Box 1319 Carbondale, CO 81623 Reference: Limited Impact Review, Garfield County File Number: LIPA-01-21-8820 Dear Mr. Stewart, This letter is in regard to our completeness review of the application you have submitted including a Limited Impact Review application for an outdoor storage facility. The parcel is located northeast of the Town of Carbondale, at 87 County Road 103, Carbondale, CO 81623, and identified by County Assessor parcel number 2393-264-00-007, Our completeness review included input from the County Attorney’s Office and has noted several items that need to be addressed prior to a determination of technical completeness. In accordance with the Garfield County Land Use and Development Code (LUDC), please respond to the following items: 1. Provide a Statement of Authority for a designated agent to act on behalf of Crystal Ranch Corp. The Statement of Authority needs to be recorded with the Garfield County Clerk and Recorder. 2. Provide an updated Letter of Authorization. The current property owner (CRC, LLC) must authorize the representative (All Valley Storage/Travis Stewart). 1. Certification of Mineral Owner Research form (attached) needs signature and information regarding mineral owner research. 2. Provide a response from CDOT regarding the access permit, which needs to verify whether a new/updated permit is necessary and the status of such permits, or clarification from traffic engineer on the status of such permit. 3. Provide a response from Garfield County Road and Bridge regarding the driveway access permit, which needs to verify whether a new/updated permit is necessary and the status of such permits, or clarification from traffic engineer on the status of such permit. 4. Provide Screening proposals and/or documentation of visibility from adjoining properties. 5. Please update the traffic study to address all of the requirements for a Basic Traffic Analysis as outlined in Section 4-203.L.2 of the LUDC, including demonstration of compliance with Section 7-107, and adequacy of the access drive including accessibility for RV Vehicles and trailers. A waiver with specific responses ~ Garfield County 2 pursuant to section 4-202 may be requested from submittal of a full traffic analysis. 6. Provide a waiver request to fulfill the water supply plan requirements, with specific responses to the Waiver of Submission Requirements in section 4-202. 7. Provide a waiver request to fulfill the wastewater treatment plan requirements, with specific responses to the Waiver of Submission Requirements in section 4- 202. 8. Provide responses to Impact Analysis items consistent with the current LUDC (Section 4-203.G) and which are related to the proposed use of the current application. Waivers from certain elements may be requested with specific responses to the Waiver of Submission Requirements in section 4-202. 9. The geologic and geotech study provided is in reference to a different use. Provide an updated cover letter statement from the author clarifying that the report is applicable to the change in use, and any additional information needed to address the current application. 10. Provide an updated engineering report which is relevant to the proposed use and current application. The Sopris Engineering Report provided is in review of a different use and does not adequately address the proposed use of the current application. 11. Please provide updated information for all required sections identified in Section 4-203(E) for a Grading and Drainage Plan as related to the current proposed use, or an updated cover letter statement from the author clarifying how the report is applicable to the proposed change in use. 12. If the applicant is proposing a waste/dump station with the current application, information needs to be supplied on the station including design characteristics, information on soils, and any information related to permitting with Garfield County Environmental Health. We look forward to receiving the revisions and supplemental information listed above. Once the above information is provided, we can finalize our completeness review and proceed through the review process. Section 4-101 (B)(2)(a) stipulates that the applicant shall correct the deficiencies within 60 calendar days or the application will be deemed withdrawn. The Impact Analysis shall include a complete description of how the Applicant will ensure that impacts will be mitigated and standards will be satisfied. The following information shall be included in the Impact Analysis: 1. Adjacent Land Use. Existing use of adjacent property and neighboring properties within 1,500-foot radius. The subject property, the site of a former gravel pit, is bordered on the North side by rural agricultural property. To the East is County Road 103 followed by the Cerise Gravel Pit, operated by United Companies and rural agricultural. To the South is Highway 82 and beyond it rural agricultural. To the West of the property is also rural agricultural. See the map below for further details. 2. Site Features. A description of site features such as streams, areas subject to flooding, lakes, high ground water areas, topography, vegetative cover, climatology, and other features that may aid in the evaluation of the proposed development. ~ ALLVALLEY STORA0E     Updated 4‐203.G.  Page 2 of 3    The subject property topography is the result of the reclamation of the old Powers Gravel Pit. This pit was operated by Lafarge and most recently the by the United Companies/Oldcastle. The area is flat with a gravel surface and surrounded by the reclaimed slopes, which have been revegetated with dryland grasses. There are no bodies of water or specific climatology to speak of. 3. Soil Characteristics. A description of soil characteristics of the site that have a significant influence on the proposed use of the land. The surface of the proposed area is surfaced with a gravel base course and the underlying geology is primarily riverbed cobble, and sand/gravel. The area was a former gravel pit and the soils are consistent with that former use. Soils are suitable for development such as this application as demonstrated in the geotechnical report. 