(WWE) to support a No Rise Certification for the construction of the King Heatherly Diversion Structure Fish Passage Design (Project) at the existing King Heatherly Diversion Structure on East Divide Creek in Garfield County, Colorado. To summarize, this analysis indicates that the Project will not cause a rise in the Base Flood Elevations (BFEs) of East Divide Creek outside the proposed Project area and will not impact any structures. The area is highly remote with no structure in the vicinity and overall Project work will reduce impacts from future flooding and provide for more resilient ecosystem if a flood would occur. 2.0 PROJECT OVERVIEW The Project is located along East Divide Creek south of Silt, Colorado by 8 miles. The Project is located on a Bureau of Land Management's parcel. The diversion structure is considered a Pre - Federal Land Policy and Management Act (Pre-FLMPA) structure, therefore has reduced permitting required when work is performed in the area. The Project is located off of Highway 313 (East Divide Creek Road). There are no structures in the surrounding area. The closest structure up and downstream from the Project site is approximately 1 mile. Therefore, any effects from the proposed Project will not affect structures. The overall change in topography of the site will take place downstream of the diversion structure and the crest elevation of the diversion structure is not being modified, therefore no changes in the hydraulics will propagate upstream. The proposed Project is located in Section 20, Township 7 South, Range 91 West of the 6th Principal Meridian. See attached Location and Vicinity Map for additional information. The Project provides many environmental, agricultural, structural and safety benefits to the watershed. The Project includes the installation of an 80 -foot rock ramp at a slope of 5% to allow native bluehead sucker fish to navigate an existing 3 foot, vertical, diversion structure. These types of structures are known to have safety concerns associated with low head dams and can cause 181-047.000 November 2019 Wright Water Engineers, Inc. The Project will re-establish floodplain connection through the Project area as well as stabilize eroding banks. The existing diversion structure is severely undercut and has the potential of failing at any time. Therefore, the Project will also stabilize the existing diversion structure to keep it from failing in the future. The Project will provide for a more resilient and sustainable ecosystem. The area will be revegetated after construction to mimic surrounding conditions. The Project is a multi -benefit project being led by the Middle Colorado Watershed Council and is in alignment with the Colorado Water Plan and the Colorado River Roundtable Basin Implementation Plan. A pre -application meeting took place with Glen Hartman from Garfield County as well as Michael Erion of Resource Engineering to discuss the Project and evaluation approach. 3.0 CONFORMANCE WITH LAND USE CODE This section outlines the various land use code requirements of Garfield County and addresses them for this Project directly or in subsequent sections. This Project meets the intent of applicable land use codes set forth by Garfield County. Below are overall excerpts and discussion on how the Code is met. Included in this document are more descriptive discussions as well as all the required submittal aspects. Section 3-301: Floodplain Overlay Regulations The Project fits within many of the allowed uses within Floodway and areas outside the Floodway but within the 100 -year floodplain, such as agricultural uses, open space structure not intended for human habitation, dams, irrigation structures, bank restoration and bank stabilization (3-301(A)). The Project meets the general standards for improvements by being adequately designed to prevent floatation, collapse, or lateral movement; will be constructed by methods to minimize flood damage; and with materials resistant to flood damage (3-301(B). It has been demonstrated through hydraulic modeling, in accordance