Public Hearing - Staff Request for Continuation
Staff review and preparation of the Staff Report is ongoing and pending receipt of all
referral comments (CPW & Division of Water Resources) and additional information per
referral comments. A complete Staff Report will be presented to the Board prior to the
continued public hearing that is being requested.
The Applicant has provided copies of public notice documentation in accordance with
the Land Use and Development Code requirements'
Public notice documentation is subject to the County Attorney's Office review and
direction prior to opening the Public Hearing.
The Board's Packet included the Application Submittals, Referral Comments received
to date, and Public Comments received to date. These are noted in the Exhibits List
provided.

a Staff has received a public request and a request from legal representatives for the
public, for copies of referral comments and public comments. These will be consistent
with the Exhibit List.
Staff will defer to the Board of County Commissioners calendar and schedule for
selecting a date for the site visit.
The public will be able to attend the site visit but per County Attorney direction will be
able to listen but not present testimony.
Staff has requested that the Applicant provide story poles (or alternative height
delineators) and staking for building locations for the Bocc site Visit.
Staff is requesting a continuation of the public hearing based on the following:
r Allow scheduling of the Board of County CommissionerE Site Visit.o Allow additional time to receive referral comments from Colorado Parks and Wildlife
(CPW) and Colorado Division of Water Resources.¡ Allow the Applicant to respond to additional information requests based on Referral
Comments including but not limited to traffic information and documentation
associated with the Harmony Lane Access and proposed improvements.o Allow the Public additional time to review Referral and Public Comments.
Staff recommends the continuation be set for a date certain and be for a minimum of 30
days. Available dates in late June (June 21st) or early July (July 6th & 12th) are suggested
subject to Board availability.

Dear Glenn:
This office has rcviewed the documents provided for the land use applications of Ascendigo
Ranch, The submittal was found to be thorough and well organized. Comments generated are not
specific to any application in particular but the project as a whole. The review generated the
following comments:
1. The existing well permits are not congruent with the proposed uses. The wells will need to be
permitted for the proposed watet uses.
2. A pump test should be provided for proposed Well 1'
3, Water quality test results should be provided for Well 1.
4, The application materials providecl design flows and leachingarea sizes for multiple proposed
OWTS but did not provide OWTS designs. The Applicant will need to apply for OWTS
pemits for each ryst"* proposed. Systems with flows greater than 2,000 gallons per day will
need to be permitted by CDPHE.
5. The Appüòant proposes to provide less parking than would be required by Garfield County.

to be much less than the traffic that would be estimated by adding similar uses from the ITE
trafftc generation studies. The Applicant should provide some of the assumptions from these

tt'ips, deliveries, etc. are not included, and trips generated during special events.
12. The trafTìc study shows that improvements to Harmony Lane are warranted. This Applicant

At the request of Garfield County (GARCO), LRE Water reviewed the land use application
of Ascendigo Autism Services for the proposed Ascendigo Adventure Camp project. The
proposed project includes base camp dining hall, camper and staff lodging, activity barn,
guest house, caretaker house, maintenance barn, and equestrian structure. The submittal
includes an engineering report dated March 18, 2021 prepared by Roaring Fork
Engineering, which included Appendix M (SGM Water Supply Adequacy Report),
Appendix N (Water Quality Data). LRE Water's review covers the water supply plan for
the project and includes applicable technical criteria and standards in Article 4-103, 4-
201, 4-203, and ArticleT of the GARCO Land Use and Development Code (LUDC). LRE
Water's comments are presented below.
Sections 4-203(M) andT-104 Water Supply
Potable water for the proposed project uses will be served by the existing central water
system. The existing water system includes two wells, a 200,000 gallon storage tank,
and a distribution system capable of delivering peak demands and fire flows. The existing
water supply plan for the property includes two wells known as Levitt Well No. 2 (DWR
Permit No.55124-F) and Levitt Well No. 3 (DWR Permit No.55125-F), and BWCD
Contract No. 269. The BWCD Contract No. 269 was included in the BWCD batch plan
for augmentation decreed in Case No. 01CW305. The BWCD augmentation plan allowed
Contract No. 269 to have 14.2 AF of diversion and 4.3 AF of depletion (the amounts of

14.9 AF of diversion and 5.1 AF of depletion included transit losses from Ruedi Reservoir
releases). The applicant can serve all of its indoor uses and up to approximately 1.7
acres of outside irrigation using the existing BWCD Contract. However, the Applicant can
obtain additional contract water if it wants to have up to 1.84 acres of irrigation (or more )
from the central water system. The BWCD Contract and the well permits will need to be
amended to include commercial use, and additional water use, if needed.
The Applicant owns shares in the Missouri Heights Mountain Meadow lrrigation Company
that were used to historically irrigate the property. The water derived from these shares
can be used for continued irrigation of the property to the extent water is physically
available from Cattle Creek and Spring Park Reservoir.
There is an existing irrigation control pond anri the property and the applicant proposes a
future pond of one to two acres in size. The Applicant proposes to change a portion of
its irrigation water rights to allow for filling and replacement of evaporative losses for
recreational use. Such change of water right would be adjudicated through the water
court process.
The physical supply from the Levitt Well Nos. 2 and 3 has been evaluated in pumping
tests in 1996, 2016 and 2020. The tests indicate that the wells are capable of supplying
the demands of the project. As indicated in the Exhibit M SGM report, the water levels in
the wells should be monitored and demand management of irrigation use from the wells
should be implemented. The irrigation plan should minimize the amount of rrrrgation trom
the wells and maximize the use of the senior irrigation water rights.
The existing watersystem has been maintained operationalforthe approved White Cloud
Subdivision by Zancanella and Associates since the time the system was constructed.
The water quality data indicates that the water supply is suitable for a domestic supply.
Such conclusion was previously determined for the White Cloud Subdivision.
ln summary, the water supply plan meets the County code criteria and demonstrates that
the proposed project has a legal (with the stated modifications) and physical supply of
water. The Division of Water Resources has authr¡rity over the legal and physical supply
and will ultimately determine if the plan is acceptable or needs modification. The diversion
and depletion of waterwill be similar to the existing subdivision approvals for the property.
The BWCD contract will need to be amended to include commercial use and then the well
permits would be amended to include commercial use pursuant to the amended BWCD
contract. lf the Applicant develops a pond for recreational use, it will need to go through
the water court process to allow for the filling and replacement of evaporative losses
through a change in its irrigation water rights.

After reviewing the application for Ascendigo, I have a few concerns. They did not address the kind of improvements to
the private road they plan on doing other than chip seal. There are more improvements needed than just chip
seal. They did not address the drainage improvements that are needed, or the current road needing improved before
chip seal can be placed. ls chip seal a good option in that area, or is gravel or pavement better? They did not address
the maintenance, and who is responsible for the private road after the road is upgraded. Road and Bridge does not
want to take on the maintenance, and upkeep of this road. The traffic count study was for 1 day, and typically a traffic
count study should be done for a full 7 days to get an accurate count, including weekends. There needs to be more
information provided for me to make accurate referral comments.

Noxious Weeds
The applicant did participate in the Conservation Districts/Garfield County 2020 noxious weed cost-share program. ln the
permit application they have stated that weed management will be an ongoing responsibility. They did provide the
Districts with a noxious weed map with their 2020 cost-share application.
Revegetation and LandscaPing
Revegetation - Staff requests that the applicant quantify any new surface area disturbances that may require
reseeding. This does not include areas within building envelopes. This quantification will help determine if a
revegetation security is necessary. These areas would include:
a Plant materials list and seed mixes - These are acceptable.
Species of concern
a Populations of Harrington's penstemon or Harrington's beardtongue (Penstemon harringtonii) was found many
years ago in a neighboring subdivision. This plant is a flowering perennial that is endemic to Colorado and only
found globally in six Colorado counties, including Garfield and Eagle counties. Although rare, there are no state
or federal protections in place regarding this plant. lf the property owner is interested, further information on this
plant may be found on the Colorado Natural Heritage Program website,

I have reviewed the application for the Ascendigo Ranch and have the following
comments.
1. Drinkinq Water:
a. The water supply provided by the existing wells on the property appears to
be adequate in both quantity and quality for the proposed use, based on
laboratory testing of water samples from the wells and a long-term pump
test performed to indicate aquifer drawdown and recovery.
2. Onsite Wastewater Treatment Svstem:
a. The proposed Ascendigo Ranch project involves multiple structures, with
six proposed Onsite Wastewater Treatment Systems (OWTSS) spaced
across the site. Each of these OWTSs are designed to handle less than
2,000-gallons per day each. Each of these systems will require their own
permit application, associated fee, and review.
b. As part of the review process, the OWTS concept was sent to the
Colorado Department of Public Health and Environment (CDPHE) for their
review regarding the design capacity evaluation. We agree with the
findings presented in the letter published by CDPHE. Garfield County
Public Health (GCPH) will be the reviewing agency of these systems, as
Gar¡eld County Public Health Department - working to promote health and prevent disease
the design capacig of the systems are below 2,0OO-gallons per day. The
OWTSs presented in the Limited lmpact Review Application are
conceptual in nature, and full designs (including all requirements of the
application process) will be required for each system. We also agree with
the conditions of approval listed in the CDPHE letter, as well as the
subsequent recommendation regarding the waste strength from the
Basecamp building.
3. Radon Resistant New Construction (RRNC):
c. While not currently required by Garfield County's building code, it is
recommended that the proposed buildings at the Ascendigo Ranch be
constructed using Radon Resistant New Construction (RRNC) standards.
This can represent a significant cost-savings to the owner over installation
of a mitigation system after the building is constructed. The buildings
should be tested for radon after construction is complete, at which time a
fan can be added to the passive systems if elevated radon levels are
present. Free radon test kits are available at Garfield County Public Health
offices and the Clean Energy Economy for the Region (CLEER) office at
the 3'd Street Center in Carbondate.

