Grading and Drainage Plan Narrative Administrative Review Caerus Piceance LLC Garfield County, Colorado 1 | Page 1001 17th Street, Suite 1600 2022 Denver, CO 80202 1) Introduction The following narrative addresses the requirements for the Grading and Drainage Plan under Article 4 Section 203.E. of the Garfield County Land Use and Development Code (LUDC). 2) Section 4-203.E.1. Site Map. A Site Map showing locations of any existing structures, Waterbodies or hydrologic features on the site, including intermittent water features, Wetlands, and the 100-year Floodplain boundaries. The N23 CDP Site Plan, depicting the site features, are provided in the Grading and Drainage tab. Floodplain areas are not located in the site perimeter or within the vicinity of the site. There are no streams, areas subject to flooding, high ground water areas, and lakes within the perimeter of the site. No intermittent or perennial streams exists within 1,000 feet radius of the site perimeter. The only downgradient surface water feature within 1,000 foot radius of the project area is a drainage (ephemeral stream) 900 feet to the east. Stormwater and drainage control features were installed at the N23 CDP to mitigated potential surface run-off. The Surface Hydrology Map is located in the Grading and Drainage Plan tab. 3) Section 4-203.E.2. Drainage Structures. a. Locations of existing and proposed drainage structures or natural drainage features affecting site drainage on the parcel and within 10 feet adjacent to the site boundary, including street gutters, storm sewers, drainage channels, and other water conveyance structures; and Wetlands or other Waterbodies receiving storm Runoff from the site. b. Preliminary engineering design and construction features for drainage structures to be constructed. Prior to grading activities, no manmade drainage structures existed within the site perimeter. The site was designed to accommodate a 25-year, 24-hour storm event. Grading activities were completed in the 3rd quarter of 2021. During construction of the facility, the sediment traps/ponds located on the eastern and western site perimeter will be expanded to provide capacity for a 25-year, 24-hour storm event. 4) Section 4-203.E.3. Topography. Existing topography at reasonable contour intervals to provide necessary detail of the site. The map should extend a minimum of 10 feet beyond the property line and show the location of the property line. The N23 CDP is located on the Roan Plateau. The proposed CDP will be located on a ridgetop east of the East Fork of Stewart Gulch. The ridgetop is divided by ephemeral drainages that typically drain west into the East Fork of Stewart Gulch or east into an BJU N23-496 Central Delivery Point Article 4 Section 203.E. Terrain in the general vicinity is composed of rolling ridges divided by draws and drainages that flow north toward Piceance Creek. The CDP site boundary is located 5369 feet from the nearest property line. Due to wildlife timeframe stipulations set forth by CPW, COGCC, and the BLM, Caerus obtained a grading permit from Garfield County prior to the submittal of the land use change application. Grading activities were completed in the 3rd quarter of 2021. The N23 CDP Grading Permit and As-Graded Plat, depicting current site conditions and contours, is provided in the Grading and Drainage tab. The CDP facility Form 2A Location Assessment was approved by the COGCC on January 14, 2021. Site topography prior to grading activities is depicted in the Construction Layout Drawing, provided in the Grading and Drainage tab. 5) Section 4-203.E.4. Grading Plan. A grading plan showing the proposed topography at reasonable contour intervals that provides necessary detail of the site. The plan shall show elevations, dimensions, location, extent, and Slope of all proposed clearing, and Grading including building site and driveway grades. Due to wildlife timeframe stipulations set forth by CPW, COGCC, and the BLM, Caerus obtained a grading permit from Garfield County prior to the submittal of the land use change application. Grading activities were completed in the 3rd quarter of 2021. The As-Built Grading Figure and N23 CDP Grading Permit, is located in the Grading and Drainage tab Surface use disturbance, detailing location and acreage of disturbance, is provided in the Grading and Drainage tab. Soil Stockpile and Snow Storage Areas. Probable locations of soil stockpiles and snow storage areas. Location of current soil stockpiles are detailed in the N23 CDP Site Plan and As-Built Figure. To protect soil stockpiles from erosive elements, hydromulch was applied. Snow within the site perimeter will be stockpiled only as needed to allow operations. Stockpiled snow directed towards BMPs when practical to allow treatment. Plowed snow will be placed near the outer boundary of the pad. Snow BMPs are detailed in the N23 CDP Site Plan (Grading and Drainage tab). 7) Section 4-203.E.6. Drainage Plan. Proposed drainage plan. Caerus will utilize engineering and operational BMPs to limited runoff. The N23 CDP was designed to accommodate a 25-year, 24-hour storm event. Drainage features and BMPs are detailed in the N23 CDP Site Plan. (Grading and Drainage tab). 8) Section 4-203.E.7. Equipment Storage Areas. Location of storage areas designated for equipment, fuel, lubricants, chemical, and waste storage with an explanation of spill containment structures.. The N23 CDP will not require storage for equipment, lubricants, chemical, and waste storage. Oil tanks will be located at the facility and will be installed in secondary containment (spill containment) with 150% capacity. 