with standard engineering practice, that the proposed Project would not result in an increase of the flood levels within the community during the occurrence of the Base Flood Discharge (3-301 (D)). Drainage is not near structures and will also not adversely impact adjacent properties (3-301(E)). The Project appropriately considered issues of sediment transport, erosion, deposition and channel migration; meets all applicable Federal, State, and local 181-047.000 November 2019 Wright Water Engineers, Inc. Page 2 Floodplain Development Report for King Heatherly Diversion Structure Fish Passage Design on East Divide Creek Floodplain requirements and regulations; and this report constitutes its hydraulic evaluation to show a No -Rise in base flood elevations within the floodway or floodplain (3-301(G)). Table 4-102: Common Review Procedures and Required Notice It is understood that this Project is subject to an Administrative Review and a decision can be made by the Director as shown in Table 4-102 of the Code. Section 4-109: Development in the 100 -Year Floodplain This document is to provide support of the Floodplain Development Permit application prior to any work being performed in the 100 -year floodplain. This document and the Project are in compliance with Section 3-301, Floodplain Overlay Regulations, and upon weighing the relevant factors listed below. Along with the relevant factors, how this project is in conformance with the section is noted. 1. The danger to life and property due to flooding or erosion damage; a. There will be no effect on the danger to life and property due to flooding or erosion damage caused by this project. 2. The susceptibility of the proposed facility and its contents to flood damage and the effect of such damage on the individual owner; a. There will be no effect on the susceptibility of the proposed facility and its contents to flood damage caused by this project. 3. The danger that materials may be swept onto other lands to the injury of others; a. There will be no danger that materials may be swept onto other lands to the injury of others caused by this project. 4. The compatibility of the proposed use with existing and anticipated development; a. There will be no effect on the compatibility of the proposed use with existing and anticipated development caused by this project. 5. The safety of access to the property in times of flood for ordinary and emergency vehicles; a. The costs of providing governmental services during and after flood conditions, including maintenance and repair of streets and bridges, and public utilities and facilities such as sewer, gas, electrical, and water systems; a. There will be no effect on the costs of providing governmental services during and after flood conditions, including maintenance and repair of streets and bridges, and public utilities and facilities such as sewer, gas, electrical, and water systems caused by this project. 7. The expected heights, velocity, duration, rate of rise, and sediment transport of the flood waters and the effects of wave action, if applicable, expected at the site; a. There will be no effect on the expected heights, velocity, duration, rate of rise, and sediment transport of the flood waters and the effects of wave action, if applicable, expected at the site caused by this project. 8. The necessity to the facility of a waterfront location, where applicable; a. The proposed `facility' is the enhancement of a diversion structure which must reside at a waterfront location. 9. The availability of alternative locations, not subject to flooding or erosion damage, for the proposed use; and a. The proposed work is taking place at an existing diversion structure therefore there are no alternative locations. 