I have the following preliminary comments regarding the Ascendigo project based on a review of the proposed
structures:
L. There appears to be two different lodging type structures one for campers and one for staff. These structures
would be reviewed as Residential R-1 and R-2 occupancies respectfully per the lnternational Building Code (lBC).
2. The Camp Headquarters would be reviewed as a Business (B) occupancy.
3. The Activity Barn would be a mixed used structure possibly Utility (U), Storage (S) and Educational (E).
4. There appears to be a single-family dwelling unit that would be reviewed under the lnternational Residential
Code (lRC).
5. Other accessory use buildings would be reviewed under the IBC based on actual use.
I would anticipate a fire sprinkler system for the residential (R) uses. Specific building code review would be based on
the final building plans, specifications and uses.

Ascendigo Autism Services from Garfietd Co. Community Devetopment Department on Aprit 1 ,2021.The
division reviewed the request to determine if this proposal meets the definition of a domestic wastewater
treatment works, or if it can be under tocat jurisdiction as an onsite wastewater treatment systems (OWTS)
accepting tess than or equal to 2,000 gpd'
A domesticwastewatertreatmentworksis defined by the ColoradoWaterQuality ControlAct (the "Act"),
525-8-1 03(5), C.R.5., as:
,'...e system or facility for treating, neutralizing, stabilizing, or disposing of domestic wastewater
which system or facility has a designed capacityto receive more than two thousand gallons of
domestic wastewoter Per day."
As this development witt have total flows greater than 2,000 gpd but proposes to install multiple OWTS on a
single parcel, the division reviewed the proposa[ under the criteria in the division's "SiteApplication Policy
6: Muttipte On-Site Wastewater Treatment Systems" (Poticy ó). Poticy 6 describes the division's
implementation of Regutation 22 Site Location and Design Regulations for DomesticWastewaterTreatment
Works (5 CCR 1OO2-22) for sites with muttipte OWTS that might otherwise be permitted by the local public
heatth agencythrough local regulations adopted pursuantto the On'siteWastewaterTreatmentSystemAct,
23-10-101, etseq. C.R.S. (OWTSAct)and Regulation43, On-siteWastewaterTreatmentSystemRegulation
(5 CCR 1OO2-43l.This poticy addresses possible situations for [oca[ permitting of muttiple OWTS rather than
requiring site location application review and permitting through the division.
Subsequent to the review of this information, the division is amenabte to the AscendigoAutism Services site
to be permitted by the Garfietd Co. Environmentat Health Division as an OWTS with a design capacity of
2,000 gpd or less, consistent with the division's Poticy 6 for multiple OWTS on a singte property, subject to
the fottowing conditions being included in the local pubtic heatth agency's OWTS system permit:
1 . Ascendigo Autism Services sha[[ devetop and activety imptement an operating ptan to timit the
activities, customers, or other wastewatergenerating loads so as to remain within the approved
design capacity ftows to each OWTS, based on the average monthty flow at maximum occupancy.
2. The facitity must maintain reliable, accurate occupancy and water ftow metering for each OWTS
that has proposed flows of 1,250 gpd or higher; recorded on a monthly basis. Note that for sites
with significant fluctuations in daily flow, maximum month average daily ftow must only consider
days with reasonabteftow and not inctude minimatistdays in their catculations (e.g., school with

4. lf any or a combination of OWTS with overlapping zones of influence within the devetopment
exceeds an influent hydraulic load of 2,000 gpd, based on the maximum monthly average flow, the
local permit terminates, the OWTS becomes subject to the WaterQuality ControlAct, and
Ascendigo Autism Services must modify or construct a domestic wastewater treatment works
fotlowing the appticable State of Cotorado statues, regutations, and policies.
5. The Poticy 6 setback requirements must be provided on the site plan to indicate the location of
each of the proposed OWTS. This witt subsequentty provide ctear evidence of compliance with
Poticy ó. Att OWTS must meet the separation requirements of Poticy 6 or they witt be evatuated
together as a domestic wastewater treatment works and be subject to appticabte State of Colorado
statues, regulations, and poticies for site location and permitting requirements.
Recommendations:
1 . As the Base Camp buitding includes a proposed food service, the effhrent to the OWTS for this
buitding wi[[ most likety be considered high strength waste. High strength waste is referenced in
Tabte 6'4 of Regulation 43; BOD5 >300, TSS >200 FOG >50. Further, section 43.6.B.2states that,
"high strength waste must be reduced to TLI quality or lower bef ore applying to a soil treatment
areo..;'Subsequently, the design for this system may necessitatethe inctusion of a higher [eve[
treatment system that witt reduce the effluent to at least TL1 strength prior to the soil treatment
area.

Thank you for the opportunity to provide feedback on the Ascendigo Ranch Limited Impact Review
and Subdivision Vaiation [the 'Application") submitted by Ascendigo Autism Services (the
,Applicant"). This interagency referral is known as file number IAR-9156-2021- for Eagle County
recôr¿s. please officially notit/ the County should the Application be approved. Please consider the
following comments fróm the Eagle County Planning Division, Engineering, Public Health, Road and
Bridge, ùousing, and Environmental Health Departments as the Application is reviewed'
Planning Division Comments:
L The Application does not address the applicable Goals, Policies, and Recommended
Strategìôs in the Mid-Valley Area Community Plan (the "Plan"). In the future, Eagle County
"nrori"g". Garfield County to recommend that applicants for projects in areas adiacentto
Eagle Cãunty analyze conformance with the applicable Eagle County comprehensive
planning document. As part of this interagency referral, the Eagle County Planning Division
ievieweã the Application against the appropriate portions of the Plan' There are many
attributes in the Àpplication that meet the Goals, Policies, and Recommended Strategies of
the plan for the Missouri Heights Character Area. There are also many areas of concern,
nonconformance, and improvements that can be made to the Application to improve
compatibility with the Missouri Heights area. Eagle County encourages Garfield County to
"n.ú.u that the following attributes are delivered by the Applicant if the Application is
approved. Eagle County also recommends that the Application be updated to address the
aiéas of concern, nonconformance and improvement prior to being considered by GarfTeld
County.
Areas of Conformance:
a. The Summary of Considerations and Desired Outcomes for the Missouri Heights
Character area includes "discouraging future subdivisions." The Application clearly
does this by consolidating and vacating an already approved subdivision.

b. Policy 3.2.1, Recommended Strategy b: "Hncourage the continuation of ranching,
equestrian and agricultural land uses. Strive to preserve rustic buildings, fences,
irrigation structures and other features associated with ranching." This is
accomplished through the Applicant committing to preserve the Long family's
granary and chicken shed and the creation of a walking trail to access this historical
site. The Application also mentions providing access and parking for the Roaring
Fork Horse Council.
c. Policy 4.3.1: "Encourage and/or require the use of alternative energy sources,
energy efficient designs and energy efficient fixtures." The Applicant commits to
being primarily or exclusively operated on electricity, to investigating the use of
sola4 and claims to have designed buildings for passive solar energy gains. These
strategies align with the recommended strategies under Policy 4.3.1.
d. Policy 4.2.1, Recommended Strategy e: "Promote the use of approved palliatives to
reduce dusL un unpavetl ruads." The Applicanl colrrrnits to paving Lhe remainder of
Harmony Lane to reduce dust. Eagle County recommends this commitment be well
documented and required for the life of the operation to continue to reduce dust.
e. Policy 4.2.4: "Strive to protect and preserve the quality of wildlife habitat and the
vitality of wildlife populations." The Application meets many of the recommended
strategies under Policy 4.2.4 including coordination with appropriate agencies,
siting development to minimize impact, and encouraglng leash laws and
enforcement as appropriate.
f. Policy 2.1.2, Recommended Strateg¡r c: "Discourage development in areas of geologic
instability, including areas subject to swelling, subsidence, landslides, avalanche or
debris flows." The Application states no development is proposed in geohazard
areas. Should the development plan change, this analysis should be reconfirmed.
g. Poìicy 4.2.1, Recommended Strategy i: "Encorrrage efforts to manage local weecl ancl
insect infestations." The Applicant has already begun noxious weed management on
the property and commits to continued and on-going noxious weed management.
h. Policy 1.1.4, Recommended Strategy g: "Strive to separate or buffer recreational uses
from private properties where necessary." The Application discusses berms and
trees to provide screening to adjacent property owners.
Areas of Concerns. Nonconformance. and Improvements:
i. Policy 1.1.4, Recommended Strategy a AND b: "Strive to preclude new uses that
would interfere with the quiet enjoyment of residential neighborhoods in the area."
AND "Strive to preclude non-agricultural commercial activities and recreational
activities that would be incompatible with residential and agricultural uses in the
area." These policies reflecl" [he desire of Missouri Heights residents to continue the
quiet, rural, and agricultural character and uses ofthe area. The Application includes
many components that do appear to be in alignment with these characteristics
which is most likely part of why the Applicant seeks to build the operation in this
location. Howeve4 the size of the many structures, the large scale events, and the
maximum number of people that may be on site at one time do call into question the

