Please see the below responses to the Completeness Review Letter – Sunlight Mountain
Resort Telecommunication Facility – Substantial Amendment (LIPA-07-20-8798)
1. The application provided a deed of trust. Please provide the Warranty Deed or other
proof of ownership for the property. A Title Commitment would also address the
ownership issue.
Applicant Response: Please see AMC equity report Deed information dated
9/16/2020 for proof of ownership for Ski Sunlight Inc
2. A Statement of Authority is needed for Ski Sunlight, Inc. If the Statement of Authority
authorizes an employee besides Ross Terry to act on behalf of Ski Sunlight, then a
new letter of authorization will be required.
Applicant Response: Please see signed Statement of Authority from Ross
Terry dated November 16, 2020
3. Mineral Notice research and a completed form is needed for this application.
Applicant Response: Please see attached Certification of Mineral Owner
Research
4. It appears that the Lease area will be expanded to encompass the new equipment.
Will the Lease with the property owner be adjusted or is it sufficient as it currently
exists?
Applicant Response: We are working on expanding the lease area via
amendment with the landowner and will provide as soon as it is executed. We
have included the expanded lease area in the updated plans dated 2/22/2021.

Planning Items
5. To support your request for a Waiver of the Traffic Study, please provide a
description of the amount of construction traffic generated by the project.
There will negligible construction traffic generated by the project. There will
be 1-2 vehicles at the site during construction. Please see photo of proposed
construction staging area.
6. The application indicated that the access road meets the Roadway Standards
identified in Section 7-107. Please provide approximate dimensions of the roadway
as well as whether or not there are any concerns regarding construction traffic
access to the site.
Applicant Response: Please see approximate roadway dimensions on the
updated plans dated 2/22/2021. There are no concerns regarding construction
traffic access to the site.
7. The submitted Site Plan does not meet the requirements as identified in Section 4-
203 (D) including but not limited to, topography and the property lines of the subject
site. A waiver may be requested from this requirement – but it should be supported
by additional information indicating why a complete site plan is not appropriate in this
case.
Applicant Response: Please see updated drawings dated 1/22/2021 with the
required topography and property lines.
8. A Grading and Drainage Plan was not submitted with the application. A waiver may
be requested from this section, but it should be supported by supplemental
information indicating why a full-scale Grading and Drainage Plan is not required.
Please include any inspection information that will be completed as part of the
construction process.

9. The Land Use and Development Code requires that the plans for the tower are
prepared by a qualified professional engineer. The submitted plans are from an
Architect. Please submit plans from an engineer or provide additional information for
how this requirement will be met.

prepared by a qualified professional engineer.

10. The FAA form that was submitted does not appear to be a Form 7460-1 that is
required. Please provide additional information indicating whether or not that form
has been submitted to the FAA.

Recitals
A. The Board of County Commissioners of Garfield County, Colorado, (Board) received
a request for a Land Use Change Permit to allow for a Communications Facility (consisting of a
60-foot tall monopole) as further described in the Site Plan attached hereto as Exhibit A.
B. The Communications Facility is located within a 183.17-acre parcel of land owned by
Ski Sunlight, Inc. The ownership of this property is described in a Deed of Trust found in Book
629, Page 842 having a Reception Number of 343470 in the records of the Garfield County
Clerk and Recorder.
C. The subject property is located within unincorporated Garfield County in the
Commercial Limited zone district, approximately 10 miles southeast of the City of Glenwood
Springs on County Road 117 (Four Mile Road).
D. A Communications Facility may be permitted in the Commercial Limited zone district