9) Section 4-203.E.8 Temporary Roads. Location of temporary roads designed for use during the construction period. A temporary road is not required for the construction period of the site. A site-specific access road was constructed during initial grading activities. This access road will be utilized during the life of the facility. The N23 CDP access was designed to meet the requirements of the Article 7 Section 107 Access and Roadways of the LUDC. 10) Section 4-203.E.9. Areas of Steep Slope. Areas with Slope of 20% or greater shall be identified by location and percentage of Slope, both for the existing site conditions and within the developed area. Due to wildlife timeframe stipulations set forth by CPW, COGCC, and the BLM, Caerus obtained a grading permit from Garfield County prior to the submittal of the land use change application. Construction Schedule. Construction schedule indicating the anticipated starting and completion time periods of the site Grading and/or construction sequence, including the installation and removal of erosion and sediment control measures, and the estimated duration of exposure of each area prior to the completion of temporary erosion and sediment control measures. Due to wildlife timeframe stipulations set forth by CPW, COGCC, and the BLM, Caerus obtained a grading permit from Garfield County prior to the submittal of the land use change application. Grading activities were completed in the 3rd quarter of 2021. Additional construction activities are listed below. Permanent Stabilization. A brief description of how the site will be stabilized after construction is completed. The site is located on the top of a plateau. Grading has been completed for the development of the site. The access road and working pad surface are graveled stabilization surface. The N23 CDP photos show the current grading of the site (Impact Analysis tab). Erosion control features, such as armoring, have been installed and are displayed in the N23 CDP Stormwater BMP Figure (Grading and Drainage tab). During construction of the facility, the sediment traps/ponds located on the eastern and western site perimeter will be expanded to provide capacity for a 25-year, 24-hour storm event. During initial grading activities 2021, temporary stabilization efforts were employed. Perimeter topsoil berms were stabilized with mulch. Cut/Fill slopes fall under the alternative stabilization schedule and utilize perimeter controls until long term stabilization can occur. After construction of the facility, interim reclamation will take place. Areas of interim reclamation will be seeded for long term stabilization. The application method to be applied for seeding will be hydraulic broastcast. BJU N23-496 Central Delivery Point Article 4 Section 203.E. Erosion Control Measures. Plan view drawings of all erosion and sediment control measures showing approximate locations and site drainage patterns for construction phases and final design elements. Text may be necessary to accompany and explain the drawings. Typical erosion control measures should be depicted using standard map symbols. Erosion control measures and BMPs are detailed in the N23 CDP Site Plan and N23 CDP Stormwater BMP Figure (Grading and Drainage tab). Caerus will perform regular maintenance of BMPS. Stormwater and erosion control BMPs were installed and construction when Caerus during initial grading activities. These controls and BMPs will be modified after interim reclamation. 14) Section 4-203.E.13. Estimated Cost. Estimated total cost, including installation and maintenance, of the required temporary soil erosion and sediment control measures. The initial installation and construction cost was approximately $10,000 for stormwater and erosion control features. Annual stormwater maintenance costs are estimated to be $6000 yearly. Estimated annuals costs are based on operational costs at similar facilities owned and operated by Caerus. 15) Section 4-203.E.14. Calculations. Any calculations made for determining rainfall, Runoff, sizing any sediment basins, diversions, conveyance, or detention/retention facilities. Calculations were performed by UNITA. Calculations were based on Caerus’s Control Measures Manual, which states for the subject site’s elevation and location approximately 3,600 ft3 per acre should be used for a 25 year/24-hour precipitation event.. Two (2) sediment basins/ponds were constructed adjacent to the pad along the eastern and western site perimeter. These ponds will be expanded during construction of the facility to accommodate a 25-year 24-hour precipitation event. The Calculations Reports is located in the Grading and Drainage tab 16) Section 4-203.E.15. Neighboring Areas. A description of neighboring areas with regard to land use and existing pertinent features such as lakes, streams, structures, roads, etc. The subject parcel is zoned Resource Lands, and the site location is designated as Resource Lands-Plateau subzone. All adjacent parcels are zoned resource lands or public lands in Garfield County and Agricultural in Rio Blanco County. Existing use of adjacent property and neighboring properties are natural resources extraction, public lands, and limited agricultural. BJU N23-496 Central Delivery Point Article 4 Section 203.E. Caerus maintains and utilizes private access roads that are adjacent to the site. There are no streams, areas subject to flooding, high ground water areas, and lakes within the perimeter of the site. No intermittent or perennial streams exists within 1,000 feet radius of the site perimeter. The Surface Hydrology Map is located in the Grading and Drainage Plan 17) Section 4-203.E.16. Stormwater Management. A description of the stormwater management planning concept for the site, including both structural and nonstructural best management practices. The ACF was designed with site specific stormwater controls depicted in the N23 CDP Site