAL . REQUEST The Applicant is requesting approval of an Amended Final Plat application for 5 Lots in the Antiers Orchard'Subdiv¡sion. The proposed amendment would combine portions of Tracts 2g,25, and 39 that are split bythe County Road, into one lot. Additionally, the applicant proposes to move Tract 26 to the original location of Tract 28. This would split fiåct 28 in half, but would not create any new lots, as Tract 26 was part of the original Antlers Orchard Subdivision. Access to Tracts 23,25, and 39 is directly onto the County Road. Access to Tracts 26 and 28 is proposed via a 40' Access Easement that is memorialized at Reception No. 91g5gg. This newly recorded document updates and extends the easement that was originally in place via the original Antlers Orchard Subdivision Plat. The applicant has indicated that water will be supplied via welts and wastewater will be handled through Onsite Wastewater Treatment Systems. The An¡ers Orchard Subdivision was platted in 1908 in the area north of Silt. The original plat generally created 1O-acre parcels. County or State Subdivision regulations were not in ptãce duriñg the creation of Antlers Orchard. As such, demonstrations of physicalwater have not been reviewed for the Subdivision. II. AUTHORITY - APPLICABLE REGULATIONS The Amended Final Plat Application is being processed in accordance with Section 5- 305, Amended Final Plat and 4-103, Administrative Review of the Land Use and Development Code, as amended. Public notice is required in accordance with Sections 4-1Og and 4-101 and the Applicant has provided documentation that all required public notice has been comPleted. III. PUBLIC AND REFERRAL COMMENTS Seven public comments have been received as a result of public notice. All comments were in opposition to the proposed Amended Final Plat. Reasons included: water supply questions, increased density, traffic, and lack of compatibility, mainly with regards to the relocation of Tract 26. Public comments are available in their entirety as Exhibits 9 - 14 and 17. Referral Comments received on the Application are attached as Exhibits and summarized below: Garfield County Desisnated Enqineer (Exhibit n: ldentified potential issues related largely to the splitting of Tract 28 with Tract 26. lssues included the lack of a physical water supply, the floodplain in the area of the proposed access, and the loss of physical access off of the County Road. Garfield Countv Road and Bridoe lExhibit 8)No concerns were identified with the proposal. Division of Water Resources (Exhi bir 15):No objections were noted as long as the applicant obtains the appropriate well permits for the proposed uses. Town of Silt (Exhibit 16): The application was reviewed by the Town of Silt's Planning and Zoning Commission. No comments were noted. Referral Aoencies with No Resoonse Garfield County Surveyor, Holy Cross Energy, Xcel Energy IV. STAFF ANALYSIS 1. The applicant's proposal was reviewed against the Amended Final Plat Criteria contained in Section 5-305 (C), as follows: a. Does not increase the number of lots; and The proposed Amended Final Plat does not increase the number of lots. b. Does not result in the major relocation of a road or add any new roads; The proposed Amended Final Plat will not result in a maior relocation of a road or add new roads. The applicant has supplied an additional easement fo access Tracts 26 and 28, however, the existing easements from 1908 are still in place. c. Will correct technical errors such as surveying or drafting errors. The Amended Final PIat has not been proposed to correct technical errors. 2. No conflicts with the existing underlying zoning have been noted including lot size 2 and setbacks. 3. The applicant has indicated that no changes or impacts are anticipated with regards to Article 7 Divisions 1-3 of the Land Use and Development Code. 4. The proposed access easement crosses a portion of floodplain that was mapped according to a Soil Conservation Survey Study completed for the Town of Silt, as well as a perennial water body. The water body passes through a culvert in the easement location. The floodplain appears to be located on portions of Tract 23, 25, 26 and 39 as well as in locations that cross the proposed access easement. There also appears to be potentialwetlands on the parcel based on Staff's review of the national wetlands database and a site visit. These items were not fully addressed as part of the applicant's submittal. 5. The referral engineer's comments indicated that the Amended Final Plat application would move Tract 26 from County Road access and away from a physical water supply. Legal access is still available via an access easement that the applicant has finalized. However, it is unknown whether physical access can be provided in compliance with County requirements particularly with regards to floodplain. Legal water is not an issue, as indicated in the Division of Water Resource's referral comments Because the Antler's Orchard Subdivision was created prior to County subdivision regulations, there is no demonstration of physical water provided for the parcels. The referral engineer also indicated The application to combine parcels into Tract 39 seerns to be straightforward enough. The majority of the rssues seem to be with splitting Tract 28 and relocating Tract 26. The applicant appears to be creating a parcelthat has inherentissues with water supply, flood plain, and access. The applicant should provide justification for the apparent shortcomings. Staff agrees with the referral engineer's assessment and has approved a portion of the application related to fixing parcel boundaries that cross the County Road. Staff does not recommend approval of the relocation of Tract 26. 6. The Comprehensive Plan designation for the area is Residential Medium/High, which recommends that the density of parcels is 2-6 acres per dwelling unit. Tract 39 appears to be located in the Town of Silt's Urban Growth Boundary (UGB), while the remainder of the proposal appears to be located outside of the UGB. The Town of Silt responded with referral comments that indicated they did not have any issues with the proposal. The application is compliant with Comprehensive Plan requirements. 7. The parcel is zoned Rural, which permits a minimum lot size of two acres. The a -1 application is compliant with this Land Use Code provision. 