CERTIFICATION OF MINERAL OWNER RESEARCH
This form is to be completed and submitted with any application for a Land Use Change Permit.
Mineral interests may be severed from surface right interests in real property. C.R .S. § 24-65 .5-101, et seq,
requires notification to mineral owners when a landowner applies for an application for development from a
local government. As such, the landowner must research the current owners of mineral interests for the
property.
The Garfield County Land Use and Development Code of 2013 ("LUDC") Section 4-101(E)(l)(b)(4) requires
written notice to owners of mineral interests in the subject property in accordance with C.R .S. § 24-65.5-101,
et seq, "as such owners can be identified through the records in the office of the Clerk and Recorder or
Assessor, or through other means." This form is proof of applicant's compliance with the Colorado Revised
Statutes and the LUDC.
The undersigned applicant certifies that mineral owners have been researched for the subject property as
required pursuant to C.R.S. § 24-65.5-101, et seq, and Section 4-101 (E)(l)(b)(4) of the Garfield County Land
Use and Development Code, as amended. As a result of that research, the undersigned applicant certifies

To Whom It May Concern:
Jon Fredericks with Land West is working with our mutual clients Dennis and Patricia
Cerise and recently submitted a minor subdivision application on their behalf for their property
located at16724 Hwy. 82, Carbondale, Colorado. Jon asked me to provide additional information
regarding mineral ownership for the property. Originally the application was submitted indicating
minerals were retained by Charles Harris and were then distributed pursuant to his estate.
My clients have understood that the minerals have not been severed from the property.
Upon review of chain of title documents, it appears the minerals are owned by Dennis and Patricia
Cerise and were not retained by Charles Harris. Deeds conveying the real property from Charles
Harris to his wife Rosetta Harris were recorded in the Office of the Garfield County Clerk and
Recorder at Reception Nos. 12369 and 91697 in 1925. Rosetta Harris then conveyed the real
property to Mumbert Cerise and other family members November 16, 1925 by warranty deed
recorded at Reception No. 93116. In addition, I reviewed an oil and gas lease from Mumbert and
Laurine Cerise granted for the benefit of a third party recorded March 8, 1937 at Reception No.
127021. The applicants acquired title to the property from Mumbert and Laurine Cerise per the
previously submitted title commitment. None of the conveyance deeds referenced in this
correspondence or the title commitment reflect that the minerals were retained by the grantor party.
Thus, the application has been revised to reflect the applicant owns the minerals rather than
stating the minerals are owned by Charles Harris, deceased. Please contact me with any questions.

Septic Inspection for 16724 Hwy 82: The tank is 1500 gallons, 2
compartment, and is constructed of cement. The water levels were normal.
The T's were on both the inlet and outlet lines. There was no deterioration of
the tank at the time of inspection. The leachfield showed no signs of
surfacing, or having any problems, and appears to be functioning normally at
the time of inspection.
