RE: Steiner Application for Minor Subdivision — Water Supply
Dear Tim:
This letter summarizes the legal water supply for the proposed Steiner Minor Subdivision.
The property (Parcel ID: 212336200051) consists of 25.6 acres and is proposed to be split into two
lots. For water calculation purposes, Parcel A:1 (23.67 acres) will be an agricultural lot with a single
family residence and barn. Parcel A:2 (2.00 acres) will be a residential lot with a single-family
residence.
Domestic Water
The existing residences are currently supplied from the Finley Well No. 4 located in the
NW1/4 of the NW1/4 of Section 36, Township 5 South, Range 90 West of the 6th P.M. at a point
650 feet from the North Section Line and 620 feet from the West Section Line. The well was
previously permitted pursuant to State Engineer's Well Permit No. 66369-F and West Divide
Water Conservancy District Contract #0609210CR(a). The well permit allows for the withdrawal
of 55 g.p.m. for domestic use in 12 single family dwellings, irrigation of 12,000 square feet of
home gardens and lawns, and the watering of twelve head of livestock. Applicant is in the
process of obtaining a new West Divide Water Conservancy District Contract to reflect the
current uses on the property: 2 single family homes, irrigation of up to 15,600 square feet and
watering of 8 head of livestock.
The Steiner Minor Subdivision is located within West Divide's "Area A" primary service
area. Within this primary service area, West Divide issues water supply contracts to off-
set depletions associated with water diversions from wells. West Divide has several decreed
and pending augmentation plans which augment depletions from both existing and potential
future water structures. In addition to the augmentation plans, West Divide has three
temporary substitute supply plans, approved by the State Engineer's Office, which allow
West Divide to immediately provide augmentation water to new customers.

Irrigation will be provided from Applicant's 1.20 c.f.s. ownership in the Mings, Chenoweth
and Wolverton Ditch, Priority 74B. The Mings Chenoweth Priority No. 74B was decreed in Civil
action 1160 for irrigation. Applying the duty of water recognized by the Court in Civil Action 1160
of one c.f.s. to 50 acres, Applicant can irrigate up to 75 acres with its 1.2 c.f.s. Therefore, the Mings
Chenoweth water will provide sufficient water for irrigation on Parcels A:1 and A:2 consistent
with historical practices.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from
seeking relief in a civil court action.
2} The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(2) for a well constructed under Permit # 229550, appropriating ground water
tributary to the Colorado River, on the condition that the well shall be operated only when the West Divide Water
Conservancy District's substitute water supply plan, approved by the State Engineer, is in effect, and when a water allotment
contract between the well owner and the West Divide Water Conservancy District for the release of replacement water from
Ruedi Reservoir is in effect, or under an approved plan for augmentation. WDWCD contract #060921 OCR(a).
4) The use of ground water from this well is limited to ordinary household purposes inside twelve (12) single family
dwellings, the irrigation of 12,000 square feet (0.275 of an acre) of home gardens and lawns, and the watering of twelve
heads of livestock. All use of this well will be curtailed unless the water allotment contract or a plan for augmentation is in
effect. This well is known as FINLEY WELL NO. 4.
5) The pumping rate of this well shall not exceed 55 GPM.
6) The average annual amount of ground water to be appropriated shall not exceed 5.11 acre-foot (1,665,094 gallons).
7) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case
number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings.
8) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all
diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon
request.
9) This well shall be constructed not more than 200 feet from the location specified on this permit.
10) This well shall be constructed at least 600 feet from any existing well, completed in the same aquifer, that is not owned by
the applicant.

of this permit, by filing a written request with this office within sixty (60) days of the date of issuance. pursuant to the State
Administrative Procedures Act. (See Section 24-4-104 through 106, C.R.S.).
NOTE: Unless a completed Well Completion Report (GWS-31) and Pump Installation and Test Report (GWS-32) is
received by the Division of Water Resources before the expiration date shown below, this permit will expire on the
expiration date. An extension of the expiration date may be available. Contact DWR for additional information or refer to the