8. The moving of Tract 26, to the northern half of Tract 28, has a number of impacts that are not normally addressed in the Amended Final Plat process and which the applicant has not fully addressed in the submittal. These impacts were not reviewed at the time of the original subdivision. Wetlands, access through a floodplain, and the adequacy of physical access for an additional easement are all unaddressed issues. These items were all identified in the referral engineer's comments. Based on Staff's review and referral comments, Staff is supportive of the applicant's request to adjust the lot lines that cross the County Road, but is not supportive of the relocation of Tract 26 within Tract 28. When Tract 26 remains in its current location, it does not lose physical access to the County Road and is closerto the existing physicalwater supply. Additionally, potentialfloodplain issues and wetlands already exist on Tract 26 and the Staff's conditional approval increases the lot size, which makes future development of the lot easier. The amendment to merge parcels that are split by the County Road is supported by Staff. Conditions of Approval have been included that outline Staff's recommended approval. This includes maintaining Tract 26 in its original location and merging the portions of Tracts 23 and 25 that are south of the County Road with Tract 26. Tract 39 will stay in its original location. The portion of Tract 26 that is north of the County Road will be merged with Tract 23. An image of the Amended Final Plat with Staff's changes is included on the last page of this document. V. SUGGESTED FINDINGS AND RECOMMENDATION Staff supports a finding that a portion of the Amended Final Plat Application for Tracts 23, 25, 26,28, and 39 meets the requirements and standards of the Garfield County Land Use and Development Code as amended including the Review Criteria contained in Section 5-305 (C) and is recommended for Administrative Approval by the Director of the Community Development Department subject to the following conditions of approval and findings. Suggested Findings 1. That proper public notice was provided as required for the Director's Decision 2. That the application, with the adoption of conditions, is in general conformance with the 2030 Comprehensive Plan, as amended. 3. That with the adoption of conditions, the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. 4 Recommended Conditions of Approval 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. Final review by the County Surveyor's Office shall be required and all edits and corrections based on that review shall be completed prior to submittal of the plat for signature by the Board of County Commissioners. 3. The plat shall be updated and edited prior to submittal for final review by the Community Development Department and the County Attorney's Office as follows (additional updates or changes may be required pending the final review): a. The Lienholder Consent and Subordination Certificate and the Certificate of Dedication and Ownership shall be updated to reflect the County Resource Guide. b. The plat shall be updated to include the County Commissioner's Certificate as reflected in the County Resource Guide. c. Surveyor Note 5(c) shall be updated to correct the Reception Number. d. The Mineral Owners shall be included on the plat. e. The plat shall be updated to show that Tract 39 and Tract 28 are not being adjusted. Tract 26 shall remain in its original location, but shall be merged with adjacent parcels as follows: the portion of Tract 26 that is south of the County Road shall be merged with the portions of Tract 23 and 25 that are south of the County Road. The portion of Tract 26 that is north of the County Road shall be merged with Tract 23 as shown on the submitted Plat. The remainder of the plat shall be updated to reflect this change, including the title. f . A plat note shall be added that states: "At time of Building Permit, the applicant shall be required to address floodplain issues on Amended Tract 26.', 4. Once reviewed and approved for Mylar the applicant shall supply: a. The submittal was found to be thorough and well organized. The review generated the following contments: l. The Applicant seerns to be splitting Tract 28 in two and Tract 26 will occupy the norlhern portion. I am extremely concerned and strongly object to the proposed lot line adjustment (Tract 26 & Tract 28) being suggested here. Predominately, these have always been ten acre parcels and that is a very strong appealwhen looking to buy property in this area. I own a home that has to be appraised at half its values because there are no comparables in the area to justify what my home is truly worth. lt is a huge concern to me that the ten acre parcel in front of my home just happens to be the lot on which Mr. Pollard wants to subdivide into two acre parcels. This seems very suspicious because the markers Mr. Pollard has put in the field clearly show that his first ideas were to subdivide Tract2l in the north east corner of the Antlers Subdivision. lt is extremely obvious that Mr. Pollard could definitely benefit from splitting the lot in front of my house and charge more for those lots to enjoy the view of my home. And while my property values go down, Mr. Pollards property values go up by taking advantage of my home. My Property is at huge risk of someone putting a mobile home in my front yard. This proposed lot line adjustment increases that chance by another 50%. I have health issues that this would atfect as well. My property sits on the west side at the end of a lane with no drive by traffic. I bought this home because the one thing I am allergic to is dust. The proposed subdivision sits exactly west of my front yard and the lot line adjustment guarantees me twice as much dust to deal with than with keeping it a ten acre parcel. Property values and allergies aside, tiis subdivision could have a major impact on our water supplies. Panoramic Drive residents just south of our subdivision are already having problems with water before another subdivision starts lowering the water table. While it appears the new county codes do permit this change, I believe that the original Plat Plan from 1908 should Grandfather the new codes recently put in place. My biggest concern in the amount of water available to people. We have a community well with 22homes on that well and there have been times when we didn't have water because there \ilasn't enough water in the well. If people are allowed to keep building homes up here there won't be any water available to anybody . I or 2 homes might not hurt the water tables but 50 or 60 more homes will deplete that water and soon nobody will have any water. As a Senior Planner for Garfield County it is your responsibility to prevent that water shortage from happening. V/hat you're doing may be legal but is it the responsible thing to do for the people already living up here? If the people up here run out of water and get mad enough we can always file a class action lawsuit against Garfield County for negligence.