4. Geology and Hazard. A description of the geologic characteristics of the area including any potential natural or manmade hazards, and a determination of what effect such factors would have on the proposed use of the land. The geologic conditions for the site are described in item #3. There are no additional geologic or manmade hazards that would create an effect on the proposed land use. 5. Groundwater and Aquifer Recharge Areas. Evaluation of the relationship of the subject parcel to Floodplains, the nature of soils and subsoils and their ability to adequately support waste disposal, the Slope of the land, the effect of sewage effluents, and the pollution of surface Runoff, stream flow, and groundwater. The subject parcel does not reside within a floodplain. While this application does not propose waste disposal via a leach field, the subsoil conditions are adequate to support such uses. The parcel is mostly flat with drainage sloping toward a detention basin located on the Western portion of the property. The event of a spill or pollution event would be able to be contained and cleaned up as groundwater is not exposed on the property and drainage flows into a detention pond and not directly into a stream, river or other bodies of water. 6. Environmental Impacts. Determination of the existing environmental conditions on the parcel to be developed and the effects of development on those conditions, including: There are no existing environmental conditions that would be impacted by the proposed development. The existing area is not vegetated and is graveled. a. Determination of the long-term and short-term effect on flora and fauna; The only plant vegetation that exists in the proposed area are noxious weeds, which are treated annually. No other flora or fauna exist that would be affected. b. Determination of the effect on designated environmental resources, including critical wildlife habitat; There are no critical wildlife habitats or other designated environmental resources that would be affected by the proposed use. ~ ALLVALLEY STORA0E     Updated 4‐203.G.  Page 3 of 3    c. Impacts on wildlife and domestic animals through creation of hazardous attractions, alteration of existing native vegetation, blockade of migration routes, use patterns, or other disruptions; and There will be no blockade of migration routes, use patterns, or other disruptions or alterations of existing native vegetation that would impact wildlife or domestic animals. d. Evaluation of any potential radiation hazard that may have been identified by the State or County Health Departments. There are no potential radiation hazards. 7. Nuisance. Impacts on adjacent land from generation of vapor, dust, smoke, noise, glare or vibration, or other emanations. There will be no impacts to adjacent land from generation of vapor, dust, smoke, noise, glare or vibration, or other emanations. Additionally, all lighting will be downcast and not visible to surrounding properties. 8. Hours of Operation. The Applicant shall submit information on the hour’s operation of the proposed use. The sanitary dumping station must have the following features: 1. A sloped concrete apron with a drain at least 4 inches in diameter at the low point near the center of the pad. 2. A tight-fitting drain cover (to prevent the escape of odors) equipped with a foot operated attachment or similar device, to open the drain cover without directly contacting waste material. 3. An approved water outlet or hydrant adjacent to the dumping station for flushing down the drain pad after use. 4. An approved atmospheric vacuum breaker attached to the water outlet to prevent possible back-siphonage into the water supply system. The vacuum breaker must be installed downstream from the shutoff valve and at the highest point. 5. An adequate length of flexible hose for flushing the concrete apron and drain. A means must be provided to retract the hose when not in use so it does not contact the concrete pad or rest on the ground surface. 6. The sanitary dumping station must be located at least 100 feet from any water supply well. The dumping station and associated water outlet must be at least 50 feet from and campsite or potable water outlet. If possible, locate the dumping station at a pull over near the campground exit for ease of access and disposal without blocking traffic. 7. A sign must be posted at the sanitary dumping station stating that the adjacent water outlet is “UNSAFE FOR DRINKING”. 8. Hi Travis, I was able to review all the information that you all sent over. I have a few follow-up questions: 1. Do you all have a site plan that shows the setback from the property line to the Storage Yard? I don’t anticipate it being an issue, but I don’t think I saw a site plan that addressed this. [Please see the attached setback map for your reference. Due to the relative shapes of the areas we attempted to take the shortest length (most restrictive) on each side. To the North it is 31’-6” (From the existing fe nce line to the property line), To the West 50’-3” (From the existing fence line to the property line), To the South 470’-2” (New fence to property line), To the East 533’-4” (New fence to property Line). We have no physical structures being built in these areas.] 2 2. Is the dump station only for customers of the storage yard, or could members of the public come in for the dump station and not storage? [Only customers with controlled gate access will be able to utilize the dump station. It will also be monitored via camera.] 