operation's compatibility with a more rural environment. Eagle County suggests
Garfield County require a sized down operation to increase compatibility with the
Missouri Heights Character Area.
j. Policy 3.1.1,, Recommended Strategy b: "Encourage compact development that
minimizes infrastructure needs and visual impacts, and that maximizes
opportunities for connectivity and resource sharing." The Application states that
buildings will be distributed around the site as represented in the site plan, for
consistency with a rural-agricultural, low density pattern of land use. The Plan
strategy referenced above discusses the desire for compact development to preserve
open space, reduce the potential of visual impact and increase the possibility of
infrastructure resource sharing. Eagle County recommends additional visual
analysis to ensure the locale of buildings does in fact increase the rural-agricultural
feel rather than decrease the character through dispersed development. Howeve4 if
in fact the location of the buildings have been determined in concert with adjacent
property owners and such property owners are supportive as the Application
suggests on page 1,7, then Eagle County defers to those adjacent property owners as
they are the ones directly impacted by the development. The attached public
comment from Eagle County residents illustrates the importance of rural character
and therefore should be a major consideration if the Application is approved and
developed.
k. Policy 4.2.3, Recommended Strategy f: "strive to protect the quality and quantity of
ground aquifers. Refer to existing Source Water Protection Plans and implement
applicable best management strategies. Support efforts to increase awareness of
domestic source water protection issues, and encourage the development of
additional Source Water Protection Plans with assistance from the Colorado
Department of Public Health and Environment." Water source is discussed starting
on Application page 18. There is no discussion of water preservation practices or
review of exÍsting local or the creation of a new source water plan. Water availability
is of great concern in the Missouri Heights area, as illustrated by the many Eagle
County public comments regarding water availability and as discussed in the Plan'
Eagle County recommends the Application be updated to include how water will be
preserved, used in a sustainable fashion, and align with existing or an updated
source water plan,
L Policy 1.1.3, Recommended Strategy b: "Encourage the use of public roads by
mountain and road bicyclists, and support improvements that would enhance safety
for these users." Bicycle and pedestrian safety may be impacted by the increase in
traffic produced by operation. Eagle County recommends the Application be updated
to discuss how the Applicant will mitigate the impact of increased traffic on bicycle
and pedestrian safety. Public comment from Eagle County residents discusses this
concern, especially since many of the drivers will be new to the area and unfamiliar
with the roadways and users.
m. Policy 4.2.1, Recommended Strategy j: "Work to minimize the impacts of fugitive
light on natural areas and the night skyJ'The Application discusses using low scale
bollard lighting for parking areas and walkways. Bollard lighting in general is a
lesser impact to night sky; howeve¡, Eagle County recommends the Applicant add

that all lighting will tle rlark-sky compliant through the use of down câst shades.
Reducing lighting impacts will greatly enhance rural compatibility.
n. Policy 4.3.1, Recommend Stratery a: "Encouragc carpooling, a local transit collector
and other strategies that help reduce reliance on the personal automobile." The
Applicant briefly discusses the use of shuttle for the two proposed community
events per year and states 'Ascendigo commits to implement traffic-reduction
strategies to reduce peak traffic. Examples include encouraging and/or requiring
staff carpooling and incorporating shuttles during special events." Other medium
scale events are also planned such as workshops and training not to exceed 72
people at a time. Large and medium sized events present the biggest traffic impact to
the Missouri Heights roadways. Eagle County encourages Garfield County to require
shuttles to be used for a certain percentage of event participants, as well as shuttles
to be incorporated for other summer camp related activities. Carpooling should be
encouraged year round. Eagle County encourages the Applicant to update the
Application to outlinc how they will encourage stâff and clients to carpool and how
the shuttle program will operate. Increased traffic is a major concern for Eagle
County residents in Missouri Heights.
o,Policy 2,'l..7, Recommended Strategy e: "Work with involved agencies and
homeowner associations to improve the availability of water for fire suppression."
Although the Applicant states they have worked with local fire entities to
understand fire suppression needs, there is no discussion of how to ensure water
availability not'only for the Applicant's property but other properties in the area.
Fire suppression often requires collaboration between neighboring properties to
ensure safety for all. Eagle County encourages the Applicant to update the
Application to discuss how they will work with other local residents on a
comprehensive fire suppression plan that is supported by water availability. Fire
suppression and water availability is of great concern to Eagle County residents in
the Missouri Heights and Roaring Fork Fire Rescue.
2. Evacuation is not discussed in the Application. Eagle County residents as well as Roaring
Fork Fire Rescue are highly concerned about wildfire evacuation procedures due to the
intensity of the use, Eagle County recommends that Garfield County require an evacuation
plan as part of the Application.
3. As of April 27, 2021, Eagle County received 72 letters. The letters are included as
Attachment A to this referral response. The following are themes of the comment letters:
a. Traffic Impacts including increases in speeding and further dcgradation of roadways
b. LackofEvacuation Procedures
c. Concern for loss of rural character and precedence sefting fnr cnmmercial rrses in an
agricultural area
d. Water availability for everyday residential uses, irrigation and fire suppression and
how increased use will impact water availability for the entirety of Missouri Heights
e. Wildlife Impacts
f. The future resale of the property as commercial rather than residential and
agricultural
g. Large scale events
h. Support ofthe project

Engineering Department Comments:
1. The Traffic Impact Study (the "TIS"J assumes that generated traffic will use Fender Lane or
Paseo Drive/Sunset Lane to get to Harmony Lane and the project access. Fender Lane and
Paseo Drive are public roads maintained by Eagle County. Sunset Lane is a private road and
is privately maintained. Although the Applicant states that they wiìl highly discourage use of
Sunset Lane, Eagle County recommends that the Applicant enter into an agreement with the
owners of the road to share in an equitable cost, based on project generated traffic, for
maintenance of Sunset Lane.
2. Based on the TIS, if the project were located in Eagle County, the County would collect road
impact fees to pay for the new development's share of capacity improvements on Eagle
County roads. As this project only impacts State Highway 82 and Eagle County roads
including El febel Road, Upper Cattle Creek Road, Paseo Drive, and Fender Lane, Eagle
County recommends that the road impact fees collected for this project by Garfield County
be transferred to Eagle CountY.
3. As part of the proposed Erosion Control and Stormwater Management PIan, Eagle County
recommends measures for dust control, temporary stormwater detention, temporary
seeding, temporary irrigation for vegetation establishment, minimize disturbed areas, etc. to
reduce potential impact on adjacent property owners during construction and on-going
project implementation.
Public Health Comments:

increases the risk of skin cancer later in life. Skin cancer is the most common cancer in the
United States. Colorado has the Sth highest death rate from melanoma, the most deadly form
of skin cancer. A leading risk factor for skin cancer is exposure to ultraviolet rays (UV) from
the sun. Seeking shade when outside is one of the best ways to prevent overexposure to UV
rays. Since protection from UV is especially important for children and adolescents, Eagle
County Public Health recommends the use of shade in common areas like courtyards, patios,
and play areas through the planting of trees or physical share structures. It is important that
shade structures and appropriate landscaping are considered earlyin the design process so
that they can be incorporated well into the overall site plan. These considerations optimize
the opportunity for residents and visitors to shield themselves from the sun and may reduce
their risk of skin cancer. Upon review of the Application, it was unclear if shade structures
are to be built. Eagle County recommends the Applicant consider including shade structures
at strategic locations on the site plan and as part of the development, if approved.

L. Air oualitv: Colorado air quality regulations state that "Land development projects that are
greater or equal to 25 contiguous acres and/or 6 months in duration typically require an air
permit." If this Application anticipates exceeding the 25 contiguous acres over the course of
phased development, an Air Pollution Emission Notification (APEN) or Air Permit may be
required. The Applicant can find more information in CDPHE's Overview of Colorado Air
Regulations for Land Develooment and fill out the APEN anplication if necessary.
2. Drinkins water; It is unclear based on the Application and Engineering Report if the facility
evaluated their potential status as a public drinking water system based on the number of

My husband and I live in Eagle County within a mile of the proposed Ascendigo project
that is before Garfield County. Vy'e have been residents in Missouri Heights for 5 years and
enjoy the quiet, rulal neighborhood. This letter is to request that you oppose the Ascendigo's
ploposal.
Although the Ascendigo's project is in Garfield County, it will impact Eagle County
resitlents wil.h it's proposed increase in tmfüc, noise, light pollution, fire and water conceürs
along with potential of reducing property values since it is on the county line.
ln regards to increased traffic, the original proposal stùmitted by Ascendigo mentioned
450 cars then was reducecl to 250 cam along with emergency vehicles. Even though Google
Maps gives directions to the proposed site via Fendery'County Road 1021o Harmony Lane - how
many people will drive over Paseo to Sunset (a plivate road) to Harmony? And, how many of
those people will be new to the area and not respect the danger of wildlife on the roads fi'om
Highway 82 to the site?
Colorado has increased drought over the yeals affecting potential wildfires. How will a
single toad access to Ascendigo's site be condusive to evacuating the large number of people
proposed? Ascendigo has stated they will have up to 150 people at one time.
ln teading a letter to the editor in the Aspen Times fi'om the Boald of Ascendigo eariier
this week,I noted that few of the Board Members actually live in Missouri Heights. I wonder if
any of thern were evacuatecl tluring the Lake Clu'istine fue in 2018? If they were evacuated,
memories of congestion on Fender/County Road 102 will be recalled along with the stress fi.om
not knowing when we could retum and then dealing with the impact of smoke. If a fire were to
happen in the area of the Ascendigo site in the futule, I believe Eagle County resouîces would be
utilized. Another r'Ëasr,tì lur Eagle Counly to calefully consider Ascendigo's proposal and object
to it.