10. The relationship of the proposed use to the Comprehensive Plan for that area. a. The proposed use does not disagree with the Comprehensive Plan. Table 4-201: Application Submittal Requirements This document is to provide the required information as provided in Table 4-201 for development in the 100 -year floodplain. Included in this submittal are general application materials, a vicinity map, a site map, and a floodplain analysis as well as other supporting information required. Section 4-203: Description of Submittal Requirements A licensed Professional Engineer in the state of Colorado, Scott Schreiber PE #: 46577, developed this application and performed the engineering analysis for this Project. Scott practices in the area of water resource engineering and develops fish passage projects across the state. An application form has been developed and is included in this document as an appendix. Page 4 Floodplain Development Report for King Heatherly Diversion Structure Fish Passage Design on East Divide Creek appendices is also an owner authorization letter from the Bureau of Land Management, who owns the land where the Project will take place. Also included in the appendices is information on the adjacent property owners and mineral owners and lessees within 200 -foot radius or mineral estate owners in the Project area. It is our understanding from discussions with the County that since this Project was initially managed by a local non-profit and funded by the Bureau of Reclamation that review fees for the Floodplain Development Permit would be waived. Other items required are included in this submittal in conformance with Section 4-203, which include: project description, vicinity maps, site plans, grading and drainage plans, hydraulic calculations, and revegetation plans. Requirements from Section 4-203(0) were also adhered to for the floodplain analysis. Section 4-203(0): Floodplain Analysis A floodplain analysis was completed which meets the intent of the land use code. The information required of the land use code for this Project is contained within this document. The Project takes place in an unmapped floodplain. There also is not a mapped floodway. The Project takes place on East Divide Creek. There are no insurable structures affected by or part of this Project. Non applicable requirements of 4-203(0) include floodway boundary, since one doesn't exist; elevation of lowest floors, since buildings don't exist in project area; boundaries of impervious surfaces, since none exist in Project area; elevation certificate since one is not needed; Revegetation The area will be revegetated with the use of existing on-site materials including willows. Seed mixes from the BLM or Garfield County will also be used as needed. 4.0 SECTION 404 PERMIT Consultation with the US Army Corps of Engineers has taken place for this Project. It has been determined that Project is considered exempt from 404 permitting due to the fact the work is part of construction or maintenance of irrigation ditches. No mitigation is required of this project, since the inherent nature of the Project is mitigation itself. Page 5 Floodplain Development Report for King Heatherly Diversion Structure Fish Passage Design on East Divide Creek 5.0 CONSTRUCION During construction all materials, equipment and refueling will be stored outside of the approximated 100 -year floodplain. The Project is less than one acre of disturbance; therefore, a stormwater management plan is not required. Even though a plan is not required the contractor is responsible for installation and maintenance of stormwater controls for the site. This will limit erosion and sedimentation in downstream waterways. Installation of Best Management Practices will be reviewed by the engineer and modified as required. The project will be constructed with the use of earth moving equipment including but not limited to excavators and hand equipment. 