Roadway and Design Standards ............................................................................................. 6 Laramie Energy, LLC Annex Cuttings Facility Administrative Review Application Narrative Article 4 Section 203.B.5. - Project Description Garfield County Administrative Review, 2020 2 | Page 1) Introduction Laramie Energy, LLC (Laramie) is pursuing an Administrative Review (AR) in Garfield County for the development of a non-commercialized drill cuttings treatment site, the Cascade Creek 697-15-54 Annex Cuttings Facility (ACF). The proposed site will be located on private property, owned by Laramie, approximately 16 miles north of DeBeque, Colorado. The site use will be defined as Processing. The facility’s main function will be to accommodate an overflow of dried drill cuttings material from three well pad locations. 2) Description The following narrative addresses the requirements for the Project Description under Article 4 Section 203.B.5 of the Garfield County Land Use and Development Code (LUDC). The purpose of the proposed facility will be to accommodate an overflow of cuttings material from three well pad locations within the Cascade Creek (CC) field. The ACF will reduce overall heavy traffic on county roads by allowing vehicles to transport drill cuttings from the source well pad to a location within Laramie’s property. The parcel is currently owned by Laramie. The ACF will be a non-commercialized Exploration & Production (E&P) Waste Management facility (as defined by the Colorado Oil and Gas Conservation Commission (COGCC)) for the treatment of drill cuttings from three future well pad locations within Laramie’s Cascade Creek field. The facility will only manage the treatment and beneficial reuse of cuttings generated by Laramie’s drilling activities and will not provide services to third parties. Laramie will be the sole operator and user of the subject site. The proposed site will be approximately 7.3 Acres. ACF will eliminate the need to transport drill cuttings to a landfill disposal facility. The proposed site will accommodate additional overflow of cuttings material from three COGCC approved well pad locations in the Cascade Creek Field: CC 610-21-41 (up to 24 wells), CC 697-15-08 (up to 18 wells), and CC 603-23-32 (up to 24 wells). Laramie Energy foresees the subject multi-well pad locations will produce a volume of drill cuttings that will exceed each well pad’s cuttings storage capacity. The stated well pad locations, (Hauling Route Map – Maps and Plans tab) will be able to hold approximately 40% of the cuttings produced from drilling. An estimated 33,000 cubic yards will be generated from the 66 wells of the 3 well pad locations. Laramie Energy estimates that 19,800 cubic yards of untreated cuttings will need to be transported to ACF. The proposed site design is to provide storage for cuttings for 44 wells from the 3 locations and will allow for 22,000 cubic yards of material to be managed and stored. Cuttings will be mixed with a drying agent (sawdust) on the source well pad location prior to transportation to the ACF. Once 2,000 cubic yards of dried untreated drill cuttings accumulates on the well pad, the material will be transported to the ACF. Transporting and treatment of the cuttings will occur in phases approximately between every 30 to 50 days. The cuttings will be transported in accordance with COGCC transportation regulations when delivered to the approved ACF. Upon arrive at the ACF, the cuttings will be unloaded in the ACF’s cuttings trench. Dried cuttings will be treatment in cells within the cuttings trench. Drill cuttings will be treated in cell units of approximately 2,000 cubic yards. Seven to 10 treatment cells will be utilized during the life of the ACF. The cuttings will be blended with native soils. It is estimated the mix will require less than a 1:1 ratio to meet current COGCC analytical requirements. The mixed cuttings will be routinely turned to allow for aeration and biodegradation. Mixed cuttings will be sampled on a periodic basis to determine completion. The dried drill cuttings will be partitioned into cell phases. Each cell will be treated and sampled separately. Once a treatment cell meets current COGCC analytical soil standards, the treated cuttings will be graded and moved to the western side of the sloped cuttings trench. Using land application method, the treated drill cuttings will serve as beneficial reuse as fill to allow for natural contouring during reclamation of the site. Remediation activities will occur in stages as each treatment cell meets COGCC analytical standards. Reclamation and final grading activities will begin after all cell phases meet current analytical standards. Local native soil from Laramie’s Cascade Creek operating field will serve as top fill for the site. The site will adhere to reclamation and revegetation recommendations from the WestWater Engineering, Inc.’s (WestWater) site-specific Reclamation, Revegetation, and Noxious Weed Management Plan (Maps and Plan tab). Drilling will start around June 2021 (3rd quarter) with the first drill cuttings being delivered in late July 2021, approximately two (2) months after