Due to the proximity of the Ascendigo site to Eagle County, other Eagle County
resources will be needed for road accidents, health emergencies and road maintenance. It is our
understanding that Eagle County will not receive revenue fi'om Ascendigo's project. Is it
applopriate for this project to set a precedent for other non-residential uses for Missouli Heights
that are not compatible with the t'ural environment? V/hy should Eagle County residents be
negatively impacted by an inappropriate use in a residential rural area?
I haven't reviewed Ascendigo's reports regarding water but I wonder how it will affect
our aquifer. And, if those repofis adequately address how theil water lequirements will affect
the sumounding neighbors,
Ascendigo argues that the ploposed site was approved (20 years ago) for 13 home sites
and their project will have less impact, The subdivision has not had one home developed on it to
date. 'We believe the development will have a much larger impact without any tax benefit to
Garfield County to generate frrnds to support an inappropriate use in a rural, residential
neighbolhood.
I was not able to locate anywhere in Ascendigo's application a restriction to fuifher
expansion or accountability.
I urge you to noti$ Garfield County that Ascendigo's planned project is not acceptable to
Eagle County residents, I understand that Eagle County previously denied this sort of project by
the residents speaking up and being heard. Ascendigo's mission is admirable but the location at
White Cloud is inappropriate.

I live in Aspen Mesa Estates (30 years) in Eagle County but I am writing about the Ascendigo Camp application. I am
adamently opposed for the following reasons.
1. Missouri Heights is a RURAL residential area, which is why we choose to live here. Several years ãgo there was an
application for a special events facility which was denied by Eagle County because they agreed that it was not compatible
with our rural zoning. Ascendigo does a great job for autistic kids but this location is just wrong, wrong wrong for the
following reasons.
2. lt appears to be a conflict of interest for Dan Richardson, mayor of Carbondale, to be requesting your epproval of this
eamp.
3. Although I understand that the official directions to the camp will be Fender Rd. to Harmony Lane, Google Maps will
route traffic through our subdivision via Paseo and Sunset because it is much shorter. Eventually everyone everyone at
Ascendigo will use this shortcut.
4. Extreme Fire Danger-the closest fire depaftment is in El Jebel not in Garfield County. The Garfield County Fire
Department is too far away to respond if there is a fire, and there will be a fire. That places an unreasonable burden on
the tax payers of Eagle County. We were evacuated three years ago by the Lake Christine fire and last year we were on
pre-evacuation status during the Grizzly Creek fire. Ascendigo in in a pinion and juniper forest. Fire is inevitable.
5. The Ascendigo application states there will be conferences and special events. This is the reason Eagle County
rejected the Dragonfly Ranch application. We are a rural zoned, residential community, special events and conferences

are not compatible with our zoning.
6. Ascendigo will be larger than any other Missouri Heights project with more people, cars, vans and trucks.
Constructioñ traffic, camper's busses, staff, conference attendees, ambulances, etc. will bring traffic, noise and dust to
our residential community and will add to already congested traffic on Hwy. 82, El Jebel Road and other Missouri Heights
roads.
7. Light pollution-many of us live here for the dark skies. Ascendigo will ruin this for us. They claim they will have bright
lights all night. This is unacceptable.
L Water- our water tables are dropping. Many of our neighbors with private wells are having to dig them deeper.
Ascendigo not only will bring thirsty hords of campers but THEY WANT TO BUILD A LAKE! This is unsustainable and
unacceptable.
9. Ascendigo will pay no taxes to support Eagle County roads, infrastructure and emergency services. As an Eagle
County taxpaye¡ I feelthis is unfair and unacceptable.
Please consider our position and find a more appropriate location for the good work Ascendigo does.

I and four generations of my family have lived, worked and have owned various properties in
Glenwood Springs, the greater Garficld County as well as parts of Eagle County. We love our
community and have a long and demonstrable history of public service contributing to the
welfare of our citizens and to the quality of life that draws all newcomers here. I have never
addressed the Eagle County Board of County Commissioners before, and do so now with
great humility, respect and thankfulness for your service to our citizens.
My wife and I live at 260 Harmony Ln, Carbondale, Lot 19 of Fox Run Meadows, and the
western border of our property lies in Garfield County immediately adjacent to the proposed
development by Ascendigo (LIPA 01-21-8826) as well as in Eagle County. I am writing to
present information that supports the conclusion that this application, LIPA 01-21-8826, has
been made by a large and powerful entity that has spent an enormous amount of money to
carefully craft and present documents, plans and even an Application Summary that are full of
partial truths, incomplete and misleading information all designed to sway planning and public
opinion and to get the approval to place a 24 hour per day, year-round commercial medically
based therapy facility on the view-plane ridge of an old and established residential community
in Missouri Heights. I believe that this approval would significantly harm the adjacent property
owners in both Garfield and Eagle Counties and could reduce both current and future revenue
streams from both counties as Ascendigo would be tax exempt. I respectfully request that you
please consider the information presented below and then help us by denying this proposed
land use application outright. ln sumnrary, the infonnation presented below is to supprtrt our
urging that this use be denied because:
. The true intended use of this development, as presented to us by Bob Schultz and Dan
Richardson (C.O.O.) of Ascendigo and by documents published by Ascendigo, is not as
presented in the application LIPA 01-21-8826. We believe and will share information
below indicating that the use, both as presented and as truly intended falls outside of
the citizen's and the planning department's originally intended use for this area.
. There are clear and convincing facts contained below showing that Ascendigo is other
than an "Educational Facility" (ref. Job advertisements listed at the bottom of this letter).

We shall share with you credible information supporting the assertion that this
development could disturb the aquifer from which all neighboring properties draw their
water, and from which Ascendigo intends to draw theirs.
The irrigation water that once flowed across our property and at a time when our friends
raised cattle and hay here flowed though ditches that have not been used for decades.
Just recently, a pipeline was forced through a ditch easement across our property,
without warning, to Ascendigo, yet the water still remains unused. I am not a lawyer,
but I believe these irrigation water rights have been abandoned per Colorado Water
Law.
I was told by the engineer managing this pipeline project that the idea was to put water
into a pond to replenish a falling aquifer, (not to produce crops for which the water was
originally intended). This raises the concern of the aquifer coming under the influence
of ground water and contaminating the potable water used by nearby neighborhoods.
Dan Richardson told me that the pond was desired because water was therapeutic and
soothing for people with Autism, but I cannot imagine cold muddy runoff being
enjoyable.
The irrigation water that we have available from the reservoir is only available for a
short period in the spring and in early summer (typically a few weeks in May and most
of June). But, recent dry years have cut the irrigation season short (we grow hay and
can attest to this). So, any water placed in a pond for therapy purposes will create a
mosquito breeding ground and possible West Nile virus hazard. There are currently
never any mosquitos at our property. Also, evaporative losses cannot rightfully be
offset by well water drawn from the aquifer so this stagnant pond will become an
unsightly bog quickly throughout the course of the hot dry summers here. I base this on
how quickly local retaining ponds for cattle disappear in the summer, and how rancid
they become.
My son and I were present during, and helped protect neighboring homes from the
devastating Lake Christine Fire that raged across the forested hillside just to the east of
Ascendigo. I believe that this development is in a high-wildfire danger zone that would
put the Ascendigo clients, and the nursing and support staff in great danger in the very
likely future event of future wild fires. Bob Schulz, consultant for Ascendigo, confirmed
the existence of this danger as is documented in the body of this letter below.
There are significant physical and legal issues with the roads that access the Ascendigo
property and documents and agreements presented in the application pertain only to
portions of the road that access the original subdivision (White Cloud Ridge via Wind
River Road) and ignore the portion of Harmony that crosses our property leading to the
newly proposed main entrance directly across from our home. We have not been
included in any discussions or outreach with regard to this unwanted road use. But,
Ascendigo has reached out to others.

a Per an intergovernmental agreement provided to me by Glenn Hartmann (attached
below) and between Garfield County and Eagle County; Eagle county has sole
jurisdiction for planning and use for that portion of Garfield County that lies within the
boundary of the Fox Run Meadows P.U.D., and this includes the portion of Harmony Ln
(a.k.a. Harmony Rd) that crosses our property.
For decades, the Public has used the old jeep roads that crisscross the Ascendigo
property for hiking, riding horses, walking dogs, riding bikes and other recreational
purposes unhindered. There is surely public record of this as citizens in this area have
often called both the Garfield County Sheritf's office and the Eagle County Sheriff's
office when the use has become excessive. I have received emails from neighbors
over time to this etfect. As I read Colorado Law, it seems that the Public has a
prescriptive easement for these uses on this long vacant property that cannot be denied
by the building of ponds, parking lots, and buildings that block the Public Access.
The original residentialsubdivision, White Cloud Ridge, was for 13 closely spaced lots
in the lower portion of the Ascendigo property, whereas the new proposal is for an
expansive development on the upper portion of the property causing significant issues
with traffic, noise, light pollution, view-plane impacts, soil disturbance and dust.
Based on information presented to us by Ascendigo representatives, ambulances will
routinely be called to the facility by medically trained staff and this can occur at any hour
of day or night. This hardly sounds educational, but surely sounds harmful to the
peaceful environment of Missouri Heights.
Even though Ascendigo calls the proposed facility a "summer camp", Dan Richardson
expressed atan outreach meeting held on site Monday, April 19th, thattheAscendigo
facilities and grounds would be for year-round use with intense summer use by clients,
staff and contributors alike. This truth is clear in the copies of current Ascendigo job
postings at the bottom of this letter.
Dan Richardson stated to me that our opposition to Ascendigo was an opposition to
people with Autism. My wife and I have a demonstrable history of hiring, training,
supporting and loving both autistic persons and their families. We believe this is simply
a selfish attempt to construct a sprawling commercial venture in a beautiful residential
area rather than in a location zoned for such facilities.

