GENERAL PROJECT DESCRIPTION The applicant is proposing to build an additional structure on the property for the operation of an existing fire station. This includes the addition of a 2 -bay garage for the storage of fire apparatus, as well as additional storage and a "turnout" room for fire fighter equipment and protective gear. The proposed site plan also reflects potential improvements for staff/volunteer/guest parking and circulation improvements. The parcel is currently improved with an existing fire station including apparatus bays and crew quarters. Because the property is owned by a public entity, the proposal will need to be reviewed under the statutory requirements of a Location and Extent Review, consistent with Section 4-111 of the Land Use and Development Code. The project architects are also undertaking preliminary studies to see what portion of the subject site may be possible for future expansion so that the County is aware of future growth potential if District Voters request further expansion sometime in the future. A Location and Extent Review by the County is required because the property is owned by a public entity. PROPERTY BACKGROUND: The subject property was acquired in 1992 by the Fire District from a previous owner of the H Lazy F. Initial facilities for the fire station were constructed in the mid-1990s. An expansion also occurred in 2005. That expansion included a crew quarters approximately 1560 ft.2 in size which includes two bathrooms, four bedrooms and associated areas for staff personnel. The property itself is approximately 0.84 acres in size and is triangular in nature. The parcel has a flat topography with soils typical of those in the area of the H Lazy F and surrounding areas. Access is from County Road 154. The property is served by a local wastewater and domestic water system. There are no known environmental or engineering constraints. PROJECT BACKGROUND: The Fire District updated their Master Plan in 2015. That Master Plan examined internal operations, station facilities and related infrastructure, apparatus and equipment status and plans for replacement. District voters approved a $7.5 million bond issue in November 2018 for apparatus and equipment replacement and facilities construction. $3.5 million was allocated for facility design and construction. The planned expansion of Station 84 is part of this project. a PRESENT FACILITIES: The Station 84 primary structure includes a 3- bay truck/vehicle storage area, a small operations/staff room and equipment/bunker gear storage area. A driveway and related circulation/apron occur off County Road 154. The previously mentioned crew quarters are towards the rear or western edge of the property. PROPOSED EXPANSION: The District proposes to build 2 new apparatus bays approximately 2,450 ft.2 in size. The vehicle circulation aprons will also be expanded. Complies COMPREHENSIVE PLAN: The main review criterion for a Location and Extent review his compliance with the Garfield County Comprehensive Plan 2030. We have reviewed the Comprehensive Plan and will demonstrate compliance. At this point, we are providing information for the initial portions of the Comprehensive Plan. One point we have found is that while having adequate services for development, especially water and wastewater, is a primary concern of the Comprehensive Plan, other physical infrastructure (excepting transportation), is rarely mentioned. Please note that in our opinion nearly any policy, goal and/or strategy/action that mentions water and wastewater could also be mentioned in terms of other critical infrastructure — in this case — provision of safety infrastructure related to fighting structure fires, wildfires and providing emergency medical care/transport. These are the services that the Fire District provides. Another interesting thing we found is that many of the relevant Comprehensive Plan passages were in the introduction and future land use area sections of the Plan, not buried in some matrix or subset of a strategy/action. What we will do at this time is identify portions of the Comprehensive Plan which we think demonstrate compliance for the Fire District proposed expansion. Comments/explanations are shown in italics. The Fire District, by their planning and land use application or expansion of Station 84 is just the type of effective intergovernmental cooperation (of course, with County approval) that helps provide the desired and efficient services to which the Comprehensive Plan speaks. From this simple but fundamental direction emerges five major themes for future Land Use which are embodied in the Future Land Use Map (pages 18 — 19)". Comment: This Major theme of the Plan and direction it should take is self-explanatory. In this case, the Fire District has a major substation built in an area that is a Rural Employment Center, has adequate public services for growth and is immediately adjacent to a number of residential units, including a relatively dense modular/mobile home park. The H Lazy F is much more dense than most County residential developments. Chapter 3 — Plan Elements Section 1 - Urban Growth Areas and Intergovernmental Coordination Vision Statement Below "Garfield County has worked with municipalities to direct development to Urban Growth Areas where public services and infrastructure are provided in an efficient and cost- effective manner. Intergovernmental cooperation between municipalities and other public agencies has demonstrated successful collaboration and has resulted in the creation of new partnerships and collaborative efforts on behalf of the residents of the county". (p.34) Comment: The Fire District believes in this vision statement and by proposing this expansion in this location, demonstrates efforts to implement intergovernmental coordination for basic services in this growth/employment area within the County. Chapter 3 — Plan Elements Section 1 - Urban Growth Areas and Intergovernmental Coordination Goal # 2: Encourage future development requiring urban services to be located in areas where the services are or can readily be made available. Comment: Demonstrates compliance — proposing expansion in an area with services. This Fire District substation is in a good location, and besides being in a rural employment center and in an area where there are services available, it is also in that fringe area at the Glenwood Springs Fire District and the Carbondale Fire District boundaries. There are additional Comprehensive Plan Elements and chapters as well as specific issues, goals, policies and strategies/actions which we can address, but we feel at this point that we have demonstrated that the application for expansion of Station 84 complies with the Garfield County Comprehensive Plan 2030. MINERAL RIGHTS: The ownership of the land and mineral rights was researched the week of November 5, 2019. It is our opinion that the Fire District owns the mineral rights. NM 6 American Land Title Association Commitment Schedule B - Section 1 - Form 1004-5 DISCLOSURES Colorado Division of Insurance Regulation 8-1-2, Section 5, Paragraph F provides: "Whenever a title entity provides the closing and settlement service that is in conjunction with the issuance of an owner's policy of title insurance, it shall update the title commitment from the date of issuance to be as reasonably close to the time of closing as permitted by the real estate records. The Company must receive appropriate affidavits indemnifying the Company against all unfiled mechanic's and materialmen's liens. D. Any deviation from conditions A through C above is subject to such additional requirements or information as the Company may deem necessary; or, at its option, the Company may refuse to delete the exception. No coverage will be given under any circumstances for labor or material for which the insured has contracted for or agreed to pay. Colorado Division of Insurance Regulation 8-1-2, Section 5, Paragraph M. Pursuant to Colorado Division of Insurance Regulation 8-1-3, notice is hereby given of the availability of a Closing Protection Letter which may, upon request, be provided to certain parties to the transaction. Pursuant to C.R.S. §10-11-122, notice is hereby given that: A) The subject real property may be located in a special taxing district; B) A Certificate of Taxes Due listing each taxing jurisdiction may be obtained from the County Treasurer's authorized agent; C) The information regarding special districts and the boundaries of such districts may be obtained from the Board of County Commissioners, the County Clerk and Recorder, or the County Assessor; and D) The company will not issue its policy of policies of title insurance contemplated by the commitment until it has been provided a Certificate of Taxes due from the County Treasurer or the County Treasurer's authorized agent; or until the Proposed Insured has notified or instructed the company in writing to the contrary C.R.S. §30-10-406 requires that all documents received for recording or filing in the clerk and recorder's office shall contain a top margin of at least one inch and a left, right, and bottom margin of at least one half of an inch. The clerk and recorder may refuse to record or file any document that does not conform. Pursuant to C.R.S. §10-11-123, notice is hereby given: This notice applies to owner's policy commitments containing a mineral severance instrument exception, or exceptions, in Schedule B, Section 2.
