These nine sites, know commonly as UMTRA sites, were remediated jointly by the State of Colorado and the U.S. Department of Energy during the late 1980’s and early 1990’s. Mill tailings were removed from 8 of the mill sites and relocated in engineered disposal cells. A disposal cell is designed to encapsulate the material, reduce radon emanation, and prevent the movement of water through the material. At one site, Maybell, CO, the tailings were stabilized in-place at the mill site. After remediation of the tailings was completed, the State and DOE began to investigate the residual impacts to groundwater at the mill sites. The groundwater phase of the UMTRA program is on-going. There are eight previously recorded sites within the proposed Project area and these sites consist of two prehistoric archaeological sites, three historical archaeological sites, an isolated find (IF), a ditch segment, and a potential segment of the Escalante-Dominguez Trail. Sites within the proposed Project area that are not eligible for inclusion in the National Register of Historic Places (NRHP) are one of the prehistoric sites (5GF4561), the three historical sites (5GF2652, 5GF4080, and 5GF4081), the Marling Ditch segment (5GF4149.1), and the IF (5GF4562). The Escalante-Dominguez Trail (5GF392) and prehistoric site 5GF4141 require addition data for an NR6HP determination. The presence of the potential Escalante-Dominguez Trail site boundary in the proposed Project area is based on historical documents; however, it has not been fully surveyed and its exact location has not been recorded in this portion of Garfield County. Site 5GF4141 is a lithic artifact scatter consisting of four microflakes found in and around an anthill indicating the potential for subsurface cultural deposits. No subsurface testing was conducted at the time of its recording. Although a segment of the Marling Ditch within the proposed Project area was determined not eligible for inclusion in the NRHP, the unrecorded portions may have historical significance and enough integrity to support the overall significance. General Land Office (GLO) maps, United States Geological Survey (USGS) topographic quadrangles, and USGS single frame aerial images were reviewed. The 1890 GLO map for Sections 35 and 36 of T7S R96W did not show any historical structures or buildings within the proposed Project area. Available USGS aerial photos and topographic maps were limited. The earliest USGS topographic map for the area is the 1929 1:62,500 Grand Valley map. This map shows three structures and at least five roads within the proposed Project area (see Figure 1). These structures correspond to OAHP data for previously recorded sites 5GF2562, 5GF4080, and 5GF4081. The 1962 1:24,000 Grand Valley topographic map shows one structure, which corresponds to site 5GF4080 (see Figure 2). One road is also shown on the 1962 map and this road follows the alignment of the existing unnamed gravel road within the proposed Project area. The 1957 aerial images of the proposed Project area show two individual structures, a cluster of several structures, the Marling Ditch, several feeder ditches or drains in fields, and numerous roads between the structures (see Figure 3). One of the individual structures, the cluster of structures, and a portion of the Marling Ditch correspond to the OAHP data for previously recorded sites 5GF4080, 5GF4081, and 5GF4149.1. 12 Figure 1. (USGS 1957a and 1957b) Because structures are present on modern aerial images of the proposed Project area, the Garfield County assessor data was reviewed to help further define the structures’ ages (Garfield County 2021). The Project area consists of a single parcel and only lists building information for the residential building in the west central portion of the proposed Project area. Modern aerial images indicate there are two buildings and infrastructure for three oil/gas pads within the parcel boundary. The assessor record indicates the two-story wood framed house has a year-built date of 2014. The Phase I ESA notes that this building is the current residence of the landowner, who has owned the property since 2006 (HDR 2021). The proposed Project area has not been surveyed in its entirety for cultural resources. Review of OAHP data and historical documents indicate the presence of one ditch, one trail, three historical archaeological sites, and three prehistoric archaeological sites and IFs. However, HDR’s field visits to the proposed Project area for the Phase I ESA indicated that the only standing structure is modern and the historical structures have been demolished. The Phase I ESA does note the presence of debris piles within the proposed Project area (HDR 2021). These debris piles are likely historical archaeological artifact concentrations associated with the former structures and occupants. If a federal nexus is determined for the proposed Project, HDR recommends a Class III cultural resource survey for a future defined area of potential effects (APE). A lead federal agency may require surveys for areas previously surveyed more than 10 years ago if the agency determines those surveys do not meet current OAHP standards for cultural resource surveys. Federal agencies are required to assess the probable impacts of an undertaking’s APE pursuant to 36 Code of 14 Federal Regulations Part 800 of the National Historic Preservation Act (NHPA) (1966, as amended in 2000). Section 106 of the NHPA (16 United States Code 40f) directs federal agencies to consider the potential effect of an undertaking on “historic properties,” which refers to cultural resources listed in, or eligible for inclusion in the NRHP. However, in the absence of a federal nexus, any cultural resource survey on private property would be considered due diligence on the part of AES. If any ground disturbance during the course of the proposed Project exposes artifacts, foundation, or other indications of past human occupation, HDR strongly encourages AES to notify the State Historic Preservation Officer and OAHP. If there is a federal nexus, the lead federal agency would also be notified. In the event that human remains are encountered all construction activities will be halted immediately and the Garfield County Coroner’s Office will be called to determine if the remains are prehistoric, historical, or modern.