I hope this letter finds both you and your families well. I am writing about a matter that may be of
interest to you. Tuesday night last, Kimala and I attended a presentation by a planner named Bob
Schultz. Mr. Schultz said that he is a friend of the Aguilars, so forgive me if this is old news.
It seems that an organization named Ascendigo has under contract White Cloud and an adjoining
property to the west of Harmony and they are planning to build a camp for autistic people. Personally,
this sounds like a fine idea, but I wonder if this neighborhood is the right location for this size of
operation. The entrance to the camp would be directly below and across from the Aguilar family's
porch on the old jeep road by the cabins.
It was explained that the majority of the early stages of development would be on the upper mesa by
the green water tank. We were told that the initial stages would include a lodge for housing 24
campers, a pond for recreation, lodging accommodations for 48 staff (2 each per camper), a main lodge
for administration and dining, guest housing, facilities for maintenance staff, an activity barn, parking
lots, equestrian facilities etc.
I asked why the developnrer¡l was beirrg planned on the upper mesa instead of where the existing lots
are located below and Mr. Schultz explained that they wanted the campers located away from the rim
for wildfire reasons. I asked why a new entrance was being pla4ned across from the Aguilar family
utilizing Harmony. Mr. Schultz explained that it would not be uncommon for ambulances to be called to
the camp perhaps 4 times a week or so, and that quicker ambulance access was a driving factor. He
also said this would facilitate a fire evacuation should the need arise.
Where I work, we have autistic customers who, when startled, scream at the top of their lungs for 5 to
10 minutes at times, so I asked questions about noise, dust, and road maintenance with regard to the
increased use on Harmony etc. I also asked if water rights adjudicated for the purpose of growing
crops could rightly be used for a recreation pond. I did not ask questions about light pollution, but I
suspect that is a lupiu of corrcerrr for David. Finally, I asked if Garfield County approved this camp,
could it be enlarged in the future and sold to another camping organization (such as the Boy Scouts). I
was told that it could, but that was not Ascendigo's intent.
Mr. Schultz explained that he and the Ascendigo development team have been working with the head
of the Garfield Country Planning Department, Glen Hartman, and states that this is not a commercial
use and that it is consistent with the zoning for these properties.

Friday, August 28,2020; Dan Richardson joined me at my house at 260 Harmony Lane for lunch and to
discuss the Ascendigo project, He came right on time at 12:00 noon. We sat out on the patio so he
could enjoy the view and the peaceful quiet, and thus learn first-hand what Ascendigo's project would
do to the neighborhood. The following bullet points are the outline of my thoughts for discussion of
which a copy was given to Dan. Following the outline I have recorded in detail many of the topics
discussed over a period of approximately 2 hours. lt is now 2:37 pm, so I am recording what was said
having a fresh and recent recollection.

At lunch, I asked Dan how he came to be associated with Ascendigo, and he told me about his former work with
SGM, how that went, and then how he became interested in doing something else with his life. Dan became
aware of Ascendigo after they purchased and developed property in Carbondale where he is mayor. At one
point he reached out to the founder and was hired for a new position as CEO. Dan had no experience with
autism, but was being paid several hundred thousand dollars a year - presumably because of his political
connections in the area. Dan has two children, the oldest of which is L7, and he has roots in Glenwood Springs,
but again, he did not report any family with autism. The founder has a son with autism, at least 37 years of age
per Dan, that inspired her to create Ascendigo. Dan indicated that Ascendigo has faced opposition to
development because people do not understand and therefore do not want autistic people living near them' I
shared with Dan that my wife Kimala had hired and managed a severely aut¡stic employee for years that she
taught to do all of her filing in a large commercial insurance team under her leadership. She loved the young
man and made a concerted effort to care for him and to develop a strong relationship with his mother as well. I
shared similar experiences of my own and made it clear that we have no opposition to Ascendigo nor to people
with autism. I let Dan know that there is strong opposition to the proposed project at White Cloud from many
perspectives because the envisioned use at this particular location is not a good fit, but this has nothing to do
with Autism from what I know.
I shared with Dan my long personal family history in this Roaring Fork valley from the Days when there were
roundups, cattle ranches, massive flocks of sheep and potato farming. I explained how "down zoning" had hurt
many of my family and friends and how I had worked all my life before being finally able to purchase a small
property where I could enjoy the peace and quiet that the majority of the valley lost long ago. The point was
made that the locals know all too well how people with extreme wealth are able to hire planners and lawyers
and staff to use properties in the valley in a way that locals could not. So, my personal opposition to the
Ascendigo Camp was from many perspectives, but also from a sense of justice. Dan said that he was in a difficult
position because he fully understands how this hurts me personally, but that he also has "a job to do".
Dan explained that people may be in opposit¡on to this project because they are imagining it to be something
that it is not. I suggested that the people in this neighborhood are very well educated and quite sophisticated
and that they have taken it upon themselves to discover exactly what this corporation is about. I pointed out
that Ascendigo is presenting this as a "summer camp" based on comments made to me and others by Bob
Schultz, and Dan himself, during lunch today. He agreed with me and admitted that this was a year-round
operation and then tried to explain why they call it a summer camp, but the explanation was lost on me. I then
pointed out that their site drawings and records from their preliminary meeting with Garfield County indicated
the sledding hill and skiing amenity. Dan then made the point that their plans were preliminary and that they
were being "good neighbors" by reaching out to us months in advance to see how they could dovetailthis plan
into the community. At that point, I explained to Dan that I am fully in favor of an organization like this that
provides wonderful therapy, but not in a residential area. I explained that there was no use in attempting to
spin the proposalto us as my family and I and many others are firmly aga¡nst it based on the facts presented.
So, I started back down my list of reasons why Ascendigo shouldn't buy the land and build here and explained
that I had been told that the aquifer under the Ascendigo project was dropping and that Michael from Resource
Engineering had told me that the Levitt pipe and porrd had been put in to help replenish the aquifer. I further
explained that if this were true, there were concerns that this would place the Antonid¡es well under the
influence of surface ground water. I forgot to mention that the pond, if used for swimming could, could
introduce fecal matter to that water flowing down to the aquifer. Next, the discussion turned to pond liners
(clay or EPDM) and that these could limit the amount of pond water seeping into the ground, but such liners can
make getting out the water difficult for wildlife and even children and that a tragic drowning could result.
Next, regarding potable water, the discussion turned to electrolytic soils and I asked about the integrity of the
old water tank. Dan stated that the tank had been inspected from the interior. We went on to discuss proper
tank foundat¡ons and drainage to help prevent corrosion from eating out the steel tank bottom from below. I
suggested that they get an Olympus ultrasonic non-destructive-testing instrument to measure the bottom
thicknessascorrosioncanbeoutofsight. lalsodiscussedhowthesoilsandmaterialscanleadtodestructionof
infrastructure and that they may want to excäväte and perform the same testing on pipes. I explained that
many firms had examined the aquifer in the 2013 time frame; but that I had seen recent graphs of the two well
levels in our subdivision and that the recovery from dry years was slow to recover than in the past and indicated
to that the aquifer was becoming inelastic.
Dan and I sat and talked for hours about how the parking lot lights would diminish the viewing of the nighttime
sky for everyone, especially the Augilars who have an observatory right across the road. We discussed the
impacts on wildlife migration, and the large populations of mountain lions that have killed a great many
livestock up here (most recently 4 lamas at the Someday Ranch just above Ascendigo).
Ascendigo is planning to put in a "single story" gymnasium that is actLrally a 52 foot high structure that will perch
right in the view of so many people who have bu¡lt their homes here just for the view. ln Eagle County there is a
"Ridgeline Preservation" ordinance that we had to abide by, but I was told there is no such ordinance in Garfield.
We talked about our harrowing experiences during the Lake Christine Fire and how the fire cut off the power
rendering all of our fire hydrants useless.
Finally, I explained that nobody is responsible for maintaining the road across my land and that I have to
maintain it myself with my backhoe when Joe Edwards is not up to it. The winds drift snows across Harmony Ln
severalfeet deep, and this would certainly impede ambulance access. This sometimes happens within an hour
of my having plowed the road. I told Dan that I didn't think it right to expect to have a hundred people a day
drive across my land.
ln the end, I begged Dan to buy land elsewhere, and he again said, "sotry,l have to do what I have to do".
Footnote: Ascendago subsequently purchased the land and set about putting old studies and other documents
into their application that put a "spin" on these matters. They have met with others on Harmony Ln and those
people have told my wife that "this is our chance to force Garfield County to accept and maintain our road". I
was not invited and Dan has neverspoken to me since.