6.0 FLOODPLAIN ANALYSIS 6.1 EXISTING FLOODPLAIN MAPPING Currently there is not a mapped floodplain in this area. The most current Federal Emergency Management Agency (FEMA) Flood Insurance Study (FIS) for Garfield County (080205V001A) was updated on August 2, 2006 (FEMA 2006). The current FIS does not have any documentation on East Divide Creek. The most current Flood Insurance Rate Map (FIRM) is Map Number 0802051800B (FEMA 1977) and is noted as "Not Printed" on the FEMA Map Service Center. The proposed Project area is in a very rural and secluded area. There are no known flooding issues at the site. 6.2 SURVEY Surveying for the Project area was performed by WWE. Existing ground topography including the creek and diversion structure was acquired in the summer of 2018. The vertical datum used for this survey was National American Vertical Datum of 1988 (NAVD 88). The horizontal datum utilized was Colorado State Plane Central — US Foot. The ground survey was also supplemented with LiDAR data that were obtained from a 2016 LiDAR survey performed by Merrick and Company in 2016. The LiDAR survey was developed for the Colorado Water Conservation Board. Proposed grading for the Project area was developed by WWE. 181-047.000 November 2019 Wright Water Engineers, Inc. Page 6 Floodplain Development Report for King Heatherly Diversion Structure Fish Passage Design on East Divide Creek 6.3 HYDROLOGY This analysis used hydrology from the StreamStats as well as fish passage criteria developed by Colorado Parks and Wildlife. The 100 -Year peak flow was estimated to be 863 cfs. The output from StreamStats is available in the appendices. 6.4 HYDRAULICS The hydraulic analysis was performed using HEC -RAS version 5.0.5 (Corps 2018) as well as Aquaveos' Surface -water Modeling System version 13.0) (SRH2D 2018). The hydraulics calculated along East Divide Creek were assessed using steady-state conditions and the hydrologic conditions described in this section. A two-dimensional hydraulic model was used to evaluate hydraulics at the site through the main rock ramp to ensure fish passage and associated velocities are understood and then the model was developed with one-dimensional cross sections directly up and downstream of the Project area to show no changes in base flood elevations outside the Project area. These hydrologic conditions are the same in both the Existing Conditions and Proposed Conditions Models. The most critical control elevation of the Project, the crest of the existing diversions, will not be changed as part of this Project. Therefore, work associated with this Project will not cause modifications to the base flood elevations. The following sections provide information on the development of the Existing Conditions and Proposed Conditions Models. 6.5 EXISTING CONDITIONS MODEL The Existing Conditions Model was developed from ground survey data supplemented with LIDAR data (Merrick and Company 2016) at multiple cross sections where the geometry is critical for the hydraulic analysis. Since there is no effective model or existing floodplain mapping cross sections were placed at hydraulically significant locations along the Project reach. The Project area consist of an existing cross -stream diversion structure. The existing diversion structure is approximately 3 feet tall. The structure has a 3 foot scour hole on the downstream side that is currently undercutting the diversion structure. Page 7 Floodplain Development Report for King Heatherly Diversion Structure Fish Passage Design on East Divide Creek Bank stations were set based on an evaluation of the cross-section information in the HEC -RAS model and site visits Manning's 'n' was based on a review of aerial imagery and field observation. Roughness coefficients were conservatively chosen to represent the springtime vegetated conditions. Pictures in appendices show the typical roughness. The following Manning's 'n' values were used: • Channel. 0 04 • Willows along the bank: 0.07 These values were kept consistent between the Existing and Proposed Conditions Models. Ineffective flow areas were utilized to account for flow areas with little or no flow conveyance. The upstream boundary of the hydraulic model was extended about 50 feet upstream of the existing diversion structure. The model was extended about 50 feet downstream of the proposed improvements. The downstream hydraulic control for the HEC -RAS model was set based on the normal depth calculation with a channel slope of 3%. Channel and overbank reach lengths were developed based on a review of aerials photographs and surveyed topography. 