DESCRIPTION OF THE PROPOSAL The Garfield County Community Development Department Director submits this application requesting to amend the Comprehensive Plan of 2030 through the Major Amendment review process. This amendment proposes to correct and update the text and Future Land Use Map of the Comprehensive Plan of 2030. II. APPLICABLE REGULATIONS The process and standards required for amending the Comprehensive Plan 2030 are included in Chapter 4, Amending the Plan, The process first requires a determination of the degree of amendment with classifications including "Comprehensive ", "Major" and "Minor ". This application proposes to update the Urban Growth Boundaries of the Town of Silt and Town of Carbondale which constitutes a "Major Amendment." This application also proposes to update text due to changes in the Land Use and Development Code and correct grammatical and spelling errors. Since the modification of the Future Land Use Map triggers the higher review process, this application is requesting the review to be through the "Major Amendment" process. A response to the list of standards of approval is found in the application and staff has provided an evaluation of these required findings in the Staff Analysis section of this report. III. REFFERAL AGENCY COMMENTS Referral comments were sent to the following agencies as required by Colorado Revised Statutes and the Land Use and Development Code (LUDC). General comments are included below with additional detailed comments incorporated into this report where relevant. STAFF ANALYSIS The adopted Comprehensive Plan 2030 sets forth that a Major Amendment shall be approved if the Planning Commission makes specific findings that: 1. The existing comprehensive plan and/or any related element thereof are in need of the proposed amendment. Staff Comment: The amendment to the Comprehensive Plan of 2030 is to correct and update the text and Future Land Use Map. The proposed changes included: Updates to reflect the changes in the Garfield County Land Use and Development Code approved by the Board of County Commissioners on July 15, 2013; Add the Cottonwoods Comprehensive Plan text and Future Land Use Map amendments approved by the Planning Commission on February 13, 2013 Resolution PC 2013-01); Update the Future Land Use Map to reflect the Urban Growth Areas for the Town of Silt and Town of Carbondale; Revise Chapter 4 — Amending the Plan of the Comprehensive Plan of 2030 in order to simplify the review process; and, Correct grammatical and spelling errors. 2. The proposed amendment is compatible with the surrounding area, and the goals and policies of the Plan. Staff Comment: Not applicable. 3. The proposed amendment will have no major negative impacts on transportation, services, and facilities. Staff Comment: Not applicable. 4. The proposed amendment will have minimal effect on service provision, including adequacy or availability of facilities and services, and is compatible with existing and planned service provision. Staff Comment: Not applicable. 5. The proposed amendment is consistent with the logical expansion of services. Staff Comment: Not applicable. 2 Planning Commission October 9, 2013 CPAA -7686 6. The county or the general area in which an amendment is proposed has changed or is changing to such a degree that the amendment is in the public interest. Staff Comment: Not applicable. 7. Strict adherence to the Plan would result in a situation neither intended nor in keeping with other key elements and policies of the Plan. Staff Comment: Not applicable. 8. The proposed plan amendment has a significant public benefit; will promote the public welfare and will be consistent with the goals and policies of the Garfield County Comprehensive Plan and the elements thereof. Staff Comment: Not applicable. V. STAFF COMMENTS The proposed amendment to the Comprehensive Plan of 2030 is to reflect the changes in the Future Land Use Map, changes in the Land Use and Development Code, add comprehenisive plan approvals, and to correct grammatical and spelling errors. VI. SUGGESTED FINDINGS 1. That proper public notice was provided as required for the hearing before the Planning Commission. 2. That the hearing before the Planning Commission was complete and that all interested parties were heard at that meeting. 3. That the proposed amendment to the Future Land Use Map is a Major Amendment to the Comprehensive Plan 2030 because it constitutes a significant change by modifying the Urban Growth Boundaries of the Town of Silt and Town of Carbondale, 4. That the proposed amendment to text and Future Land Use Map is in the best interest of the health, safety and welfare of the citizens of Garfield County. VII. STAFF RECOMMENDATION Staff recommends that the Planning Commission review this request and determine if it is appropriate to approve or deny the proposed text and Future Land Use Map amendments of the Comprehensive Plan of 2030 or continue the public hearing in order to receive additional information that the Planning Commission deems necessary to make a decision. 