with Limited Impact Review.
E. The Board is authorized to approve, deny or approve with conditions a Limited Impact
Review application resulting in the issuance of a Land Use Change Permit pursuant to the
Unified Land Use Resolution of 2008, as amended.
F. The Board of County Commissioners opened a public hearing on the J1h day of May,
2012 for consideration of whether the requested Land Use Change Permit should be granted or
denied, during which hearing the public and interested persons were given the opportunity to
express their opinions regarding the request.
H. The Board of County Commissioners cl9sed the public.hearing on the 7th day of May,
2012 to make a final decision.
I. The Board on the basis of substantial competent evidence . produced at the
aforementioned hearing, has made the following determinations of fact:
I. That proper public notice was provided as required for the hearing before the
Board of County Commissioners. ·
2. The hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting.
3. That for the above stated and other reasons the proposed Land Use Change Pennit
for a Communications Facility consisting of the construction of a 60-foot tall
monopole having a 12' x 12' foot print located in the main parking lot at Ski Sunlight
Resort on an 183 .17-area parcel in the Commercial Limited zone district is in the best
interest of the health, safety, convenience, order, prosperity and welfare of the
citizens of Garfield County.
4. That. with the adoption of conditions, the application is in general conformance
with the 2030 Comprehensive Plan, as amended.
5. That, with the adoption of conditions, the application has adequately met the
requirements of the Garfield County Unified Land Use Resolution of 2008, as
amended. ·
RESOLUTION
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the resolution.

B. The Land Use Change Permit for a Communications Facility related to construction of a 60-
foot tall monopole with a 12' x 12' foot print located in the main parking lot at Ski Sunlight
Resort is hereby approved subject to compliance with the following conditions:
1. That all representations made by the Applicant in the application, and at the public
hearing before the Board of County Commissioners, shall be conditions of approval,
unless specifically altered by the Board of County Commissioners;
2. The operation of this facility and any future amendments shall be done in accordance
with all applicable Federal, State and Local regulations governing the operation of
this type of facility including but not limited to the FAA and FCC.
3. The Applicant shall submit fmal engineering plans for the tower to the Garfield
County Building and Planning Department prior to initiating construction.
Construction and installation of the fence and communication cabinet shall be
properly permitted with the Garfield County Building Deparhnent and meet all
zoning and related requirements.
4. Prior to issuance of the Land Use Change Pennit, the Applicant shall provide Staff
with additional documentation or written confirmation from their telecommunications
engineer that no further FCC notification is required.
5. The Applicant shall be approved for two years from the date of this approval by the
BOCC. The Applicant may request additional time from the BOCC in a public
meeting so long as the Applicant can demonstrate that it is making a good raith effort
to obtain a permanent location.
6. The Applicant shall paint / powder coat the monopole a darker non-r~flective color to
better blend in with the surrounding area. ·
7. The Applicant shall install a screening-system incorporated within the chain-link
fencing such as either dark green fabric ( or other similar color) or typical slat-systems
to aid in the screening of the .base of the monopole and mechanical cabinet.
8. The Applicant shall install proper signage for any :hazardous materials on the
mechanical cabinet or fencing as applicable pursuant to the International Fire Code.

This Land Use Change Permit is issued subject to the conditions contained in
Resolution No. 2012-41 and set forth in Exhibit "B"; consistent with the representations
made in LIPA-7060 and shall be valid only during compliance with such conditions and
other applicable provisions of the Garfield County Unified Land Use Resolution of 2008,

Exhibit B
1. That all representations made by the Applicant in the application, and at the public
hearing before the Board of County Commissioners, shall be conditions of approval,
unless specifically altered by the Board of County Commissioners;
2. The operation of this facility and any future amendments shall be done in accordance
with all applicable Federal, State and "Local regulations governing the operation of
this type of facility including but not limited to the FAA and FCC.
3. The Applicant shall submit final engineering plans for the tower to the Garfield
County Building and Planning Department prior to. initiating construction.
Construction and installation of the fence and communication cabinet shall be
properly permitted with the Garfield County Building Department and meet all
zoning and related requirements.
4. Prior to issuance of the Land Use Change Permit, the Applicant shall provide Staff
with additional documentation or written confirmation from their telecommunications
engineer that no further FCC notification is required.
5. The Applicant shalt be approved for two years from the date of this approval by the
BOCC. The Applicant may request additional time from the BOCC in a public
meeting so long as the Applicant can demonstrate that it is making a good faith effort
to obtain a permanent location. ·
6. The Applicant shall paint / powder coat the monopole a darker non-reflective color to
better blend in with the surrounding area.
7. The Applicant shall install a screening-system incorporated within the chain-link
fencing such as either dark green fabric (or other similar color) or typical slat-systems
to aid in the screening of the base of the monopole and mechanical cabinet.
8. The Applicant shall install proper signage for any hazardous materials on the
mechanical cabinet or fencing as applicable pursuant to the International Fire Code.

