Dept. 108 8th St. , Suite 401 Glenwood Springs, Co. 81601 RE: My answers to your completeness review letter dated 10-1-2020 Items 1-13 Dear Mr. Hooper, My responses to your items listed in your above referenced letter are in italics below. Item 1 – see attached Geological Survey Form and payment Item 2 – see updated plans from Boundaries Unlimited Item 3 – We have completed the identified driveway improvement, widening it by 2 feet and other adjustments identified by Dale Stephens at the Garfield County Road and Bridge dept and my excavator and engineer. Dale has approved the work and says that we are now in full compliance for the old driveway permit and Deric has seen and verified the widening of the driveway per the requirements for the subdivision. Item 4 – Per Resolutions 2003-31 and 2003-82, provide an analysis of specific conditions of approval, whether the current uses and improvements are in compliance and whether the future use of the property will require a revision to the specific condition. See below for my response to each item on the applicable resolutions cited below. The resolution is in black, my answers as per compliance on each item are in Red. Analysis- Resolution 2003-31 Specific conditions of Approval – “NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that Special Use Permit is hereby approved, subject to compliance with all of the following specific conditions: I. All representations of the Applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval, unless specifically altered by the Board. I am In Compliance 2. The Applicant shall comply with all applicable requirements of the Garfield County Zoning Resolution of 1978, as amended. I am In Compliance 3. The Applicant shall comply with all State and Federal regulations and standards, such as Noise Abatement, Water and Air Quality. I am In Compliance 4. The Applicant shall comply with the Garfield County Noxious Weed Management Plan. I am In Compliance, I have contacted the Garfield County Vegetation Manager and the NRCS and had them revisit the plan, map the property so I can apply for the NRCS financial assistance available. Their plan and my most recent treatment log is attached. 5. Building permits are required for the new structures. I am In Compliance –we pulled permits for the structures proposed back then and there are no new structures proposed now 6. The area of the storage of raw materials will be screened with appropriate berm (minimum 4' in height) and trees, and/or fencing on the north and trees or other vegetative growth on the east and west. This was amended in the second resolution no. 2003-82, Item 6, to read “The applicant shall install trees along the east and west boundaries of the property. The trees shall be spaced in intervals that will reduce the visual and noise impact to adjacent properties at the point of tree maturity. It was agreed on at the meeting that trees would simply be planted on the east , and that the current cottonwoods and willows would suffice as a screen on the west, the North berm & screen requirement was dismissed in the second amendment, as I hope you will find in the notes or by asking John Martin or others who were there . We planted and watered the trees on the east for a year, but none of them made it. I am prepared to replant those now and will start as soon as I have your approval of the submitted landscape plan. 7. All lighting fixtures shall be designed and placed to prevent direct reflection on adjacent properties, Interstate 70 and County Road 346. I am In Compliance 8. The Applicant shall comply with the following recommendations from the Garfield County Road and Bridge Department: a. No off-loading or parking shall take place on County Road 346. I am in compliance b. A stop sign shall be installed on the property to the entrance to County Road 346. The sign shall be installed in conformance with standards set forth in the Manual on Uniform Traffic Control Devices. I am In Compliance 9. Vibration, emission of smoke and particulate matter, and the emission of heat or radiation shall comply with applicable Federal, State, and County laws, regulations and standards. I am In Compliance, no complaints lodged that I know of 10. The Applicant shall comply with all Local, State and Federal Fire Codes that pertain to the storage of oxygen, acetylene and mineral spirits. I am In Compliance – see attached safety survey forms from Colorado River Fire Rescue 11. The Applicant shall obtain and provide the Planning Department a copy of an exempt commercial well permit. Should water usage exceed 1/3 acres feet, the Applicant shall obtain the additional contract water from West Divide Conservancy District. I am In Compliance and have provided such with my initial application 12. Any uses in addition to the steel fabrication shop, office and storage yard the property owner shall obtain any additional special use or conditional use permit necessary. I am In Compliance and currently working on the Vehicle Sales Use with this application 13. The property owner shall meet the appropriate noise standards which may require the Applicant to meet the "Residential' zone noise level pursuant to Colorado State Statue 25-12-130. I am In Compliance, no complaints lodged that I know of and we have not changed or added any equipment louder than what we began with back in 2006 Analysis- Resolution 2003-82 Specific conditions of Approval – 1. All representations of the Applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval, unless specifically altered by the Board. 2. All conditions of Resolution NO. 2003-31 shall remain in effect unless otherwise amended by this Resolution. 