Beiow are some of the recent job postings for Ascendigo"s "Summer Camp'. Piease note that these postings
refer to "Clients" not campers. These jobs are for people with special medical and therapy skills, not for a small
educational facility. The actual number of employees and others to be at this facility is shocking and far beyond
that portrayed by Ascendigo in the land use applications. These postings specifically state that operations are
year-round, not Just a summer camp. Please note the many references to certifications for therapy and medical

Program Staff Requirements: Program staff, which includes all staff with direct client contact, will
work under the direction of Ascendigo management as well as both our in-house and consultine
behavioral health professionals. We expect our staff to create and maintain a positive learnìng
environment and to prioritize the health, safety and comfort of our participants - use good judgment
and ask for help when needed. Program staff will be asked to attend several staff meetings each
week and to be available to Ascendigo management for ongoing discussions and feedback. We ask
the program staff to maintain open lines of communication with parents and families. In many ways,
you are in the guest services business and this means the highest level of guest service and

Job Summary:
The Reqistered Nurse (RN) will report to the Adventures Director and Co-Director. The RN will
provide services in a day camp setting to both participants and staff. The RN role will be to act as
liaison between campers. parents. staff" and doctors/nurses.
Salary range is based on relevant experience, education, years at Ascendigo, relevant certifications,
and availability. Starting Salary is $750/week.

Job Summary: Outreach RBT's (Registered Behavioral Therapists) support the program in improving
the lives of individual clients through the application of Ascendigo's Natural Developmental

Behavior Analysis (ABA), and developmental principles based on the Ascendigo Way Curriculum.
RBT's provide services to clients age 9 months to l7 years old using NDBI and other competencies as
directed by Outreach management and clinical services oversight.

Clinical basis: Ascendigo, welcomes people ages 5 and up with Autism Spectrum Disorder,
including classic Autism, Pervasive Developmental Disorder, Not Otherwise Specified (PDD-NOS),
Asperger's and related diagnoses. Our skills trainers and sports specialists use positive
reinforcement across our behavioral services, educational, and sports programming based on a
clinical modality based on the Denver model - a Naturalistic Development Behavioral Intervention.
Clinical services, oversight and ongoing staff training are under the auspices renowned autism
expert Diane Osaki and her group, as well as our in-house Board-Certified Behavioral Analyst.
Adventure Camps: Participants of any athletic ability can succeed. We pride ourselves in ensuring
progress in our sports while having lots of fun. Current sports and outdoor programming include
summer, fall and winter camps and individualized services. We continually seek to expand our
offerings. Camp activities include hiking, climbing, river rafting, lake & boating sports, biking
(mountain & road), horseback riding - as well as winter skiing and snowboarding at
Aspen/Snowmass.
Behavioral Intervention Services: Community integration and behavioral health activities include
our Adult Enrichment programs serving the RF valley out of Carbondale, and upcoming programing
for school age children.

fire and water concerns, but the Eagle County municipal seru¡ces will be called upon given the proxim¡ty to the
property, It's right on the county line. From road accidents to fire and health emergencies, and even maintenance of
our road infrastructure, this project brings significant increased activity and vehicles - and there is no revenue
coming with it to mitigate costs associated with those issues. This is not simply a Garfield County matter. It will be
an Eagle County problem and those of us who live in Missouri Heights do not want this.
The potential drain on our water is also of great concern. We seem to be facing more and more drought every year.
We are seeing the effects of climate change. And imagine the evacuation of 100 people, including children and
animals from that single road access point should we have another fire. The alternative subdivision of homes would
be developed over time and would bring fewer impacts and is much more compatible with the location.
I am very concerned about the change in character to our rural, quiet area and believe this would open the door to
future commercial endeavors. This was tried once before in Eagle Gounty and rejected for similar reasons.
We all support Ascendigo's work and their mission, but building it in this specific location is not appropriate nor is it
safe. Please do what you can to encourage Garfield County to reject this application.

I lived in Missouri Heights for over 16 years and do not support the Ascendigo project for Missouri
Heights which is a residential area with limited water and high fire danger. My house went through
the Panarama fire in 2002. So I know the fire danger well.
Ascendigo does good work but Missouri Heights is not a good place for it.

open fields, agricultural operations and large lot single-family residences. The only rural thing about this
application is the Horses and even that aspect is concerning as that is purely recreational use of the animals that
will be transported to and fiom there. That is not educational.
This intensive land use of the development (yes, after reviewing the proposal I would say intensive and
cornmercial for this area) is not compatible with the current existing. rural development pattem and land use.
The non-residential nature of the proposed use will result in atrsolute increased trafüc use, noise, light, water and
wastewater impacts. Dan Richardson has told us there would be approxim ately 476 daily trafiìc trips to and
from this Camp. Currently we canuot cross Fender lane to retrieve our mail without concern of being struck by a
vehicle. And walking our leashed Dogs or assisting our daughter along Fender Lane? Can I sav SCARY AF?
And Dan said weekly estimated Monday 1O0-person drop offs /welcome gathering and Friday 1O0-person
pickup /goodbye banquets requiring intense franspol{ation, catering, tbod deliveries, waste management etc? I
am told that a Monday drop offwould be all day and then a Friday pickup and party is all day and then a
weekend flunry of cleaninel sanitizing,llaundry /trash out / maintenancel incoming prearrival preparations not to
mention daily weekly coming and going of a multitude of contractors seryicing everything fronl A to Z. And
Medical sewices. Curent Roads to access the site are dirt, private and residential in nature. Limited access is
now permitted to existing and proposed residences. The proposed site is a wildlife coridor. The proposed site is
also in the "Very High" category of Garfield Counfy's Wild{ire Susceptibilifv Inclex. We were evacuated fiom
our home during Lake Christine fir'e and fwo years later we were on the pre-evac for Grizzly Creek fire.
It huly bemoans one to compassionately ask: Seriously? A Camp? Up here? A development like this has been
proposed before in greater Missouri Heights and thank goodness our elected officials have recognized. "Not
appropriate". We are concerned tliat better venues and propefties with preexisting land use zoning have not been
considered when they acquired this plnperty to seek approval. If the land is zoned for this type of development
as proponents have said it is why hasn't there been an embrace of it? Wb do expect zoning authorities will
permit only compatible uses with the existing character of adiacent and curent land uses. This proposal is
opposite to what we, as residents of Eagle and bordering Garfield county expect from zoning and representative
ofTìcials.

I hope this email finds you all well. I recently found out about an application by Ascendigo Land Holdings submitted to Garfield
County BOCC to develop commercially in a residential area just above where I live in Missouri Heights in Carbondale' Though
this development is is proposed for Garfield County, it will greatly affect those of us in Eagle County. My main concem is for this
development is the likely environmental impact it will have, specifically conceming water and the added strain this will pose on an
already scarce resource.
Missouri Heights is home to many people, ranchers, farmers, and wildlife-we all need water. Every few years, my family and I
dig our wells deeper to get enough water to supply water to our fields and livestock. My neighbors have to do the same.
Additionall¡ over the past two years people have been evacuated due to wildfires-in part due to the cuffent drought conditions
most of Colorado is facing. This is not even accounting for the impact it will have on wildlife. Missouri Heights is adjacent to
Basalt Mountain and we share the resources with the wildlife.
Please take the time and oppose this development and place maximum pressure on Garfield County to seek input from the
adjoining Eagle County as outlined in the Mid Valley Comprehensive Area Plan as this proposed development will put much more
strain on our already little water resources. Ascendigo is a worthy organization, but I do not support the proposed development.

Pursuent to my discussions with Glenn Hertmann, I am submitting this letter to confirm my
opÞosit¡on to the Ascendþo Ranch proposed development in Mlssourl Heights.
I am a resident of Missouri Heights and have been for over 33 years. Most of us who live in
Missouri Heights live here for the peace and quiet and rural character the area provides and its distance
from congestion and the masses. The rural character of the area and way of life (including water supply)
will be threatened if this proposal is approved and it will set a dangerous precedent for
overdevelopment in the area.
After review of Ascendigo's Application materials, I have major concerns about the development
and its lmpact on the Missouri Heights area where it ¡s proposed. I believe Ascendigo's Application fails
to meet the Land Use standards in several important respects. My concerns are many and include, but
are not limited to, the magnitude of the development and proposed further expansion, its
incompatibility with the rural land and character of the area, the increase ¡n traff¡c and noise, increased
taxing of water supplies and roads, and fire danger.
Masnitude of Develooment and Proposed Further Exoansion
and lncompatibiliW with the Rural Land and Character
First let me say that I was very disappointed when a representative of Ascendigo was asked
recently about their "educational training curriculum," which I assume is to support their Application as
an Educational Facility. The final Application materials say'lscendigo does indeed have a published
educational training curriculum." The questions asked were: What is the date of that document and
where can it be found? We were told that the information was proprietary and not available to the
public. I can't understand why they would not want to share that document, especially if that is the
basis for their submittal. That is key information when looking at their Application.
The magnitude of the proposed development ¡s not "aligned with other community services" it
lists In our viclnlty (Strang Ranch, Windwalkers, Missouri Heights Schoolhouse). The impact of the
current activitíes listed for these 3 entities all combined is not even close to the activities that are
proposed on the Ascendigo property.