3. I may have missed it, but I was looking through the Traffic Study and trying to determine where the other uses on the site were accounted for (the stone yard, your all’s existing Contractor’s Yard). [I believe they accounted for everything as stated in the update provided for NTC, I will double check this item] 4. In my past review of the stone yard at the property, I know there were some questions of piped irrigation ditches on the property. Do you know the location of those ditches? [There are no piped ditches on the “floor” or flat area where our application area is. There is some water infrastructure in the hillsides surround the area as part of the revegetation area.] 5. Just so I understand, the Grading and Drainage Plan shows the required addition of piping for a ditch that runs along the road. Is this a drainage ditch? The proposed storage facility is proposed to encompass a total of 6.53 acres +/- of which 3.28 acres +/- will be utilized for leased storage. Proposed improvements additionally include minor grading, installation of a drainage swale around the site, an RV dump station and security fencing around the site. Below is a summary of the feasibility of the proposed site improvements per the Garfield County Land Use and Development Code (LUDC). Grading and Drainage Plan (4-203.E) As is shown on sheet C3.0-Grading & Erosion Control Plan the existing and proposed site topography generally slopes slightly from north east to south west, with slopes ranging from 2-3%. There is an existing steep hillside surrounding the north and western portions of the site. There is also an existing detention pond southwest of the site which was installed with the Powers Pit reclamation project. Per the June 24, 2011 Drainage Study prepared by Sopris Engineering (attached), the detention pond was designed and built to detain the entire 100-year storm assuming the entire pit floor was impervious since water cannot physically leave the site and no development plans existed at the time of that report. The proposed improvements include minor grading and installation of a drainage swale along the north and western boundaries of the site to collect runoff from the steep slopes and route to the detention pond. The site is proposed to maintain positive sheet flow drainage from northeast to south west to the existing detention pond, which is in compliance with the 2011 Drainage Study and therefore no updates to the original report are necessary at this time. Temporary erosion control Best Management Practices will be during construction to prohibit mobilized sediment from leaving the site during construction. Traffic (4-203.L.2) Sopris Engineering, LLC (SE) has prepared this basic traffic analysis for the proposed Site in accordance with the GCLUC section 4-203.L.2. The project Site has an access to CR103 which was permitted by the County when the Powers Pit was reclaimed. CR103 provides direct access to SH 82 which was also permitted by CDOT at the same time. Refer to the attached C1.0 which shows the existing and proposed roads (which are further described below in the Access and Roadways section). Based upon the proposed uses, we have estimated the additional trips which will be generated by the proposed CRC Storage Yard on the pit floor of the Crystal Ranch Corporation(formerly known as Power’s Pit) which will include the 163 spaces for the storage of RV’s, boats, and trailers, etc. and compared those trips to what is currently existing at the site as well as to what is currently included in the County and CDOT permits. Based upon this analysis we have determined that neither a new County driveway permit nor CDOT access permit will be required with this development. Our findings are outlined below. In preparing our analysis, SE utilized various traffic studies/analyses which were previously prepared for this site: • May 3, 2011 Traffic Assessment for Powers Rural Employment Center-Prepared by TurnKey Consulting, LLC: This initial study was prepared as part of a 2011 Compressive Plan Amendment application to the County to request changing the property designation on the Future Land Use Map from Residential Medium to Rural Employment Center for the entirety of the pit floor which encompasses approximately 24-acres. This study details what the traffic impacts would be if the site were ever fully developed into a Rural Employment Center. The CDOT access permit (Permit #312039-attached) that was issued based upon this study allows for 190 DHV at County Road 103/SH 82. All required improvements associated with both the CDOT Access Permit and County Driveway Permit (Permit #GRB12-D-15-attached) have been constructed. SE then utilized the 9th Edition of the ITE and looked at two different scenarios to calculate the trips the Site will generate. Therefore, development of the CRC Storage Yard is in compliance with the CDOT and County permits and no further permitting is required. Access and Roadways (7-107) The existing site has and existing access to CR 103 which was design and constructed in compliance with the traffic studies noted in the Traffic section above to accommodate the full build out of the CRC site as a Rural Employment Center. The existing access to CR 103 was designed and constructed as a boulevard configuration with each side of the boulevard including 16-feet of asphalt and a 4-foot gravel shoulder for a total width of 20-feet, in compliance with County and the fire department’s requirements. The lanes are separated by an 8-foot landscape median. The configuration accommodates WB-50 trucks and allows for 2-way access in the event that one side or the other is blocked. There is also an existing roadway on the floor of the CRC site providing access to the Site which includes 24-foot wide with 2-foot wide gravel shoulders which is in compliance with Garfield County Standards for a rural/secondary access and easily