As you know, we have been working to obtain signatures of all owners and executed consents from all lenders on the
above-referenced Amended plat, which revises one plat note to transfer an ADU right from Lot 6 to Lot 2' we finally
obtainedthesignedconsentofwellsFargo(afterfivemonths),onlytolearnthatLotghadsold. weareintheprocess
of obtaining the consent from the new owner of Lot 9, and will add a signature block for them to the mylar as soon as
weareable. lntheinterim,wewouldliketorecordthefullyexecutedPlattoputfuturepurchasersonnot¡ceofthe
amended plat Note. As you may recall, our client owns both Lots 2 and 6, which are the lots directly impacted. Lot 9 is
not adjacent to either of these Lots and the new owners received notice of this matter in connection with the¡r due
diligence via the HOA documents.

As you know, we have been working to obtain signatures of all owners and executed consents from all lenders on the

This letter is in response to several items the County has requested to complete the above-
referenced application. In supplement to the application, I address each item in tum below.
l. An authorization letter signed by the owners of all 9 lots in Roaring Fork Preserve
and confirming consent to submit this application is enclosed herewith Exhibit 1.
2. Mineral Rights Research. With respect to owners of the mineral estate for the lots
in Roaring Fork Preserve, the undersigned has conducted research with respect to the mineral
estate and states the following:
a. In connection with the original subdivision application for Roaring Fork Preserve,
a letter from an attomey was submitted which stated that after review of the title
work for the property comprising the subdivision, no separate mineral owners were
identified. A copy of that letter is attached as Exhibit 2.
b. The undersigned has reviewed the vesting deeds for the subdivision lots, and none
of those deeds reveal a mineral reservation or statement indicating that any
severance of the mineral estate has occurred subsequent to the original subdivision
of the lots and the information contained in Exhibit 2.
Based on the foregoing, the mineral estate has not been severed from the fee estate, and
each of the owners of the lots in Roaring Fork Preserve also owns the mineral estate. Therefore,
after reasonable diligence, the undersigned states that there are no separate mineral owners to
whom notice is require.