I have no objection to the goals of Ascendigo to help youth and adults across the autism
spectrum and I appfaud their efforts. However, the Missouri Heights area where this development is
proposed is not the proper place to add the extent of almost year-round uses they propose and
"related" uses for the Ranch, such as ovemight accommodatlon rentals to "family and frlends" of
Ascendlgo and lodging for outside/corporate guests, fundraislng activlties, etc.
This development will have a huge impact on the area as far as the number of people proposed
to be coming and going from the property and staying on the propefi when you are talking about a
Base Camp, Camper Lodge, Staff Lodge, Activity Barn, Caretaker Dwelling, Caretaker ADU and Guest
Cabin ("primary buildingd' of up to 45,500 sq. ft. according to their Limited lmpact Review and
Subdivision Vacation document), AND addltlonal 'hccessory structures" for maintenance and storage, a
hay barn, horse and goat barns, an equestrian tack/office, and loaflng sheds on the property and for
other proposed "actlvltlês." Thê proposed development is not compatible with their single-family rural
residential neighbors in size, scale or use,
ln the¡r documents, Ascendigo and their consultants make numerous comparisons to what was
approved and what they propose, but those comparisons are not relevant, especially when the Final Plat
for Whitecloud Ridge was recorded on October 20, !QQQ, over 20 vears aro. And lT WAS NEVER
DEVELOPED. Things have changed considerably during that time and, as the Comprehensive Plan states,
"Beceuse condltlons change over tlme, ¡t ¡s ¡mportant for the county to revlslt and update...." That is
certainly true when comparing 2000 to 2021. There should be no comparing Ascendigo's proposed
development to what was proposed over 20 years ago; it should be looked at by what is there today.
ln their Application materials, Ascendigo also indicates that buildout could tak6 "reveral years or
more äs lt ls dependent on addltlonal fundralsing." With net fundraising income, as reported in their
publicly disclosed tax returns for 2Ot7 of 533,134; 2018 of 566,5ZO; and 2019 of 573,431, that could
take a very long time.
lncrease in Traffic and Noise
ln their most recent traffic study, "Trips per dat/' o1210 should be compared to what the vehicle
tr¡ps are from the property today (0), not what was proposed for a subdivision that was nev€r
developed. lt appears that the additional trips will double those that are present today. The increase in
noise associated with these additional vehicle trips will seriously diminish the quality of life for everyone
in the area. And with construction of "several years or more", the traffic and noise will be even greater.
On any given day at my home, you can hear a long way. On some days, it is so quiet that you
can hear the traffic on Highway 82 during peak travel times. lf we can hear that noise, you can imagine
how much will be heard during activities that are even closer that are planned for "up to 150" people,
lncreased Taxing of Water Supplies
Of major importance is the additional stress the development's impact will have on the water
supplies (both drinking water and irrigation water) in the area. We have had experiences over the last
several years where, each year, there is less water available for irrigation. Last summer, during our
irrigation water call, there was only aboutZYz weeks available for watering for our subdivision. Add to

that the lack of water pressure, low water alerts, and the production from water wells dropping, all
related to drinking water, the magnitude of the Ascendigo proposal will only negatively affect the
available weter supplies. And with the drought conditions throughout Colorado, the strain on the water
supplies will only cont¡nue to become greater. Ascendigo's plans for ponds and such a large daily
population will negatively affect those water supplies. The fact that the water supply might have been
adequate back in 2000 does not mean that it will be adequate with the huge development they propose.
Homeowners in the area indicated that when the pond was being constructed on the propefi a
few years ago, employees working on the project indicated the reason for the pond construction was
that the production from the water wells was dropping and there was concern that the water supply
would become ínadequate ¡f the trend continued. The pond was being constructed for the water to
seep into the ground and help recharge the groundwater supply and increase the well production.
Filling the ponds from the wells would further decrease the well supply and it could only be
filled with irrigation water during certa¡n weeks in the summer. Ascendigo has plans to fill 3 ponds on
the propefi, including for recreational uses, and there may be plans to line at least one of the ponds,
which would not help the level of the water wells from dropping, but would have the opposite effect.
Our concerns with water supplies are only exacerbated by these plans.
Homeowners have told of the problems with both irrigation and drinking water in the area of
this proposed development. lf there was just one issue that could be of major concern, the water
situation is it, Please do not approve overuse of our limlted water supply. There must be
accountability and protection of the resources or someday there will be no more.
lncreased Taxine of Roads
On a recent, very slow drive down Harmony Lane from 102 Road, you can see that the road is in
terrible disrepair, w¡th ruts and holes everywhere. lt is apparent that the chip and seal that Ascendigo is
proposing for that road will have to be redone, maybe several times, to handle the increase in traffic and
especially with construct¡on traff¡c through a buildout that they describe as "several years or more." lt is
my understanding and I believe you have received notice that the residents of Sunset (private road)
intend to close their road to Harmony Lane. With Harmony being the only way out for those who live
along it, it points to the increase in danger for those individuals during evacuation in the case of wildfire,
especially if there are "up to 150" people on the Ascendigo property at any one t¡me.
Fire Daneer
During the 2018 Lake Christine Fire, for those of us who were evacuated here in Missouri
Heights, it was a very scary, chaotic and stressful event, with traffic on Fender Lane coming across 102
Road and down Catherine Store Road after the fire came down the ridge into ElJebel (as the El Jebel
Road was closed), and it was a steady streäm of traffic, including not only passenger vehicles, but also
trucks, trailers hauling animals, etc. We are all very grateful that, thanks to the alert systems and the
quick action of the fire and other emergency personnel, wíth the exception of 3 homes, we survived that
incident. The experience is something that sticks with you for the rest of your life. The fire danger is
very high for our area and, if you add another "up to 150" people to an evacuation mix, that's significant
and causes great concern.

On April 9, 2027, we experienced a wildfire in neighbor¡ng St¡rl¡ng Ranch during a very windy
afternoon in Missouri Heights. Thanks to the prompt act¡on of fire personnel, it was quickly under
control, but brought up memories of the Lake Christine fire and proved that we have a very long fire
season ahead. The fact that during fire season, we have very high winds in Missouri Heights, which can
make a fire even more unpredictable, and wlth the drought conditions in all of Colorado, these factors
only add to concerns about placement of so many people in one place at one time.
ln Summarv
There was a recent statement in one of our local papers, with regard to development in the
Roaring Fork Valley, say¡ng that "the r¡ghts of a brand new bus¡ness should not þe allowed to supersede
the rights of residents in the area" and this certainly applles ln the case of this proposed development.
There are experts who are weighlng ln on both sides of this issue, which will be of importance,
but I encourage you to also listen to and take ¡nto account the personal experiences of homeowners in
this area, 8s we arê the ones who have been living here (and many of us for many years).
The proposed Ascendigo development does not comply with Sections 7-103 (COMPATIB¡uTY},
7-104 (SOURCE OF WATERI andT-tO7 (ACCESS AND ROADWAYS) of the Garfield County lend Use and
Development Code, and it does not comply with the Garfield County Comprehenslve Plan 2030, which,
among other things, is said to strive to preserve the rural land and character of Garfield County.
Therefore, I would encourage the Board of County Commissioners to DENY the Ascendigo
development as proposed.

The recently proposed Ascendigo Development is certainly a worthy cause but threatens the future
and well-being of residents living in Missouri Heights, With the growing threat of wildfires in
Western Colorado, already taxed water resources in Missouri Heights could easily become over-
stressed by this open-ended commercial development. The impact of adding an additional450+ cars
a day onto Harmony Lane, the only dirt and gravel road via Fender Lane leading to and from the
camp, is another maior warning sign this project is ill-suited for its current proposed location.
As a Missouri Heights resident and landowner for the past fifteen years, I recognize we live in a very
peculiar and dangerous micro-climate where sustained winds can gust from early spring through the
end of fall, sometimes reaching 60 miles per hour. Any wildfire occuring up here would be
unstoppable wrecking untold damage to the Ascendigo Camp, surrounding homeovrmers, nearby
communities and especially any young autistic kids caught in a raging inferno. Firefighters reported
the wildfires north of Boulder last Fall consumed areas the size of three football fields every minute.
With the Wind River easement access and private Sunset Lane access closed to Ascendigo usage, the
only egress to and from the campsite along Harmony Lane could be cut off by fire creating a recipe
for disaster.

being taught, That qualification is missing for a very good legal reason. Ascendigo is not an
established Autism/Spectrum educational organization recognized or affiliated with other linked
professional state or federal autism organizations. They do not employ credentialed educators
conducting approved curriculum-based educational services. Instead, they promote their oum home-
grown "enrichment experiences"which in toclay's world coulcl mean practically anything.
In reality, WHAT Ascendigo IS is exactly what Ascendigo SAYS it is: A non-profit, future-
expanding corporate enterprise offering adventure camping and life enrichment services while
hosting conferences, massive fundraising events while housing and feeding year-round staff
and visitors. They are no! in any legal sense, nor do they advertise in any way, a licensed, accredited,
establislled educalir:ttal olgattizatiun pluvitling, ¿rppr'ovetl Lherapy proB,r'anrs [or Lhose on Lhe
spectrum.
For all the above reasons, this application of Ascendigo Autism Services to build a 50,000
squâre font sprawling firtrrre-expansive corporate facility with a fifty-five foot tall recreation
center in the middle of Missouri Heights should be denied. This organization belongs on the
valley floor where paved county roads permit safe and rapid access for emergency responders, the
removal from the harm from high-wind wildfire threat and the access to plentiful water supplies that
are readily available there. Thankyou for considering this letter. Please keep historic Missouri
Heights out of thc vallcy floor commcrcial development crush. It maintains today such a wonderful

siting a commercial development in a zoned residential rural setting.
All issues are valid arguments for a Garfield County rejection but what concerns me the most is the issue of
water. The groundwater system is extremely fragile at their location and in the surrounding area and for
Ascendigo tı propose this scale of development shows a complete lack of understanding of our Missouri
Heights aquifer.
To put water in context I need to briefly explain the geology of the Missouri Heights groundqater system.
The vast majority of water wells on Missouri Heights lap a 200-300 foot volcanics_ layer that forms. a caprock
on our escarpment. Water exists in the lower 100' of this volcanics layer. Wells flow nicely from the