accommodates RV vehicles and trailers. Access into and through the proposed storage yard also accommodates a WB-50 with a 24-foot wide access gate and 50-foot wide drive lanes. See the attached Autoturn Exhibit prepared by Sopris Engineering, dated January 25, 2021. Water Supply/Distribution Plan (4-203.M) No full time employees will be located at this site as all leasing and customer service functions will be located off site, therefore there will be no need for water supply or distribution and the applicant is seeking a waiver to this requirement. It is anticipated that a manager will be checking on the site several times a week to review site conditions and meet with customers to ensure they move into the correct space. These site visits are likely to be under an hour in duration and it will be the responsibility of the manager to have bottled water with them in their vehicles. Wastewater Management and Distribution Plan (4-203.N) As is described in the Water Supply and Distribution Plan section above, there will be no full time employees on site; therefore there will be no need for wastewater management or distribution and the applicant is seeking a waiver to this requirement. The applicant is proposing to place a portable toilet at the site which will be serviced by a local waster vendor. We are, however, proposing a seasonal waste vault to accommodate RV’s dumping black and gray water tanks after camping trips. The vault will be pumped as necessary and will not be designed as a leach field or other means of treating effluent at the site. All effluent will be pumped and taken off site. A conceptual design is included in this application and upon final land use approval a final engineered design will be submitted to the County for review and approval. B) Soils Report: • SE has reviewed the May 12, 2011 Geologic and Preliminary Geotechnical Investigation prepared by CTL Thompson and although the proposed uses within the 2011 report are different than the currently proposed storage yard, it is our opinion that the report is applicable and all proposed site conditions are in compliance with the report. Additionally, no structures are proposed so it is our opinion that no additional soils investigation is warranted for this proposed use. Summary Based on the information presented above, the proposed storage facility can be feasibly constructed and supported by the site improvements should the project obtain Limited Impact Review approval from the Garfield County Commissioners. The entire property consists of approximately 453 acres. Of that area, approximately 68.5 acres is currently leased to La Farge for mining and batch plant operations w hi le the remaining property is developed as rural residential. The purpose of the drainage study is: • To id entify the existing drainage flows and patterns to and across the subject site. • To estimate stormwater runoff rates that may be expected through the additiona l development of the project. • To determine the volume of stormwater detention that will be necessary to maintain the existing peak runoff and stormwater volume of the project and provide a safe routing of stormwater to the detention or retention areas. • To comply w ith the drainage standards for t h e Garfield County Un ified Land Use Resolution of 2008 Section 7-206. Sopri s Engineering, LLC (SE ) has ana lyzed the project's impacts and has designed drainage detention structures to detain the enti re 100-year storm. The appendices l ocated in the back of this report contai n all supporting ca lculatio ns associated with this analysis. 2.0 DESIGN POINTS The existing site has two "release" points, which SE is referring to as Design Points (DP). The DPs are used to describe both the exi sting and developed drainage conditions. Th e developed site has been designed to not release any stormwater as the terrain prohibits the release of any stormwater. The design points and the existing and developed basins associated with them are further described below. DESIGN POINT 1-DPl is located at the western portion of the leased site. The existing basin which contributes to the flows at this DP is Ex-Basin 1. When developed, P-Basin 1 will flow to this DP. With development, there are no changes to t his basin. DESIGN POINT 2-DP2 is located at the existing detention pond. The existing basin which co nt ributes flows at this DP is Ex-Bas in 2. When developed, P-Basins 2-5 will contribute flows to this DP. Since the site has been mined and reclaimed, the site does not have a real "rel ease" point for the majority of the leased site as the g r ades are much lower t han Hig hway 82, water cannot physica lly leave t he site. 3.0 EXISTING DRAINAGE CONDITION AND FEATURES 3.1 Onsite Drainage The site consists of 62 .16 acres. The site has recently been reclaimed with slopes on the west, north and east of 3:1 and gentle slopes so uthwest across the floor of 1-3%. However, as i s noted in section 4.1 above, due to the existin g terrain, water cannot phys ica ll y leave the site, it ha s therefore been designed to deta in the entire 100-year storm. The peak runoffs for the ex isting and developed storms were compa red usin g the SCS hydrograph method to determin e th e r equired storage vo lu me. Usin g the Storm Net program, a required vo lum e for t he develo ped drainage sub areas was ca lcul ated and was u se d to size the proposed detention pond to ensure that the ex isting 210,000 CF detention pond is sufficient. These are provided for your convenience but do not alleviate compliance with all sections of the Access Code. A copy of the State Highway Access Code is available from your local issuing authority (local government) or the Colorado Department of Transportation (Department). When this permit was issued, the issuing authority made its decision based in part on information submitted by