initial drilling. The subject cuttings will incorporate transportation by 2-3 off road haul trucks. Each truck has an approximate capacity of 23 cubic yards. Drivetime (including loading and unloading of the cuttings) from the well pad to the proposed ACF is estimated at 30 minutes. Approximately 920-1380 cubic yards of untreated cuttings could be transported in a 10-hour work. Signs clearly marking the truck loading/unloading area and access shall be provided and maintained by the operator. The average vehicles per day would be less than a quarter (0.25) or one vehicle every 4 days accessing the ACF. If Laramie were to haul the subject drill cuttings off-site to a landfill, semi-trucks would be utilized for delivery. The average semi-transportation truck can haul 18 cubic yards. This would result in approximately 1,612 trips of large vehicles accessing County Road. The ACF significantly reduces future traffic on public roadways. The proposed site will circumvent an estimated 1,330 large vehicle trips on public roads. The site is located within the 10,100-acre parcel. An access road to the site location is maintained and owned by Laramie. The site location was previously developed as an approved well site and annex pad. Existing equipment located on the western boundary of the CC 697-15-54 is not included in the perimeter of the proposed ACF. The ACF will not require personnel to be staffed at the site on a regular basis. Personnel will only be on-site during unloading and treatment of cuttings and for grading activities. The ACF site has been designed to mitigate potential risks to wildlife. WestWater conducted an environmental impact study. WestWater concluded that fencing is not recommended for this ACF. Fencing could alter daily big game movements on a small scale. No migration corridors would be affected with the development of the propose site. Big game species are not restricted to specific movement corridors in this area and the presence of this facility will not create a barrier. Findings, figures, recommendations are detailed in the Sensitive Areas Study (Impact Analysis tab). The site will be inspected regularly to identify potential conditions that could cause impacts. Per Laramie Energy, LLC Annex Cuttings Facility Administrative Review Application Narrative Article 4 Section 203.B.5. - Project Description Garfield County Administrative Review, 2020 4 | Page COGCC requirements for a Centralized (E&P) Waste Management Facility, three site-specific monitoring wells will be installed: two monitoring wells will be installed down gradient and one installed up-gradient. The location and sampling plan of the monitoring wells will be determined once the COGCC has reviewed the Form 28. The monitoring wells will be installed at least 20 feet below ground surface. These wells will be monitored to detect possible impacts from the ACF operations. There is will a total of 4 stages during the lifetime of the ACF. The stages and estimated timeframe of each state is listed below: • Initial Grading Activities (10 weeks) • Transportation (30-50 days) • Treatment (18 months) • Final Grading and Reclamation Activities (27 days) The subject site will be permitted as a Centralized E&P Waste Management Facility under COGCC 907 Rule (part of the COGCC 900 Rule Series). The application for COGCC permitting will be pursued concurrently with Garfield County’s Administrative Review application. The site will be inspected regularly to identify potential conditions that could cause impacts. Per COGCC requirements for a Centralized E&P Waste Management Facility, three site-specific monitoring wells will be installed: two monitoring wells will be installed down gradient and one installed up-gradient. The final location and sampling plan of the monitoring wells will be determined once the COGCC has reviewed the Form 28. The monitoring wells will be installed at least 20 feet below ground surface. These wells will be sampled to monitored groundwater in the area. Laramie will obtain all necessary permits (including grading permit) from the Garfield County Community Development Department as required before the start of any future construction activities at the ACF site. 3) Purpose and Need The proposed ACF site will result in improved efficiency in transportation and treatment of drill cuttings. The proposed site is located on Laramie’s property and within the Cascade Creek field. The ACF site is critical to Laramie’s ability to drill the proposed natural gas wells within the Cascade Creek operational field. 4) Location The proposed ACF site plan is designed to be approximately 7.3 acres and will be easterly located on parcel 2169-214-00-026, the Southwest ¼ of the Southeast ¼ of Section 15, Township 6 South, Range 97 West of the 6th Principal Meridian, Garfield County. The subject parcel is approximately 10,100 acres. The subject parcel is zoned Resource Lands-Plateau. All adjacent parcels are zoned resource lands or public lands. The parcel is located 12.2 miles north of DeBeque, Colorado. The site is located approximately 9.6 miles from the nearest public road, County Road 213. Laramie Energy, LLC, the applicant, is the owner of the property. Recorded deeds are provided in the Parcel Details tab. In accordance with C.R.S. §24-65.5-101, a copy of the mineral interest owner of the subject property is located in the Parcel Details tab. Laramie is the sole owner of mineral rights for the subject parcel. 