3. The applicant shall comply with all applicable requirements of the Garfield County Zoning Resolution of 1978, as amended. 4. The applicant shall comply with all state and Federal regulations and standards, such as Noise Abatement, Water and Air Quality There has not been any change in the type of equipment that we use. We are in compliance. 5. The applicant shall comply with the Garfield County Noxious Weed Management Plan. Prior to the issuance of the actual Special Use Permit, the Applicant shall provide a weed management plan outlining management of the Russian olive and Russian knapweed currently on the property which shall be reviewed and approved by the Garfield County Vegetation Manager See attached updated weed management plan, map, and most recent treatment log 6. The applicant shall install trees along the east and west boundaries of the property. The trees shall be spaced in intervals that will reduce the visual and noise impact to adjacent properties at the point of tree maturity. See landscape plan attached -the trees we planted in 2006 all died -the natural occurring screen of cottonwoods on the west we were told by Garfield County would suffice , I will get started on replanting as soon as you guys approve the new plan or give me direction otherwise. I have attached a quote coming from Mt View Tree Farm and Nursery on the appropriate trees, I would like to have the option to substitute Juniper and Pinion which will be more deer/elk resistant . I will be paying cash for this from a home equity loan . 7. All lighting fixtures shall be designed and placed to prevent direct reflection on adjacent properties, Interstate 70 and County Road 346. We are in compliance 8. The applicant shall comply with the following recommendations from the Garfield County Road and Bridge Dept.: a. A new driveway access permit shall be obtained from the Road and Bridge Department. We complied back in 2003 and finalized some changes for them last week b. No off -loading or parking shall take place on County Road 346 We never do this; it would be extremely difficult even if we had to c. The existing driveway shall be brought up to the new driveway access regulations with a new driveway permit issued by the Road and Bridge Department. Work completed 11-23-20 and approved by Dale at GCRB 9. Vibration, emission of smoke and particulate matter, and the emission of heat or radiation shall comply with applicable Federal, State, and County laws, regulations and standards. We are in compliance and will make changes as noted – see safety inspection from Colorado River Fire Rescue 10. The Applicant shall obtain and provide the Planning Department a copy of the new well permit which allows the additional proposed uses. In Compliance -in the submittal back in 2003 and in the current one 11. This Special Use Permit is granted for the timber log framing business, including a staging area, raw material storage and employee parking, as well as a truck and equipment parking, storage and repair business, including designated parking and storage areas as presently described. In the event any representations made in application for which this permit is granted change and are no longer consistent with the representations in this application, the Applicant shall be required to submit a new permit application to the county addressing the changes. See attached mapping of designated areas for activities per Deric Walters, Boundaries Unlimited 12. Volume of sound generated by the operations on site shall comply with the standards established in the CRS 25-12-103. Upon a receipt of a legitimate allegation of a violation with respect to noise/sound, the Applicant shall be required to provide proof of compliance with State dB levels. In compliance 13. A Drainage Study for the entire property, as committed by the Applicant, shall be submitted prior to the issuance of the actual Special Use Permit. In addition, a revised site plan illustrating the location of employee parking shall be submitted prior to the issuance of the Special Use Permit. The study and illustration have been submitted -see attached 14. All waste shall be enclosed within wildlife proof garbage receptacles. In Compliance 15. Prior to the issuance of the actual Special Use Permit, the Applicant shall provide in writing from the Silt Fire Protection District (now Colorado Fire Rescue) approval of the appropriate storage of hazard materials, i.e. diesel and gasoline, fresh oil” rotella” and waste oil. In Compliance – see attached reports from Colorado River Fire Rescue 16. The applicant shall submit a yearly review for compliance with the Special Use Permit in accordance with section 9.03.05 of the Zoning Resolution of 1978, as amended. Getting in compliance now 17. Dust suppression on the internal driveway shall be adequate to prevent dust particles from traveling onto adjacent properties. In Compliance Item 5-Clarify whether the drainage structures planned on the original grading plan for the southern portion of the property have been completed. The retention ponds and pipe stands were not completed as we were out of money and drainage issues were not and have not been a problem here. Any runoff even after extreme storms seems to drain away leaving that area virtually dry most of the year. I am having Bub Dunnelson from Screaming Eagle work up a bid on this now. Due to financial burden and no immediate need for this, we are wondering if you could waive this requirement until future development is contemplated. Item 6- Current Civil set prelim plat and site, does not meet the requirements for Site Plan. They need a separate site plan meeting the LU & DC requirements be submitted