DIRECTOR DETERMINATION - Aspen Glen Lots D7 & D8 Filing No. L Amended Final Plat
(FPAA-os-19-8730)
Dear Mr. Neiley,
This letter is provided to you, as the authorized representative for Garfield County File FPAA-OS-
19-8730 pertaining to an Amended Final Plat to merge Lots D-7 and D-8 of the Aspen Glen
Subdivision. This letter is notification that your request to amend the final plat has been reviewed
by the Community Development Department and the Director hereby issues a determination
conditionally approving the request. The conditions of approval are as follows:
1,. All representations of the Applicant contained in the Application submittals shall be
conditions of approval unless specifically amended or modified by the conditions
contained herein.
2. The proposed plat shall be updated and edited as follows prior to submittal for final
review by the County:
a. lndicate that the building envelope on Lot D-8 is vacated with this plat.
b. Assign a new lot identifier (for example, "D-7A" ) to the newly merged lot. This
should be shown in the title description, plat and legal descriptions within the
Certificate of Dedication and Ownership and Surveyor's Certificate.
c. A plat note shall be added referencing the original Aspen Glen Filing No. L Plat
(Reception No. 476330).
d. A plat note shall be added affirming that all plat notes from the original plat
referenced shall remain in effect.

e. Change "Line to be dissolved by this Amended Plat" to "Lot line vacated by this
plat".
1. Correct the property owner names under the signature lines within the Certificate
of Dedication and OwnershiP.
g. All dates on the plat shall be updated to 20L9.
3. The Plat shall be subject to final review and approval by County Staff, including Garfield
County Attorney's Office and Garfield County Surveyor, prior to submittal of the Mylar
plat for final execution, BOCC signature and recording.
4. The Applicant has 90 days within which to satisfy conditions of approval and provide the
following documentation for BOCC signature and recordation:
a. A plat Mylar with signed Certificates that include Dedication, Ownership, Title,
Taxes, Applicant's Surveyor, Lienholders and any mortgagees.
b. Recording fees.
Notice of this decision will be provided to the Board of County Commissioners who has the ability
to 'call-up'the application for review at a public hearing. You will be notified of the Board decision
once it is received or upon expiration of the 10 day notice period (July 1, 2OL9l.