6.6 PROPOSED CONDITIONS MODEL The Proposed Conditions Model was developed by incorporating the proposed topography and fish passage designs into the Existing Conditions Model. Extents of the Manning's were modified to take into the proposed design elements. Modifications to the overall topography of the Project area only occur downstream of the diversions structure. 6.7 COMPARISON OF EXISTING CONDITIONS TO PROPOSED CONDTIONS The purpose of this report is to provide an assessment of the potential hydraulic effects of the Project. Overall the Project will not cause rises in base flood elevations outside the Project extents. The overall Project length is less than 100 feet. There are no structures within proximity to the structure that would be affected in any way by this Project. The Project actually reduces concerns from flooding in the area by stabilizing the structure and reduce impacts of scouring on the structure and surrounding banks. 181-047.000 November 2019 Wright Water Engineers, Inc. Page 8 Floodplain Development Report for King Heatherly Diversion Structure Fish Passage Design on East Divide Creek The HEC -RAS output (including tables, profiles and cross sections for the existing and proposed conditions) are available in the appendices. 7.0 OWNERSHIP The land where the Project is proposed is owned by the Bureau of Land Management. The Parcel Number is 239917400954. Attached in the appendices is a property search performed on the Garfield County Assessors page with map print out and property records card. There are no other properties within 200 feet of the Project area. The closest property to the west is Parcel Number 239919200003 and to the east is Parcel Number 239920100121. 7.1 DITCH CONTACT The work taking place as part of this project is at a diversion structure associated with the King Heatherly Ditch. The ditch itself or the functionality of the ditch will not be affected as part of this project since the upstream side of the diversion is not being affected. Proposed Use (From Use Table 3-403): Agriculture Description of Project: The proposed project is rehabilitating a failing diversion and incorporating fish passages into the proposed rehabilitation. The existing structure is severely undercut. The existing cross channel diversion dam causes a large vertical drop that fish cannot make it past. VARIATION IN THE SURFACE PROFILE AND HEIGHT OF BOULDERS SHOULD ALLOW FOR RESTING AREAS AND AREA OF REFUGIA. 3. THE GOAL OF THIS DESIGN IS TO PROVIDE BETTER FISH PASSAGE AT AN EXISTING DIVERSION STRUCTURE THAT CURRENTLY DOES NOT ALLOW NATIVE FISH TO MOVE UPSTREAM. THE VERTICAL DROP CURRENTLY ASSOCIATED WITH THE DIVERSION STRUCTURE WILL BE MODIFIED TO INCLUDED A ROCK RAMP WITH LARGER BOULDERS TO PROVIDE REDUCED VELOCITY AND HOLDING AREAS FOR FISH AS THEY PROGRESS UPSTREAM. BOULDERS SHALL BE PLACED IN A WAY TO DISSIPATE VELOCITY VECTORS AND PROVIDE INCREASED ROUGHNESS TO REDUCE OVERALL VELOCITY OF FLOWS IN ORDER TO ACHIEVE THE DEIGN INTENT. 4. MANY OF THE MATERIALS NECESSARY FOR THE CONSTRUCTION OF THIS PROJECT ARE LOCATED ON SITE, ON ACCESS ROAD, OR AT A NEARBY RANCH 2 MILES AWAY. THE INTENT OF THE PROJECT IS TO LIMIT IMPORTING OF MATERIALS. PRIOR TO CONSTRUCTION THE CONTRACTOR IS RESPONSIBLE FOR VERIFYING QUANTITIES OF MATERIAL AVAILABLE TO DETERMINE AMOUNT OF MATERIALS THAT MUST BE SOURCE FROM OFF SITE. MODIFICATIONS TO THE OVERALL QUANTITIES WILL TAKE PLACE PRIOR TO CONSTRUCTION ONCE ON-SITE MATERIAL VOLUMES HAVE BEEN DETERMINED. THE CONTRACTOR WILL NEED TO WORK WITH THE OWNER IN EVALUATING ON SITE MATERIALS AND SUPPLEMENTING WITH AN OFF SITE SOURCE. 5. MANY OF THE ITEMS LISTED IN THE QUANTITIES ARE TYPICAL UDFCD ITEMS. TYPE L SOIL RIPRAP, TYPE M VOID FILLED RIPRAP WITH RIVER COBBLE, AND TYPE VL RIPRAP CAN BE GENERATED FROM EXISTING ON SITE OR NEARBY MATERIALS. USE OF MATERIALS WILL NEED TO BE VERIFIED BY ENGINEER. THE BOULDERS LISTED IN THE QUANTITIES ARE MINIMUM SIZES. BOULDERS CAN BE FOUND ON SITE AND USED TO SUPPLEMENT OFF SITE MATERIALS. 