the applicant, on the access category which is assigned to the highway, what alternative access to other public roads and streets is available, and safety and design standards. Changes in use or design not approved by the permit or the issuing authority may cause the revocation or suspension of the permit. APPEALS 1. Should the permittee or applicant object to the denial of a permit application by the Department or object to any of the terms or conditions of a permit placed there by the Department, the applicant and permittee (appellant) have a right to appeal the decision to the [Transportation] Commission [of Colorado]. To appeal a decision, submit a request for administrative hearing to the Transportation Commission of Colorado within 60 days of transmittal of notice of denial or transmittal of the permit for signature. Submit the request to the Transportation Commission of Colorado, 4201 East Arkansas Avenue, Denver, Colorado 80222-3400. The request shall include reasons for the appeal and may include changes, revisions, or conditions that would be acceptable to the permittee or applicant. 2. In submitting the request for administrative hearing, the appellant has the option of including within the appeal a request for a review by the Department's internal administrative review committee pursuant to [Code] subsection 2.10. When such committee review is requested, processing of the appeal for formal administrative hearing, 2.9(5) and (6), shall be suspended until the appellant notifies the Commission to proceed with the administrative hearing, or the appellant submits a request to the Commission or the administrative law judge to withdraw the appeal. The two administrative processes, the internal administrative review committee, and the administrative hearing, may not run concurrently. 4. Regardless of any communications, meetings, administrative reviews or negotiations with the Department or the internal administrative review Committee regarding revisions or objections to the permit or a denial, if the permittee or applicant wishes to appeal the Department's decision to the Commission for a hearing, the appeal must be brought to the Commission within 60 days of transmittal of notice of denial or transmittal of the permit. PERMIT EXPIRATION 1. A permit shall be considered expired if the access is not under construction within one year of the permit issue date or before the expiration of any authorized extension. When the permittee is unable to commence construction within one year after the permit issue date, _the permittee may request a one year extension from the issuing authority. No more than two one-year extensions may be granted under any circumstances. If the access is not under construction within three years from date of issue the permit will be considered expired. Any request for an extension must be in writing and s_ubmitted to the issuing authority before the permit expires. The request should state the reasons why the extension is necessary, when construction is anticipated, and include a copy of page 1 (face of permit) of the access permit. Extension approvals shall be in writing. The local issuing authority shall obtain the concurrence of the Department prior to the approval of an extens'.ton, and shall notify the Department of all denied extensiohs within ten days. Any person wishing to reestablish an access permit that has expired may begin again with the application procedures. An approved Notice to Proceed, automatically renews the access permit for the period of the Notice to Proceed. CONSTRUCTION 1. Construction may not begin until a Notice to Proceed is approved. (Code subsection 2.4] 2. The construction of the access and its appurtenances as required by the terms and conditions of the permit shall be completed at the expense of the permittee except as provided in subsection 2.14. All materials used in the construction of the access within the highway right-of-way or on permanent easements, become public property. Any materials removed from the highway right-of-way will be disposed of only as directed by the Department. All fencing, guard rail, traffic control devices and other equipment and materials removed in the course of access construction shall be given to the Department unless otherwise instructed by the permit or the Department inspector. 3. The permittee shall notify the individual or the office specified on the permit or Notice to Proceed at least two working days prior to any construction within state highway right-of-way. Construction of the access shall not proceed until both the access permit and the Notice to Proceed are issued. The access shall be comple\ed in an expeditious and safe manner and shall be finished within 45 days from initiation of construction within the:highway right-of-way. A construction time extension not to exceed 30 working days may be requested from the individDal or office specified on the permit. · 4. The issuing authority and the Department may inspect the access during construction and upon completion of the access to ensure that all terms and conditions of the permit are met. If in the determination of the Department or issuing authority the failure to comply with or complete the construction requirements of the permit create a highway safety hazard, such shall be sufficient cause for the summary suspension of the permit. If the permittee wishes to use the access prior to completion, arrangements must be approved by the issuing authority and Department and included in the permit The Department or issuing authority may order a halt to any unauthorized use of the access pursuant to statutory and regulatory powers. Reconstruction or improvement of the access may be required when the permittee has failed to meet required specifications of design or materials. A utility permit shall be obtained for any utility work within highway right-of-way. Where necessary to remove, relocate, or repair a traffic control device or public or private utilities for the construction of a permitted access, the relocation, removal or repair shall be accomplished by the permittee without cost to the Department or issuing authority, and at the direction of the Department or utility company. Any damage to the state highway or other public right-of-way beyond that which is allowed in the permit shall be repaired immediately. The permittee is responsible for the repair of any utility damaged in the course of access construction, reconstruction or repair. 