C. The subject property is located within unincorporated Garfield County in the
Commercial Limited zone district, approximately 12.5 miles south of the City of Glenwood
Springs, Colorado accessed by private roads off of County Roads 117.

D. Telecommunication Facilities may be permitted in the Commercial Limited zone
district with a Limited Impact Review.
E. The Board is authorized to approve, deny or approve with conditions a Limited Impact
application resulting in issuance of a Land Use Change Permit pursuant to the Garfield County
Land Use and Development Code, as amended.
F. The Board of County Commissioners opened a public hearing on the 2nd day of •
September, 2014 for consideration of whether the proposed Land Use Change Permit should be
granted or denied, during which hearing the public and interested persons were given the
opportunity to ex.press their opinions regarding the request.
G. The Board of County Commissioners closed the public hearing on the 2nd day of
September, 2014 to make a final decision.
H. The Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following detenninations of fact:
1. That proper public notice was provided as required for the hearing before the Board
of County Commissioners.
2. The hearing before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested
parties were heard at that meeting.
3. That for the above stated and other reasons the proposed Amendment to the Land Use
Change Permit for the Ski Sunlight, Inc. Telecommunication Facility is in the best
interest of the health, safety, convenience, order, prosperity and welfare of the
citizens of Garfield County.
4. That with the adoption of conditions, the application is in general conformance with
the 2030 Comprehensive Plan, as amended.
5. That with the adoption of the Conditions of Approval the application has adequately
met the requirements of the Garfield County Land Use and Development Code, as
amended.

NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Gar:q;!:lld
County, Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the resolution.
B. The Amended Land Use Change Permit for a Telecommunication Facility is hereby
approved subject to compliance with the following conditions: ·
Prior to Issuance of the Land Use Change Permit
1. The applicant shall provide Glenwood Springs and Rural Fire Protection
District with MSDS sheets on all the hazardous materials and quantities
that will be contained on the site and in the building. These sheets shall
also be appropriately located on the cabinets and outside the fence of the
site and in compliance with applicable codes. The doors to the building
or equipment cabinet shall be signed in a viable location with hazardous
materials identification signs as specified in NFP A 704 and Section
2703.5 in the 2009 edition of the International Fire Code (IFC). The
building and area surrounding it shall comply with all the sections that
apply in Chapter 27, Hazardous Materials-General Provisions and
Chapters 28-44, 2009 edition of the IFC. These improvements shall be
reviewed and installation confirmed by the Glenwood Springs and Rural
Fire Protection District prior to issuance of the Land Use Change Permit.
Other Conditions
2. That all representations rriade by the Applicant in the application shall be
conditions of approval, unless specifically altered by the Board of
County Commissioners.
3. That, with exception to the elimination of condition number 5 as

SAC Wireless on behalf of AT&T would like to request a waiver Per section 4-202 for the Traffic Study,
Wastewater Mangement Plan, and Water Supply Plan. Please see below for further details.
SAC Wireless on behalf of AT&T would like to request a waiver for the Traffic Study 4-104 L. because the
telecommunications site is unmanned and will not increase traffic and therefore, the Traffic Study is not
applicable. There will negligible construction traffic generated by the project. There will be 1-2 vehicles
at the site during construction. Please see photo of proposed construction staging area.
SAC Wireless on behalf of AT&T would like to request a waiver for the Wastewater Management Plan
because the telecommunications site is not hooked up to a water supply and does not produce
wastewater. Therefore, the Wastewater Management Plan is not applicable.
SAC Wireless on behalf of AT&T would like to request a waiver for the Water Supply Plan because the
telecommunications site will not be hooked up to a water supply and therefore, the water supply plan is
not applicable.