5) Adjacent Property Landowners An address list of real property adjacent to parcel 2169-214-00-026, the mailing address for each of the property owners and the appropriate portion of a Garfield County Assessor’s Map showing the project site location and all public and private landowners adjacent to the subject parcel are provided in the Parcel Details tab. 6) Section 4-202 Waiver of Submission Requirements 6.1) Section 4-203 J. Development Agreement Laramie requests a waiver for the Development Plan, Section 4-203(J) of the Garfield County Land Use and Development Code. The proposed site is an industrial use and will solely be owned by the applicant. The Development Agreement is not applicable to the proposed site because the applicant does not seek to enter into a development agreement. 6.2) Section 4-203 K. Improvement Agreement Laramie requests a waiver for the Improvement Agreement, Section 4-203(K) of the Garfield County Land Use and Development Code. The site will not require the installation of public utilities nor will increase demands on public facilities. The site location is remote and is currently used for oil and gas activities. The Improvement Agreement is not applicable to the proposed site because the remote location will not require the installation or improvements of public facilities. 6.3) Section 4-203 L. Traffic Study Laramie requests a waiver for the 4-203L.1.c Study Preparation, which states the study can be completed by a professional engineer. The development of the ACF will reduce vehicles accessing public roads. The average vehicles per day accessing public roads is one vehicle every 4 days. If Laramie were to haul the subject drill cuttings off-site to a landfill, semi-trucks would be utilized for delivery. The average semi-transportation truck can haul 18 cubic yards. This would result in approximately 1,612 trips of large vehicles accessing county roads. The ACF significantly reduces future traffic on public roadways. The proposed site will circumvent an estimated 1,330 large vehicle trips on public roads. Laramie has provided a Traffic Summary, detailing trips required to constructed, operated, and reclaim the ACF. The Traffic Summary provides traffic routes, roadway analysis, trip generation and distribution, and impacts of the proposed site. The ACF has an anticipated lifespan of three (3) – five (5) years. 7) Section 4-118 Waiver of Standards Laramie Energy, LLC Annex Cuttings Facility Administrative Review Application Narrative Article 4 Section 203.B.5. - Project Description Garfield County Administrative Review, 2020 6 | Page 7.1) Section 7-107 F. Roadway and Design Standards Laramie requests a waiver for the Roadway and Design Standards, Section 7-107 of the Garfield County Land Use and Development Code for Laramie’s existing private access roads. The access road within the perimeter of the proposed site will be built to meet all the 7-107 Roadway Standards set forth in the LUDC. Like many of the historical roadways in Garfield County, Laramie’s private access and roadways were established prior to the Garfield County’s roadway standards. Laramie’s roadways are maintained to provide safe access to sites and are inspected for stormwater compliance. Roadways were designed for oil and gas transportation vehicles and equipment. These roads are not intended for or allow public access. Laramie enforces reduced vehicular speeds and specific safety driving measures. All roads located on the subject parcel are maintained by Laramie to achieve optimal safety, including speed restrictions, regular road maintenance, dust controls, and snow maintenance. The ACF is located within Laramie’s Cascade Creek oil and gas operating field. The site is located approximately 9.6 miles from the nearest public road, County Road 213. To access the site, vehicles will travel on Laramie’s privately owned and maintained Cascade Creek field access roads. The roads were constructed by the previous operator, OXY USA WTP LP (OXY). OXY pursued land use change permits while as owner and operated of the Cascade Creek field and subject parcel. Garfield County reviewed and accepted a waiver for the Cascade Creek operating field roads in 2015. OXY’s roadway assessment documents, approved by Garfield County, are provided in Standards tab. The Laramie took ownership of the Cascade Creek operating field in 2016. Laramie has continued maintain and improve the roadways located within the Cascade Creek field. D.R. Griffin and Associated (DRG) worked with OXY to design and construct the Cascade Creek Roadway system. DRG’s engineer reviewed OXY’s approved roadway assessment documents and agree with the reports. Garfield County’ Policy 01-14, “Waivers for Roads and Demonstration of Compliance”, states roads must be deemed “safe and adequate” by a Professional Engineer (PE). DRG submitted a PE stamped letter addressing Laramie’s access roads. A PE analysis was conducted