Plan and the N23 CDP Stormwater BMP Figure (Grading and Drainage tab). Caerus will adhere to Caerus’s Oil and Gas Master Stormwater Management Plan: North Parachute Ranch (SWMP), detailing stormwater BMPs, controls, and inspections 18) Section 4-203.E.17. Stormwater Management Plan. Copy of the stormwater management plan application to CDPHE with date of submittal. Caerus will adhere to Caerus’s Oil and Gas Master Stormwater Management Plan: North Parachute Ranch (SWMP), detailing stormwater BMPs, controls, and inspections. Due to the size of Caerus’s SWMP, the plan was not provided in the Administrative Review application; however, Caerus will provide any information or part of the plan to Garfield County upon request. The approved Stormwater Permit (Certification Number: COR400646) issued by CDPHE, is located in the Grading and Drainage Plan tab. 19) Section 4-203.E.18. Reclamation, Revegetation and Soil Plan. A plan that includes the following information and is consistent with the standards in section 7-208. The expected that the lifespan of the N23 CDP is approximately 30 years. A well in the Piceance Basin may produce for up to 30 years; therefore, the proposed facility will operate the same duration as the supported wells may produce. Interim reclamation will occur at the site. Caerus projects interim reclamation to occur in 2022, after construction of the facility is complete. During initial grading activities, the site was developed to 2.34 acres. BJU N23-496 Central Delivery Point Article 4 Section 203.E. After interim reclamation, the site disturbance (long-term disturbance) will be reduced to 1.02 acres. WestWater developed an integrated vegetation and noxious weed management plan for the N23-697 Pipeline. Areas surveyed included the general area surrounding the N23 CDP. The N23-697 will connect the production facilities to the proposed N23 CDP. WestWater stated it was appropriate to utilize the N23-697 Pipeline Integrated Vegetation and Noxious Weed Management Plan. The Integrated Vegetation and Noxious Weed Management Plan (provided in the Maps and Plans tab) addresses proposed reclamation practices. Reclaim areas will be vegetated with approved seed mix in order to reduce erosion and prevent fugitive dust. 20) Section 4-203.E.19. Hydraulic Calculations. Hydrologic, hydraulic, and all other calculations used to size and design drainage facilities and/or structural BMPs. Calculations were performed by UNITA. Calculations were based on Caerus’s Control Measures Manual, which states for the subject site’s elevation and location approximately 3,600 ft3 per acre should be used for a 25 year/24-hour precipitation event. Calculations were based on the site’s acre size for the production phase (after interim reclamation). The Calculations Reports is located in the Grading and Drainage tab. Two (2) sediment basins/ponds were constructed adjacent to the pad along the eastern and western site perimeter. These ponds will be expanded during construction of the facility to accommodate a 25-year 24-hour precipitation event. 21) Section 4-203.E.20. Maintenance Requirements. Maintenance requirements for all proposed BMPs should be discussed including access, schedules, costs, and designation of a responsible party. Caerus will oversee maintenance of the N23 CDP during construction, interim reclamation, and production operations. Qualified Stormwater Inspector(s) and/or Environmental inspector(s) to perform inspections of all BMPs. Inspectors will also monitor the restoration process on all disturbed land within the project and identify additional BMP, seed, and stabilizer requirements. Inspectors will be responsible for completing inspection reports to properly document the implementation of the SWMP. The assigned Stormwater Inspector will conduct routine inspections of BMPs and note areas of erosion or poor vegetation return. Maintenance will be performed by Caerus or contractors it employs. Grading and Drainage Plan Narrative Administrative Review Caerus Piceance LLC Garfield County, Colorado 8 | Page 1001 17th Street, Suite 1600 2022 Denver, CO 80202 Weed control measures will be conducted in compliance with the Colorado Noxious Weed Act, C.R.S. §35-5.5-115 and the current rules pertaining to the administration and enforcement of the Colorado Noxious Weed Act. Field personnel are trained to identify several types of noxious weeds and will notify operations if weeds are present onsite. 22) Section 4-203.E.21. Spill Prevention Control and Countermeasures Plan, if Applicable. A SPCC Plan will be required for any facility with the potential to discharge oil of any kind or in any form including, but not limited to, petroleum, fuel oil, sludge, oil refuse and oil mixed with wastes, in quantities that may be harmful to navigable water and adjoining shoreline, per EPA regulations. No chemicals or solvents will be stored within the site perimeter. Oil tanks will be located at the site and will be installed in secondary containment with 150% capacity. Caerus will develop a SPCC Plan within six months after beginning operations. SPCC compliance dates, as stated by the EPA, state for production facilities that an SPCC plan must be prepared and implemented within six months after beginning operations. 40 CFR § 112.3 - Requirement to prepare and implement a Spill Prevention, Control, and Countermeasure Plan 40 CFR § 112.3 (a)(3)(b) If your oil production facility as described in paragraph (a)(1) of this section becomes operational after November 10, 2011, or as described in paragraph (a)(2) of this section becomes operational after November 10, 2010, and could reasonably be expected to have a discharge as described in §112.1(b), you must prepare and implement a Plan within six months after you begin operations.