8. In the event it becomes necessary to remove any right-of-way fence, the posts on either side of the access shall be securely braced with an approved end post before the fence is cut to prevent any slacking of the remaining fence. All posts and wire removed are Ot·! ,artment property and shall be turned over to a representative of the Department. 9. The permittee shall ensure that a copy of the permit is available for review at the construction site at all times. The permit may require the contractor to notify the individual or office specified on the permit at any specified phases in construction to allow thii field inspector to inspect various aspects of construction such as concrete forms, subbase, base course compaction, and niaterials specifications. Minor changes and additions may be qrdered by the Department or local authority field inspector to imeet unanticipated site conditions. 10. Each access shall be constructed in a manner that shall not cause water to enter onto the roadway or shoulder, and shall not interfere with the existing drainage system on the right-of-way or any adopted municipal system and drainage plan. 11. The Permittee is responsible for obtaining any necessary additional Federal, State and/or City/County permits or clearances required for construction of the access. Issuance of this access permit does not constitute verification of the above required actions by the Permittee. By accepting the permit, the permittee stipulates and agrees to fully protect, save, defend, indemnify, and hold harmless, to the extent allowed by law, the issuing Authority, and each of the Authority's directors, officers, employees, agents and representatives, from and against any and all claims, costs (including but not limited to all reasonable fees and charges of engineers, architects, attorneys, and other professionals or expert witnesses and all court or other dispute resolution costs directly incurred by reason of claims directly brought against the Authority), losses, damages, pre-or post-judgment interest, causes of action, suits, or liability of any nature whatsoever by reason of liability imposed due to Permittee's failure to obtain, or disregard of, any applicable federal, state or local environmental permits, approvals, authorizations, or clearances, or in meeting or complying with any applicable federal, state or local environmental law, regulation, condition or requirements in connection with any activities authorized by this Access Permit. CHANGES IN ACCESS USE AND PERMIT VIOLATIONS 1. It is the responsibility of the property owner and permittee to ensure that the use of the access to the property is not in violation of the Code, permit terms and conditions or the Act The terms and. conditions of any permit are binding upon all assigns, successors-in-interest, heirs and occupants. If any significant changes are made or will be made in the use of the property which will affect access operation, traffic volume and or vehicle type, the permittee or property owner shall contact the local issuing authority or the Department to determine if a new access permit and modifications to the access are required. 2. When an access is constructed or used in violation of the Code, section 43-2-147(5)(c), C.RS., of the Act applies. The Department or issuing authority may summarily suspend an access permit and immediately order closure of the access when its continued use presents an immediate threat to public health, welfare or safety. Summary suspension shall comply with article 4 of title 24, C.RS. MAINTENANCE 1. The permittee, his or her heirs, successors-in-interest, assigns, and occupants of the property serviced by the access shall be responsible for meeting the terms and conditions of the permit, the repair and maintenance of the access beyond the edge of the roadway including any cattle guard and gate, and the removal or clearance of snow or ice upon the access even though deposited on the access in the course of Department snow removal operations. Within unincorporated areas the Department will keep access culverts clean as part of maintenance of the highway drainage system. However, the permittee is responsible for the repair and replacement of any access-related culverts within the right-of-way. Within incorporated areas, drainage responsibilities for municipalities are determined by statute and local ordinance. The Department will maintain the roadway including auxiliary lanes and shoulders, except in those cases where the access installation has failed due to improper access construction and/or failure to follow permit requirements and specifications in which case the permittee shall be responsible for such repair. This permitted access is only for the use and purpose stated in the Application and Permit. This Permit is issued in accordance with the State Highway Access Code (2 CCR 601-1), and is based in part upon the information submitted by the Permittee. Any subsequent relocation, reconstruction, or modifications to the access or changes in the traffic volume or traffic nature using the access shall be requested for by means of a new application. Any changes causing non-compliance with the Access Code may render this permit void, requiring a new permit. 