instead of a single plan attempting to serve both functions. The Site Plan should define where the various steel facility, vehicle repair, sales uses, parking, storage, etc. are proposed to be located. See attached updated plans from Deric Walters at Boundaries Unlimited Item 7- Compliance with Section 7-301. C. Buffering of the LU& DC and in relation to the buffering conditions of Resolutions 2003-31 and 2003-82 If you are talking about the berm on the south side in the first resolution, we have been discussing that the second resolution and tree screening is all that is necessary and we have presented a landscape plan Item 8- Address compliance with Section 7-302 See attached -We are in compliance Item 9- The existing uses and improvements, such as parking and storage, do not appear to match the Site Plan that was approved with the previous Resolutions. Please clarify if this is the case and what changes are proposed from the past approvals. Existing uses are similar, and improvements have changed some, we tore the trailer home off in 2017, so there is no longer a residential use. The log timber framing never came to fruition and the truck tire repair morphed into auto body repair, parking and storage has expanded to the attached designated uses on the map provided by Deric Walters Item 10-change prelim plat to Fix It Minor Subdivision and remove Prelim plat. Add required Lien Holders certificate to the plat. Done – see attached Item 11- Provide documentation of compliance to Section 5301.C. LU & DC – Section 5301.C. Review Criteria. In considering a Minor Subdivision application, the application shall demonstrate the following: 1. It complies with the requirements of the applicable zone district and this Code, including Standards in Article 7, Divisions 1, 2, 3 and 4. Included in the submittal 2. It is in general conformance with the Comprehensive Plan. Yes, we feel it is 3. Shows satisfactory evidence of a legal, physical, adequate, and dependable water supply for each lot. Included in the submittal 4. Satisfactory evidence of adequate and legal access has been provided. Included in the submittal 5. Any necessary easements including, but not limited to, drainage, irrigation, utility, road, and water service have been obtained. Included in the submittal 6. The proposed Subdivision has the ability to provide an adequate sewage disposal system. Included in the submittal 7. Hazards identified on the property such as, but not limited to, fire, flood, steep slopes, rockfall and poor soils, shall be mitigated, to the extent practicable. Included in the submittal 8. Information on the estimated probable construction costs and proposed method of financing for roads, water distribution systems, collection systems, storm drainage facilities and other such utilities have been provided. See bids from Bub Dunnelson , Screamin Eagle attached to get driveway in compliance for past driveway permit and for the work that remains on the drainage plan, once you guys approve it as we had to make some changes to it . I will be paying cash from a home equity line on my house for all work . 9. All taxes applicable to the land have been paid, as certified by the County Treasurer’s Office. Yes, they are 10. We would need approximately 6 belly dump loads of class 6 road base to level and taper out the existing grade as well as use some around the existing culvert. We will apply this material then wet and compact it. We will remove the existing Eastern gate post to make the driveway 30’ wide and reset it with concrete, expose the existing culvert and use some class 6 around the pipe to ensure it has enough cover to sustain travel. You will have to extend the gate as I’m sure your people are better at that than I am! I spoke to my supplier of the black base and he said it wouldn’t freeze and move like one would think so if you want to do any of that now would be the time due to the roller and water truck being onsite. Without black base $4800 With 4” black base cover $5600 Let me know what you decide! Spray these in spring/summer when in rosette form, or when they start to bolt (before flowering). Surfactant: When using Milestone, add a non-ionic surfactant such as Premier 90 or Activator 90 to help the herbicide penetrate the plant and be more effective. Use at a rate of 1oz/3 gallons water. Annuals: For Russian thistle (tumbleweeds), goosefoot and kochia, you can use the RoundUp you’ve been using; I wouldn’t use store-brand RoundUp as it’s very diluted. You can buy a 2.5 gallon jug of GlyStar (same active ingredient but higher concentration) at any store that sells herbicide. - Use at a rate of 6 oz/gallon water (but you can go all the way up to 13 oz/gallon if you don’t think 6 is cutting it). Use carefully – glyphosate is non-selective, meaning it will kill or hurt any plants it touches. - Try to spray in spring/early summer when plants are 10” or less Other (non-glyphosate) options for annual weeds are Weedmaster OR Rifle-D. Use at a rate of 1oz/gallon of water plus surfactant listed above. *You can also add Escort at ½ gram/gallon of water to either Weedmaster or Rifle-D to have a better impact. **If you use Escort, first mix your measured amount of dry flowable into a cup or so of water to make a slurry and then add this to your spray tank. Tamarisk and Russian olive – treat in winter, summer or fall; avoid spring as sap will tie up herbicide Use the glyphosate you already have if site is dry, or Rodeo (or other aquatic-labeled glyphosate) if along ditch/drainage or near water. Tamarisk – For cut-stump treatments, apply undiluted glyphosate to cut surface (especially tree cambium) as soon as possible after cutting.
