A 10' utility and drainage easement exists inside all lots adjacent to the road right-of-way. 6. Open space parcels defined hereon are dedicated and set apart to the appropriate public and private entities that provide utility service or access as perpetual easements for access the installation and maintenance of utility, p Y p p � Y, irrigation and drainage facilities, including but not limited to, water lines, sewer lines, drainage culverts, drainage detention structures and related facilities, together with the right to trim interfering trees and brush; with perpetual right of ingress and egress for installation and maintenance of such lines and facilities. Such easements and rights shall be utilized in a reasonable and prudent manner. 7. Any private improvements constructed within any platted easement are constructed at the sole risk of the individual lot owner. The public or private entity, to which any easement is granted, is not responsible for the repair or replacement of any private improvements within any easement that are damaged as a result of any action consistent with the intended use of said easement. 8. No open hearth solid fuel fireplaces shall be allowed. One (1) new solid -fuel burning stove as defined by C.R.S. §25-7-401, et seq., and the regulations promulgated thereunder, will be allowed in any dwelling unit. All dwelling units will be allowed an unrestricted number of natural gas burning stoves and appliances. 9. Exterior lighting shall be the minimum amount necessary and all exterior lighting shall be directed inward, towards the interior of the subdivision to prevent glare on adjacent properties, except that provisions may be made to allow for safety lighting that goes beyond the property boundaries. 10. All foundations shall be designed by a qualified registered engineer in accordance with the recommendations in the engineering report done by Hepworth-Pawlak Geotechnical, Inc., April 15, 1998, Job #196 420, and any subsequent analysis of the area. Engineered designs will be submitted with each building permit application. 11. All construction shall be consistent with the guidelines contained in Colorado State Forest Service publication CSFS #143-691, "Wildfire protection in the Wildland Urban Interface" 12. Control of noxious weeds is the responsibility of the property owner. 13. All lots are subject to drainage and utility easements along all side yards, the width of which is equal to the dimensions of the side yard building setback unless otherwise noted. 14. One (1) dog will be allowed for each residential unit and the dog shall be required to be confined within the owners property boundaries. 15. Unless otherwise noted, front lot, side lot & rear lot building setbacks shall be 10.00 feet. MINERAL OWNERS: 1.
