RE: Oak Meadows Phase 3 – Oak Meadows Service Company Commitment to Serve
Dear Gary:
SGM is consulting engineer for the Oak Meadows Service Company (OMSCO). OMSCO
received your request for a commitment to serve a proposed residential development known as
the Oak Meadows Phase 3 with water and sanitary sewer services. The subject property is
commonly known as Oak Meadows Ranch, filing 4B, Phase III which is located within the
OMSCO's service area off South Oak Way within the existing Oak Meadows Subdivision. The
current development proposal is for 25 single family residences with 3 auxiliary dwelling units
(ADUs). The property was previously approved for 25 single family residences with a will serve
letter dated 2007.
SGM has reviewed the Oak Meadows wastewater treatment facility (WWTF) performance
reports for the last several years and believes there is capacity for 25 single family residences
but nothing more. Oak Meadows has lower than industry standards wastewater flows per
residence which can change over time with the degradation of the sewer collection system and
could increase with inflow and infiltration (I&I). SGM’s analysis of the existing plant and current
flows predict that with the full buildout of 28 EQRs (25 single family residences and 3 ADUs) it
could potentially exceed the allowable capacity of the WWTF or 95% of capacity and require
OMSCO to expand the WWTF.
OMSCO’s legal water supply, i.e., OMSCO’s legal entitlement to divert and use water within its
service area, which includes Oak Meadows Phase 3, has been evaluated by OMSCO’s water
attorneys, Beattie, Houpt & Jarvis, LLP. Their review confirms that water is available only to
serve 25 single family units within Phase 3. Water service to 3 ADUs in addition to the 25 single
family dwellings was not contemplated under the augmentation plan approved by the District
Court in and for Water Division No. 5 in Case No. 92CW350. Four Mile Creek is over-
appropriated and has become more strictly administered since that decree was entered. The
engineering criteria used to establish water demands and consumption for that plan, which in
turn established OMSCO’s augmentation requirements, were aggressive and leave no room for
arguing that actual consumptive use is less than the estimated values used in the augmentation
plan. OMSCO’s supply of augmentation water stored in Martin Reservoirs is fully committed to
the replacement of out-of-priority depletions contemplated by the plan approved in Case No.
92CW350 and, again, leaves no room for additional depletions associated with the 3 ADUs.

In summary, OMSCO will serve 25 single family residences for the Oak Meadows Phase 3
development with the following conditions:
1. The Applicant shall enter into a Line Extension Agreement with OMSCO regarding the
requirements for extending OMSCO water and sewer infrastructure to the property.
2. OMSCO’s 1041 Permit with Garfield County may have to be amended for the
development. The Applicant will be responsible to obtain an amendment to OMSCO’s
1041 Permit for this project if needed, which shall be subject to OMSCO’s prior review
and approval.
3. The Applicant shall dedicate or convey to OMSCO all easements necessary for the
provision of OMSCO services to the development, which easements shall be free and
clear of all liens and encumbrances.
4. The Applicant shall prepare and submit engineering designs for the construction and
installation of OMSCO water and sewer infrastructure necessary to serve the
development, including but not limited to new water and sewer mains, connections to
existing OMSCO infrastructure, curb stops at each water service line connection and
other infrastructure, which shall be subject to the review and approval of the OMSCO's
engineer prior to the commencement of construction. All such infrastructure shall be
constructed in accordance with the approved plans and specifications and shall be
inspected by OMSCO’s engineer during construction prior to acceptance by OMSCO.
Following acceptance by OMSCO, Applicant shall convey such infrastructure to
OMSCO. (Individual water and sewer service lines will be owned by the individual lot
owners).
5. Water meters of the type approved by OMSCO shall be installed on each service line as
provided in OMSCO’s rules and regulations.
6. The Applicant shall reimburse OMSCO for all fees and costs incurred by OMSCO
regarding this project, including but not limited to legal and engineering fees and costs.