2. The Permittee shall design and install a westbound right turn deceleration lane i.h accordance with Section 4 of the Access Code. 3. The Perrnittee shall design and install an eastbound left turn acceleration lane in accordance with Section 4 of the Access Code. 4. The traffic volume shall be 190 DHV. This is for Garfield County Road 103 also known as Crystal Springs Road. 5. All other highway intersection axillary lanes meet the standards of the Code. 6. The County Road 103 Intersection with SH 82 shall be reconfigured to be as close to 90 degrees as possible. Median striping improvement for the center median on SH 82 shall be completed with this design. 7. Unofficial parking at the intersection of CR 103 and SH 82 shall be eliminated by landscaping or grading of the area. The parking area may remind if another government entity takes responsibility of maintaining of the parking area. This will need to be formalized by a written agreement. 8. The Powers' gravel pit operation access on SH 82 shall close and be reclaimed once access is open on County Road 1 03. All asphalt shall be removed and the site drainage and original vegetation shall be restored. 9. This access shall be constructed 25-40 feet wide. This access shall be constructed with turning radii to accommodate an AASHTO WB-67 turning radius. The turning radius shall be measured from the white line on the Hwy to the edge of the driveway. A drawing of the design vehicle turning template for the largest vehicle entering/exiting site will be required to ensure proper radius and lane widths. 10. The access shall be constructed perpendicular to the travel lanes of the State H[ghway for a minimum distance of 40 feet from the edge of roadway. Side slopes shall be at.a 4:1 slope on the roadway and at 6:1 to the approach. The driveway shall slope away from the highway at a -2% grade for the first 20 feet of driveway. This design shall be in conformance with section 4 of the State Highway Access Code, 2CCR 601-1. 11. The access shall be surfaced in accordance with Section 4.7 of the Access Code immediately upon completion of earthwork construction and prior to use. This access shall be hard surfaced in accordance with Section 4.7 of the Access Code a minimum distance of 50 feet from the traveled way or to the CDOT Right-of-Way. Where the hard surface is to abut existing pavement, the existing pavement shall be saw cut and removed a minimum of one foot back from the existing edge for bituminous, or until an acceptable existing cross slope is achieved. Surfacing shall meet the Department's specifications with minimum surfacing to be equal to or greater than existing highway conditions. The Permittee shall provide a performance bond that will insure completion of the required highway and all related intersection improvements in conformance with all Department standards and specifications. The bond must be at least 110% of the estimated total highway construction cost and the bonding agency must be surety licensed to do business in the State of Colorado. A thorough Construction Cost Estimate sealed by a Colorado Registered Professional Engineer and a draft of the bond must be provided and approved by Department before acceptance of the final bond and before construction is approved to commence. 13. This permit replaces any and all additional access permits that may be in existence for this access. 14. A pre-design meeting is required prior to construction design. A new culvert may be required for this access. The drainage study will be used to size all culverts. As a minimum, an 18-inch culvert with protective end treatments will be required. The culvert shall be kept free of blockage to maintain proper flow and drainage. 19. Open cuts, which are at least 4 inches in depth, within 30 feet of the edge of the State Highway traveled way, will not be left open at night, on weekends, or on holidays, or shall be protected with a suitable barrier per State and Federal Standards. 20. The Permittee is responsible for obtaining any necessary additional Federal, State and/or City/County permits or clearances required for construction of the access. Approval of this access permit does not constitute verification of this action by the Permittee. All workers within the State Highway right of way shall comply with their employ~r's safety and health policies/procedures, and all applicable U.S. Occupational Safety and Health Administration (OSHA) regulations -including, but not limited to the applicable sections of 29 CFR Part 1910 -Occupational Safety and Health Standards and 29 CFR Part 1926 -Safety and Health Regulations for Construction. Personal protective equipment (e.g. head protection, footwear, high visibility apparel, safety glasses, hearing protection, respirators, gloves, etc.) shall be worn as appropriate for the work being performed, and as specified in regulation. 22. The Permittee is required to comply with the Americans with Disabilities Act Accessibility Guidelines (ADAAG) that have been adopted by the U.S. Architectural and Transportation Barriers Compliance Board (Access Board), and incorporated by the U.S. Attorney General as a federal standard. The access shall be completed in an expeditious and safe manner and shall be completed within 45 days from initiation of construction within State Highway right-of-way or in accordance with written concurrence of the Access Manager. All construction shall be completed i 1 a single season. 30. All costs associated with any type of utility work will be at the sole responsibility and cost of the Permittee c;nd at no cost to COOT. 31. Any damagtJ to present highway facilities including traffic control devices shall be repaired immediately at no cost to the Department and prior to continuing other work. 32. Any mud or other material tracked or otherwise deposited on the roadway shall be removed daily or as r\rdered by the Department inspector. If mud is obvious condition during site constructior\, it is recommended that the contractor build a Stabilized Construction Entrance or Scrubber Pad at the intended construction access to aid in the removal of mud and debris from vehicle tires. The details of the Stabilized Construction Entrance are found in the M & S Standards Plan No. M-208-1. 