6. BOULDER EDGING IS ALSO SPECIFIED TO REDUCE EXISTING BANK EROSION AND PROVIDE GREATER CHANNEL RESILIENCE IN THE FUTURE. 7. AN EXISTING SEDIMENT SLUICE IS LOCATED ON THE FACE OF THE DIVERSION THAT WILL NEED TO BE MODIFIED AS PART OF THIS PROJECT. A HEADGATE WILL BE INSTALLED AND CONNECTED TO A PIPE TO ALLOW THE SEDIMENT SLUICE TO DAYLIGHT DOWNSTREAM OF THE DIVERSION STRUCTURE. THE EXISTING DIMENSIONS OF THE OPENING FOR THE SEDIMENT SLUICE SHALL BE VERIFIED PRIOR TO CONSTRUCTION TO ALLOW FOR PROPER ORDERING OF THE HEADGATE AND TIME TO PROCURE. IT IS THE CONTRACTORS RESPONSIBILITY TO ENSURE THE NECESSARY MATERIALS ARE ON SITE IN A TIMELY FASHION TO NOT DELAY CONSTRUCTION. 8. THIS DESIGN IS INTENDED TO BE FIELD ENGINEERED DEPENDING ON THE CONDITIONS ENCOUNTERED DURING CONSTRUCTION AND IT IS UNDERSTOOD FIELD CHANGES MIGHT BE REQUIRED. 9. SALVAGEABLE MATERIAL FOUND ON SITE MAY BE USED AT THE DISCRETION OF THE ENGINEER AND OWNER. SALVAGEABLE MATERIAL INCLUDES LARGE BOULDERS, WILLOWS AND EXISTING STREAM SUBSTRATE. 10. COORDINATION WITH THE MIDDLE COLORADO WATERSHED COUNCIL, RANCH MANAGER AND BUREAU OF LAND MANAGEMENT WILL BE REQUIRED THROUGHOUT THE PROJECT. 5. CONSTRUCTION OBSERVATION TO BE PROVIDED BY ENGINEER AND OWNERS REPRESENTATIVE. ADEQUATE NOTICE SHALL BE GIVEN TO CONSTRUCTION OBSERVATION PERSONNEL AT THE ONSET OF THE PROJECT, DURING MAJOR CONSTRUCTION MILESTONES, SUBSTANTIAL COMPLETION, AND FINAL COMPLETION. 6. SURVEY OF EXISTING GRADE PERFORMED BY ENGINEER WITH LIMITED RESOURCES, EXISTING GRADES AND FEATURES ARE APPROXIMATE AND SHALL BE VERIFIED BY THE CONTRACTOR. NOTIFY THE ENGINEER OF ANY ELEVATION DISCREPANCIES. 7. THE DESIGN OF THE FISH PASSAGE STRUCTURE WAS BASED ON INFORMATION PROVIDED TO THE DESIGN ENGINEER. THE DESIGN INTENT IS TO PROVIDE A VELOCITY BETWEEN 2 AND 4 FEET PER SECOND FOR A RANGE OF FLOWS FROM 20 TO 100 CUBIC FEET PER SECOND. THE MAXIMUM JUMP HEIGHT OF THE SPECIES OF INTEREST HAS BEEN SET BY THE MIDDLE COLORADO WATERSHED COUNCIL OF 3 INCHES, BUT THE INTENT IS TO PROVIDE NO VERTICAL SEPARATION IN FEATURES AND ALL SHALL BE SLOPED. 8. DEPENDING ON TIME OF YEAR CONSTRUCTION IS PERFORMED DEWATERING MIGHT BE REQUIRED. THE DEWATERING PLAN MUST BE APPROVED BY ENGINEER AND OWNER PRIOR TO COMMENCING WORK. WORK IS ALLOWED IN THE WET, BUT AT CONTRACTORS RISK TO ENSURE BASE BOULDERS ARE ANCHORED IN EXISTING GRADE. 9. ACCESS TO THE SITE IS VIA EAST DIVIDE CREEK ROAD. ACCESS FROM EAST DIVIDE CREEK ROAD AND SITE LOCATION IS VIA DIRT ROAD WITH ONE CREEK CROSSING. 10. ALL WORK MUST BE PERFORMED WITHIN THE BUREAU OF LAND MANAGEMENT PRE -FEDERAL LAND POLICY AND MANAGEMENT ACT (PRE-FLPMA). SITE CONDITIONS 1. ANY CONSTRUCTION DEBRIS OR MUD TRACKING ONTO THE PUBLIC RIGHT-OF-WAY, RESULTING FROM THE PROJECT, SHALL BE IMMEDIATELY REMOVED BY THE CONTRACTOR. THE CONTRACTOR SHALL MAINTAIN AND PROVIDE DRAINAGE THROUGH THE SITE DURING CONSTRUCTION. 5. THE CONTRACTOR SHALL BE RESPONSIBLE FOR EROSION CONTROL THROUGHOUT THE CONSTRUCTION DURATION AND SHALL INSTALL EROSION CONTROL MEASURES AS NECESSARY. 6. The project site is located on East Divide Creek, immediately south of County Road 313, in the SE 1/4 NW 1/4 of Section 20, Township 7 South, Range 91 West, 6th P.M., specifically at Latitude 39.434451°, Longitude -107.581470°, approximately 11.5 -miles south of the Town of Silt, in unincorporated Garfield County, Colorado. Based on the information you have provided, we have determined that the proposed work is the type of activity that is included in the Section 404(f) exemption found at 33 C.F.R. Part 323.4(a)(3) for the construction or maintenance of irrigation ditches. Discharges associated with diversion structures and such other facilities as are appurtenant and functionally related to irrigation ditches are included in this exemption. Therefore, a Department of the Army Permit is not required for this work. Measures should be taken to prevent construction materials and/or activities from entering any waters of the United States. Appropriate soil erosion and sediment controls should be implemented onsite to achieve this end.
