The Applicant is requesting an Amended Plat to combine Lots D-7 and D-8 of Filing No. l of the
Aspen Glen Subdivision into one lot. Lot D-7 is 0.939 acres; Lot D-8 tsO.74 acres. Access to the
parcels is by way of Aspen Glo Lane within the PUD. Lot D-7 is improved with a single-family
dwelling unit; Lot D-8 is unimproved. The Applicant requested in the application and plat to keep
both building envelopes; because this is not permitted by the Aspen Glen Design Review
Committee, Staff has included a Condition of Approval that the building envelope on Lot D-8 be
removed. No other changes are being proposed and no other adjustments to the affected
property lines are being requested. ln addition, no noncomforming conditions have been noted
which would result from the lot line adjustment. The Aspen Glen Design Review Committee
approves the plat amendment as long as the second building envelope is dissolved.
The Applicant is requesting a waiver from the submittal requirements for an lmprovements
Agreement. This request is deemed appropriate for the Application as no new improvements are
proposed or required as a result of the Amended Plat.

The parcels are located in the Aspen Glen Planned Unit Development northwest of the Town of
Carbondale. The parcels are accessed via private roads from Highway 82 or County Road 109. The

topography is generally flat
III, AUTHORITY - APPLICABLE REGULATIONS
The Amended Final Plat Application is processed in accordance with Section 5-305, Amended
Final Plat Review and Tables 5-1-03 Common Review Procedures. Section 4-1-03 and 4-101- address
details of the review procedures.
The Application has been determined to be complete including the waiver requests addressing
the fact that an lmprovements Agreement is not warranted for the Plat Amendment Request.
Public notice was required for the Director's Decision in accordance with Sections 4-103 and 4-
1_01.
¡V. PUBTIC AND REFSRRAL COMMENTS
The Applicant has provided documentat¡on that all required notice mailings have been
completed in accordance with the LUDC. No public comments were received. Referral Comments
received on the Application are attached as Exhibits and summarized below:
L. Garfield County Surveyor (Exhibit 7): No concerns or objections with the proposal.
2. Aspen Glen Design Review Committee (Exhibit 8): Recommends approval of the plat
amendment with conditions as long as only one building envelope exists on the newly
merged lot.
V. STAFF ANALYSIS AND CRITERIA
L. The Applicant's proposalwas reviewed against the Amended Final Plat Criteria contained
in Section 5-305 (C), as follows:
a. Does not increase the number of lots
- The proposed Amended Plot will not increase the number of lots'
b. Does not result in a major relocation of a road or add any new roads; or
- The proposed Amended Plat will not result in a major relocotion of a rood or odd
new roads.
c. Will correct technical errors such as surveying or drafting errors.
- The Amended Plot has not been proposed to correct technical errors.
2. No conflicts with the existing underlying zoning have been noted including lot size and
setbacks.
3. No changes to existing utility locations or access are proposed as part of the amended
plat process.
4. The Application was referred to the County Surveyor who had no concerns or objections
with the proposal.

5. The property is located in the Residential Medium High (2 to <6 acres per dwelling unit)
designation on the Future land Use Map in the Garfield County Comprehensive Plan 2030.
No new development is proposed which would affect the existing density in the PUD as a
result of the modification to the lot lines.
Staff supports a finding that the Aspen Glen Filing No. 1 Parcels D-7 and D-8 Amended Final Plat
Application meets the requirements and standards of the Garfield County Land Use and
Development Code as amended and is recommended for Administrative Approval by the Director
of the Community Development Department subject to the following conditions of approval:
Suggested Findings
L. That proper public notice was provided as required for the Director's Decision.
2. Consideration of the Application was extensive and complete, that all pertinent facts,
matters and issues were submitted and that all interested parties were given an
opportunity to provide input prior to the Director's decision.
3. That for the above stated and other reasons, the proposed amended plat is in the best
interest of the health, safety, convenience, order, prosperity and welfare of the c¡t¡zens
of Garfield County.
4. That the application is in general conformance with the 2030 Comprehensive Plan, as
amended.
5. That with the adoption of conditions and for the above stated and other reasons the
applicatiott has adequately mel the requirements of the Garfleld County Land Use and
Development Code, as amended
Recommended Conditions of Approval
L. All representations of the Applicant conta¡ned in the Application submittals shall be
conditions of approval unless specifically amended or modifíed by the conditions
contained herein.
2. The proposed plat shall be updated and edited as follows prior to submittal for final
review by the County:
a. lndicate that the building envelope on Lot D-8 is vacated with this plat.
b. Assign a new lot identifier (for example, "D-7A") to the newly merged lot. This
should be shown in the title description, plat and legal descriptions within the
Certificate of Dedication and Ownership and Surveyor's Certificate.

c. A plat note shall be added referencing the original Aspen Glen Filing No. 1 Plat
(Reception No. 476330).
d. A plat note shall be added affirming that all plat notes from the original plat
referenced shall remain in effect.
e. Change "Line to be dissolved by this Amended Plat" to "Lot line vacated by this
plat".
f. Correct the property owner names under the signature lines within the Certificate
of Dedication and Ownership.
g. All dates on the plat shall be updated to 2019.
3. The Plat shall be subject to final review and approval by County Stafl including Garfield
County Attorney's Office and Garfield County Surveyor, prior to submittal of the Mylar
plat for final execution, BOCC signature and recording.
4. The Applicant has 90 days within which to satisfy conditions of approval and provide the
following documentat¡on for BOCC signature and recordation:
a. A plat Mylar with signed Certificates that include Dedication, Ownership, Title,
Taxes, Applicant's Surveyor, Lienholders and any mortgagees.
b. Recording fees.

Upon review of the Amended Final Plat of Lot D7 and D8, Aspen Glen Filing No. I Plat, I have no comments
or corrections to be made prior to approval for survey content and form as follows:
Once all final comments from Community Development have been completed, the Mylar may be prepared for
recording. The Mylar shall be delivered to the Community Development office with all private party signatures
no later than Monday the week prior to the next commissioner meeting day in order to make that meeting.

Dear Tricia,
This letter is to confirm that the Aspen Glen Design Review Committee (DRC) reviewed
the proposed plat amendment to combine Lots D-7 (77 Alpen Glo) & D-8 into one lot
and remove the building envelope on lot D-8. The DRC reviewed the plat amendment at
the April 17,2019 regular meeting.
The DRC recommends approval to the Garf,reld County Board of County Commissioners
with the following conditions:
L A copy of the recorded amended plat shall be provided to the Aspen Glen DRC.
2. Tlte DRC has only approvctl the lot l.ie and removal of the D-8 buikling envelope.
There are no further improvements to the property.
Reference: Lot D-7 & D-S lmprovement Survey Plat dated 4ll5ll9.