33. A fully executed complete copy of this permit and the Notice to Proceed must be on the job site with the contractor at all times during the construction. Failure to comply with this or any other construction requirement may result in the immediate suspension of work by order of the Department inspector or the issuing authority. 34. All construction and inspection work must be under the direction of a Colorado Registered Professional Engineer. The PE shall carefully monitor the contractor's compliance on all aspects of construction, including construction zone traffic control. (b) Engineering Certification: After inspection and before final acceptance, the Engineer shall certify to CDOT in writing that all inspections, materials, materials testing, and construction methods conform to the plans, specifications and purpose of design. Upon completion of the work, that responsible Engineer shall submit an "As Built" plans, showing in detail all approved construction changes, modification. 35. No work will be allowed at night, Saturdays, Sundays and legal holidays without prior authorization from the Department. The Department may also restrict work within the State Highway right-of-way during adverse weather conditions. 36. Areas of roadway and/or right-of-way disturbed during this installation shall be restored to their original conditions to insure proper strength and stability, drainage and erosion control. Restoration shall meet the Department's standard specifications for topsoil, fertilization, mulching, and re-seeding. Construction Completion & Final Acceptance I 37. The Permittee shall construct all improvements stated on this permit prior to an)i use as allowed by this permit. The Permittee shall notify the Permit Manager by certified mail within 1 0 working days to request a final inspection. This request shall include signed and sealed certification that all materials and construction have been completed in accordance with all applicable Department Standards and Specifications; and that the access is constructed in conformance with the State Highway Access Code, 2 CCR 601-1, and the terms and conditions included in this permit. The engineer of record shall be present for this inspection. The access serviced by this permit may not be opened to traffic until the COOT Access Manager provides written initial approval. 38. Following the final inspection, CDOT will prepare an Access Construction Inspection Summary Letter and send it to the applicant, Permittee, and engineer of record. If additional items are required to complete the access construction, a list of these items will be part of the access construction inspection summary letter. All required items and final as-built survey shall be completed within 30 days from receiving the Access Construction Summary Letter. The access serviced by this permit may not be opened to traffic until written approval nas been given from the COOT Access Manager. If all work appears to have been done in 'general close conformity with the above named permit, an initial acceptance letter will be sent to the Permittee and this access may be opened for traffic. 39. The 2 year warrantee period will begin when the initial acceptance letter is issued. In accordance with section 2.5(6) of the State Highway Access Code, if any construction element fails within two-years due to improper construction or material specifications, the Permittee shall be responsible for all repairs. Failure to make such repairs may result in suspension of the permit and closure of the access. If pre-existing solid waste or hazardous materials contamination (including oil or petroleum contaminated soil, asbestos, chemicals, mine tailings, etc.) is encountered during the performance of work, the permittee shall halt work in the affected area and immediately contact the CDOT Regional Permitting Office for direction as to how to proceed. A driveway approach is understood to be that po11io11 of the county road right-of way between the pavement edge and the prope11y line that is designed and used for the interchange of traffic between the roadway and abutting prope11y. 2. At any intersection, a driveway shall be restricted for a sufficient distance from the intersection to preserve the normal and safe movement of traffic. (It is recommended for rural residence entrances that a minimum intersection clearance of 50 feet be provided and for rural commercial entrances a minimum of 100 feet be provided.) 3. All entrances and exits shall be so located and constructed that vehicles approaching or using them will be able to obtain adequate sight distance in both directions a long the county road in order to maneuver safely and without interfering with county road traffic. 4. The Applicant shall not be permitted to erect any sign or display material, either fixed or movable, Oil or extending over any portion of the county road right-of-wa y. 5. Adjustment will be made according to the type of traffic to be served and other physical conditions. 9. The construction of parking or servicing a.-eas on the county road right-of-way is specifically prohibited. Commercial establishments for customer vehicles should provide off-the-road parking facilities. l 0. The grade of entrance and exit shall slope downward and away from the road surface at the same rate as the normal shoulder slope and for a distance equal to the width of the shoulder but in no case less than twenty (20) feet from the pavement edge.
