COMMITMENT CONDITIONS
1. DEFINITIONS
(a)"Knowledge" or "Known": Actual or ¡mputed knowledge, but not constructive notice imparted by the Public Records.
(b)"Land": The land descr¡bed ¡n Schedule A and affixed improvements that by law constilute real property. The term "Land" does not ¡nclude any
property beyond the lines ol the area descr¡bed in Schedule A, nor any r¡ght, title, interest, estate, or easement in abutting streets, roads, avenues,
alleys, lanes, ways, or wateruays, but th¡s does not modify Õr l¡mit lhe extent that a right ol access to and from the Land is to be insured by lhe Policy
(c)"Mortgage": A mortgage, deed of trust, or other secur¡ty ¡nstrument, includ¡ng one evidenced by eleclronic means aulhorized by law.
(d) "Policy": Each conlracl of title insurance, in a form adopted by lhe American Land Title Associat¡on, issued or to be issued by the Company
pursuant to this Commitment.
(e) "Proposed lnsured": Each person identif¡ed in Schedule A as the Proposed lnsured of each Pôl¡cy lo be issued pursuant to this Commilment.
(f) "Proposed Policy Amount": Each dollar amount specified in Schedu¡e A as the Proposed Policy Amount of each Policy to be ¡ssued pursuant to th¡s
Comm¡tment.
(g)"Publiô Records": Records established under slate statutes at the Commitment Date for the purpose of imparting conslructive not¡ce of matters
relating to real properly to purchasers for value and withoul Knowledge.
(h)"Title": The eslate or interest described in Schedule A.
2. lf all of the Schedule B, Part l-Requirements have not been mel wilhin the time period specified in the Comm¡tment to lssue Pol¡cy, Commitment terminates
and the Company's l¡ability and obligation end.
3. The Company's liability and obl¡gat¡on is lim¡ted by and this Commitment is not val¡d withoul:
(a)the Nolice;
(b)the Commitment to lssue Policy;
(c) the Commitmenl Conditions;
(d)Schedule A;
(e)Schedule B, Part l-Requirements; and
(f) Sôhedule B, Part ll-Exôeplions; and
(g)a countersignature by the CÕmpany or its issu¡ng agent that may be in electronic form.
4. COMPANY'S RIGHT TO AMEND
The Company may amend th¡s Commitment al any time. lf the Company amends thls Commitment to add a defect, lien, encumbrance, adverse claim, or
other matter recorded in the Public Becords prior to the Commitment Date, any liabil¡ty of the Company is limited by Comm¡tmênt Condition 5. Thê
Company sha¡l not be liable for any other amendment to this Comm¡tment.
5. LIMITATIONS OF LIABILITY
(a)The Company's l¡abil¡ty under Commìtment Condition 4 is l¡m¡ted to the Proposed lnsured's actual expense incurred in the inlerual between lhe
Company's del¡very to the Proposed lnsured of the Commitment and the delivery of the amended Cômmilment, resull¡ng from the Prôposed
lnsured's good faith reliance tô:
i. comply with the Schedule B, Part l-Requirements;
ii. eliminate, with the Company's wr¡tlen consent, any Schedule B, Parl ll-Exceptions; or
ii¡. acquire the Title or create the lvlortgage covered by th¡s Comm¡tment.
(b)The Company shall not be liable under Commitmenl Condjtion 5(a) if the Proposed lnsured requested the amendment or had Knowledge of the
matter and did not notify lhe Company about it in writing.
(c)The Company will only have liability under Commitment Condition 4 ¡f the Proposed lnsured would nol have incurred the expense had the
Commitment included the added matter when the Commitment was firsl delivered to the Proposed lnsured.
(d)The Company's liability shâll not exceed the lesser of the Proposed lnsured's actual expense incurred in good faith and described in Comm¡tment
Conditions 5(a)(i) through 5(aXiii) or the Proposed Po¡icy Amount.
(e)The company shall not be liable for the content of the Transaction ldentificat¡on Data, if any.

The Land Use Change shall comply with Article 3,Zoning, including any applicable zone district use
restrictions and regulations.

Proposed in Home Daycare will be located in residential subdivision. lt would provide needed childcare
for families in surrounding area.
7-LO4. SOURCE OF WATER.
Proposed in Home Daycare will be using single family dwelling water system already in place through
Riverbend Water and Sewer.
7-27-TO5. CENTRAL WATER DISTRIBUTION AND WASTEWATER SYSTEMS.
Proposed in Home Daycare will be using existing single family dwellings wastewater system through
Riverbend Water and Sewer. No major increase in usage is anticipated by a children Daycare would be
taking in.
7 -T06. PUBLIC UTI LITI ES.
Proposed in Home Daycare will be using existing public utilities already set-¡n place for single family
dwelling. No major increase in use is anticipated by Daycares day to day activities. Electr¡c is provided
though Xcel Energy. Gas is propane and provided through AmeriGas.
7-T07. ACCESS AND ROADWAYS.
No roads are being put in place for ln Home Daycare.
All existing roads are assumed to be safe and in conformance with applicable County, State, and Federal
access regulations. Daycare use will not cause traffic congestion or unsafe traffic conditions, or impacts
to the County, State, and Federal roadway system.
7-L08. USE OF tAND SUBJECT TO NATURAL HAZARDS.
Property is not subject to identified Natural and Geologic Hazards, such as falling rock, landslides, snow
slides, mud flows, radiation, flooding, or high-water tables.
7 -LOg. FIRE PROTECTION.
Proposed in Home Daycare has adequate primary and secondary access, water sources for fire
protection, fire extinguishers, and maintenance provisions. An evacuation plan is also set-in place to
ensure safety of children and provider.