by Rock Solid Solutions and deemed the subject roads “safe and adequate”. Roadway documents, including narratives, assessments and reports are detailed in the Laramie Cascade Creek Operating Field Access Roads packet, provided in the Standards. GENERAL PROJECT DESCRIPTION The Applicant is proposing to operate a facility for storage and processing of drill cuttings from Laramie Energy well pads in the vicinity of the facility. The facility will serve only Laramie Energy well pads and accommodate approximately 29,000 cu.yd. of cuttings. Haul route access to the site will be limited to private roadways between 0.5 and 2.65 miles from the facility. No County Roads will be affected by the haul route. The location is on a previously developed COGCC well pad and will operate in compliance with all COGCC Standards and Regulations. Once the drill cuttings meet COGCC standards they will be permanently disposed of/stored in accordance with COGCC standards. The Applicant will be coordinating with the COGCC for permitting. The application should address where the applicant is within the COGCC permitting process. II. Where technical issues are concerned (i.e. roadway standards, traffic, drainage, erosion control) the Application needs to demonstrate that the issues are adequately addr essed so that the waiver criteria is being met. Technical expertise and engineering reports may still be required to support the waiver request. Pre-application Summary Prepared by: 10/7/20 ____________________________________________ _____________ Glenn Hartmann Date Principal Planner 5 | P a g e Policy 01-14 Waivers for Roads and Demonstration of Compliance March 3, 2014 Section 7-107, Access and Roadways, of the Garfield County Land Use and Development Code (LUDC) requires all roads to be designed to provide for “adequate and safe access” and reviewed by the designated County Engineer. The LUDC defines “road” as “a County road, State highway, public road, street or alley, or private thoroughfare which affords primary access to abutting property, excluding a driveway accessing a single property.” The LUDC defines “private road” as “a right-of-way constructed, established, owned, and maintained by a private party for access exclusively to private property.” Many of the roads in Garfield County are private roads in that they are gated and do not serve the general public and they pre-existed the design currently required by the County’s Road St andards as defined in Table 7-107. The LUDC allows for the waiver of specific standards provided that the following criteria have been met: 1) an alternative design achieves the intent of the subject standard to the same or better degree and 2) the pro posed alternative will impose no greater impacts on adjacent properties than would occur through compliance with the specific standard (Section 4-118). In applications that include roads that do not meet current County road standards as outlined in Tabl e 7-107, the County has asked that Applicants request a waiver of Section 7-107.F, Design Standards, and include in the Application submittal sufficient information, prepared by a professional qualified in the specific discipline, to demonstrate that they meet the criteria outlined in Section 4-118 for granting a waiver. In doing so, the application must include: A Statement of Adequacy - The evaluation of the existing roadway and waiver will need to include a clear statement that finds that the road will be adequate for the proposed use. This statement must be signed by a professional engineer qualified in traffic engineering and licensed by the State of Colorado. T o support this evaluation, the following information will be required to be provided: o Geometry of the road – A description of how the private road does/does not meet the design standards in Table 7-107. This should include a chart that compares the private road design to those standards in Table 7-107, as well as a map that shows the existing road design and highlights those areas that deviate from the standards. A narrative may also be helpful in describing the characteristics of the road as they compare to Table 7-107 design standards. Unless available, this is not intended to imply construct ion- level drawings. o Safety/Structural Issues – A description of obvious safety and/or structural issues observed and a statement about how these issues will be addressed. o Maintenance – A description of how the road is and/or will be maintained. This shou ld be supported with the submittal of any existing or proposed maintenance agreements for the road sections. o Travel Demand – An accurate count of the existing peak travel demand as well as the Average Daily Traffic on the road. This should also include t he types of vehicles that currently use the road as well as 6 | P a g e the additional amount and type of traffic that the proposed use will generate through all phases of its development. Other Evidence of Compliance. In addition, Sections 7-107.A, B, C, D, and E are required to be addressed, which includes documentation about legal access. Sufficient evidence will be required to be submitted to demonstrate compliance with these sections of the Code.