volcan¡cs and, with the rural density of development, groundwater is abundant for household needs. This
situation changes though on the southern edge of our escarpment, where Ascendigo is proposing
clevelopment. Geology clranges" First, the capping volcanics layer thins significantly to the Ëouth ãnd
becomes water barren at the escarpment edge. The water table, which closely follows topography, also
divee lower and the underlying Eagle Valley formation thcn bocomes the water reservoir. Unfortunately this
is a bad situation for water well drilling.
People in Eagle County are very familiar with the Eagle Valley formation. Thousands of feet thick of shale,
limestones, gypsum and salt. lt outcrops up and down both the Roaring Fork and Eagle river valleys. They
mine it for gypsum at Gypsum (hence the town's name). Put it next to water, like on the Roaring Fork valley
floo¡ and the gypsum and salt layers dissolve and you have engineering (sinkhole) problems. Because of
the low permeability of the rock (it's mostly shale) groundwater doesn't flow easily and water wells that tap
this formation as a source are generally marginal. They exhibit a multitude of flow issLles, take longer time
to recover after drawdowns, have silting problems, etc. Wells that have had flow problems (or have run dry)
in the past on Missouri Heights are all on this southern escarpment edge. This is the geology of the Eagle
Valley formation on Missouri Heights as a water source - iffy at best.
Neighbors are rightfully concerned that Ascendigo's plans are out of scale with the surrounding
devefopment. Ascendigo is proposing a project that will have 8-10 times the water needs of surrounding
residential neighborhood. Since groundwater recharge to the Missouri Heights aquifer is dependent on
precipitation, recltarge will be slow - even slower with a changing climate. Addltlonally, because of the
location of their property on the escarpment edge you will be dealing with an effective T. circle drainage
area (no reservoir to the south to drain so the water must come from lands to the north and east).
Ascendigo's water neêds wlll be locally lowering the water table - in effect creating a water sink and
neighbors to the north and east will be greatly affected.
Creating this water sink prnhahly won't happen immediately, but with slow recharge (the nature of the water-
bearing formation) and excessive draw (20x times typical residential development) it will happen. The
Eagle Valley formation is a fragile groundwater aquifer just not capable of sustaining long{erm water
withdrawals of this quantity without problems.
This is not about Ascendigo's work and mission, which is admirable and I believe all Missouri Heights
residents support. This is about siting a commercial development in a residential neighborhood, that is
challenged forwate¡ on a scale in excess of that of the surrounding community. This is not simply a
Garfield County problem. lt is also an Eagle County problem. Jeanne, please assist our Missouri Heights
neighborhood in doing allyou can in convincing Garfield County officials to deny this application.

I moved to Missouri Heights, a year ago, after 50 years in Aspen. I truly love the rural, quiet
feeling that makes this neighborhood so special. While I 100% support the mission of Ascendigo,
l'm very concerned about having it's campus up here. ( I live on Green Meadow Road, which is
across Fender, from Harmony Lane.)
1: There are serious water concerns here, which have only been exacerbated by the ongoing
drought, and a year round camp, with a pond(!!), hay fields, and all the demands of a full service
residéntial facility for around 100 'guests', is much more than the 13 homes that this property has
been zoned for, would use. lt's much more than our stressed water table can bear.
2: ¡¡raflic. Ascendigo has said that there would be 450 vehicle trips per day, on peak days. I think
that they've since reduced that to 250+. Either way would tax these rural roads beyond bearing, not
to mention adding to the bottle neck that already exists, at some times of day, at the El Jebel light. I
didn't live here during the Lake Christine fire, but my neighbors have told me that evacuating took
hours, due to the limited road capacity, horse trailers, etc. This is a fire prone area. I was here for
the Grizzly Creek fire last summer, and it was alarming. The number of occupants of this camp, if a
fire should hit, would only make this much more dangerous'
3: l'm very concerned about the precedent that this development would create. lf it is allowed,
will that open the flood gates for more commercial developments up here? That frankly terrifies me,
for all the above reasons, and because I love the peace , and quiet, and dark nights, of my new
home.
4: I 3 homes would pay taxes. Ascendigo is a non profit, and as such has applied for an
exemption from property taxes-or at least has applied for this exemption. This is quite a loss of
revenue for Garfield County.
I am certain that Ascendigo would be better served by a property on the valley floor, out of the
wind, with easy access to water, emergency services, and evacuation routes. This is a great
program, and I do hope that they find such a property. Missouri Heights just isn't it.

I am an Eagle County, Missouri Heights resident, and have enjoyed living here for over 10 years.
I am disturbed after reading several recent newspaper articles (Aspen Times, Aspen Daily News)
describing a proposed development near my home in Missouri Heights for an "educational
campus" - the Ascendigo Whitecloud/Harmony Heights Ranch.
According to their website, as an "educational use" development Ascendigo's proposal envisions
a sprawliñ g 126 acre campus set in the middle of our rural, residential community. Because of
its íocation at the Garfield/Eagle County border, existing residents in both Eagle and Garfield
counties will experience negative impact from this development.
Ascendigo's website describes "minimal" traffic impacts through our neighborhood from Highway
82 to their campus. The website touts a "five minute drive" to the campus from Highway 82in
Eagle County, via El Jebel Road to Upper Cattle Creek Road; a left turn onto Fender Lane
thróugh a residential neighborhood, to the campus located in Garfield County at Harmony Lane.
How, "with minimal impact" willfood and supplies be transported to the campus, which will serve
and house campers, staff, and ancillary service personnel on a daily basis - will this be achieved
using large U.S. Foods and Sysco delivery trucks through our neighborhood?

"Minimal" traffic impact is not defined by the website's definition of "student and staft shuttle¡", or
up to 150 people travelling via Upper Cattle Creek to and from the ranch site for regular
fundraisers! Does Eagle County plan to conduct an independent traffic study?
By allowing development of a not for profit, sprawling câmpus in an established rural residentialI neighborhood, approval of this development by Garfield County will negatively impact alt of us
who are residents, pay taxes for services (roads, fire), and actually live in Missouri Heights.
A May 10 site visit is tentatively scheduled. ln the best interest of those of us from of Eagle
County who live near, and will be directly impacted by this project, I think commissioners and
staff from Eagle County should be present to represent Eagle County residents. Missouri Heights
is not an appropriate location for a school campus, and I urge Eagle County commissioners to
support your constituents and oppose this development.

Dear Eagle County Officials,
We are writing to encourage you to oppose the Ascendigo proposal on Missouri Heights.
While we recognize that this property is in Garfield County and the planning department there will
make the decision, Eagle County will be negatively impacted. Not only will residents be affected
by traffic, noise, light pollution and fire and water concerns, but Eagle County municipal services
will be called upon given the proximity to the property. lt's right on the county line. From road
accldents to fire and health emergencies, and even maintenance of road infrastructure, this project
brings significant increased activity and vehicles, and there is no revenue coming with it to mitigate
costé asèociated with those issues. This is not simply a Garfield County problem and those of us
who live in Missouri Heights do not want this.
The potential drain on our water is also of great concern. And imagine the evacuation of 100
people, including children and animals from that single road access point should we have another
fire. The alternative subdivision of homes would be developed over time and would bring fewer
impacts and is much more compatible with the location.
We are very concerned about the change in character to our rural, quiet area and believe this
would open the door to future commercial endeavors. This was tr¡ed once before in Eagle County

and rejected for similar reasons.
We all support Ascendigo's work and their mission, but building it in this specific location is not
appropriate nor is it safe. Please do what you can to encourage Garfield County to reject this
application.

We have become aware of the controversy over the proposed Ascendigo development and wish
to register our support for this project as proposed in the Missouri Heights area of Garfield
County.
Through our connections Ín Colorado, we have become increasingly aware of the benefits that
Ascendigo has brought to the quality of life for people living with autism and related condit¡ons.
We also have first-hand knowledge of the Houston Center for Pursuit which was located in the
heart of Houston on the edge of River Oaks until it moved to larger premises a few miles away.
The environmental related arguments against this project seem rather lame when compared to
the size of the residentialfootprints that many have established in that area. ln a society where
it is becoming increasingly divisive, which we find very sad, why would people living with a
disability such as autism, be denied the opportunity to thrive in a rural setting? We are confident
that the management team at Ascendigo are socially and environmentally conscious, thus
addressing other concerns such as water supply.
ln closing, as residents of the Roaring Fork Valley, we sincerely request your support of the
Ascendigo limited impact review and the development of the Ascendigo Ranch project.

Dear Morgan,
Please think about the consequences of allowing Ascendigo to build its infrastructure in Missouri Heights. I encourage
you to oppose this proposition. Missouri Heights is a rural community, many of us are farmers and ranchers who rely on
the already scarce resource of water for our livelihoods. lf Ascendigo goes forward with their plans, the water use of their
infrastructure will be an added strain to this priceless resource. The traffic of both cars and people, as well as 24t7
lighting, will further stress the vulnerable wildlife populations. Allowing a commercial building to be built in Missouri
Heights would begin the destruction of our rural farms, ranches, and way of life.
Ascendigo has a noble mission. Their organization blesses and brings light and hope to many people, young and old. We
are not opposed to Ascendigo, only their plan to build commercially in Missouri Heights.