3 Planning Commission October 9, 2013 CPAA -7686 If the Planning Commission moves to approve the amendment to the Comprehensive Plan, a motion should follow to: 1) Recognize this request as a major amendment to the Comprehensive Plan 2030; 2) Authorize the Chair to sign a Resolution thereby amending the Comprehensive Plan 2030; 3) Authorize the Chair to sign the letters certifying the amendment to the BOCC, municipalities and the surrounding counties; and, 4) Authorize the secretary to sign the Future Land Use Map, as amended. 4 P a g e MEMO sent via email to morki ld- Iarson @aarfield- county.com TO: Molly Orkild- Larson Garfield County Community Development Dept. The following comments reflect the opinions of the Basalt Planning Staff. Comments: 1. The Town of Basalt supports compact communities and an urbanfrural separation. The Town's Master Plan includes a strict Urban Growth Boundary, beyond which urban level of development is discouraged by the Town and annexation is not considered, Additionally, the Town's Master Plan encourages a rural buffer in the areas around the Town limits and preservation of agricultural lands. The Town has participated with Eagle County and Pitkin County in open space purchases to help preserve a rural buffer. Since the objectives above are staples of the Town's Master Plan, Town Staff would encourage Garfield County to consider supporting similar land use patterns for the significant urban communities in Garfield County. 2. Town Staff sees aspects in the proposed Comprehensive Plan Amendments that support the Town's objectives mentioned above and other aspects that could contradict these objectives. Specifically, the Town supports the text in Chapter 2 that discourages new unincorporated communities. However, the Town feels that other text in Chapter 2 encouraging existing and new residential subdivisions to include commercial facilities could contradict the idea of centralizing urban development in existing incorporated areas. The Town would suggest reconsidering this aspect of the draft plan. The comments above are referral recommendations made to Garfield County. The Town recognizes that Garfield County is responsible for reviewing all of the input on this matter and with the final decision. Garfield County is a legal and political subdivision of the State of Colorado for which the Board of County Commissioners is authorized to act. B. The Garfield County Planning Commission conducted a public hearing on October 9, 2013, pursuant to public notice, upon the question of whether the Garfield County Comprehensive Plan 2030 should be amended the Future Land Use Map and text. F. The Commission, on the basis of substantial competent evidence produced at the aforemen- tioned hearing, has made the following determinations of fact: 1. That proper public notice was provided as required for the hearing before the Planning Commission. 2. That the hearing before the Planning Commission was extensive and complete, that all pertinent facts, matters and issues were submitted or could be submitted and that all in- terested parties were heard at that hearing. 3. That for the above stated and other reasons, the amendment to the Comprehensive Plan 2030 and Future Land Use map is in the best interest of the health, safety, and welfare of the citizens of Garfield County. RESOLUTION NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of Garfield County, as follows: A. The foregoing Recitals are incorporated by this reference as part of the resolution. B. The Garfield County Planning Commission found the amendment to be a Major Amendment. C. The Garfield County Planning Commission hereby amends the Garfield County Comprehensive Plan 2030 and the Future Land Use Map as set forth and attached hereto in Exhibit A — Amendment to the text of the Comprehensive Plan 2030, and Exhibit B — Amendment to the Future Land Use Map. D. Copies of the Garfield County Comprehensive Plan 2030 shall be certified to the Board of County Commissioners of Garfield County and to the planning commissions of each mu- nicipality within Garfield County pursuant to the provisions of Section 30 -28 -109 C.R.S., as amended. The Chairman of the Planning Commission shall be authorized to execute letters of certi- fication. E. The Garfield County Comprehensive Plan 2030 shall be utilized for all purposes as authorized and required within Section 20 -28 -101, et seq. C.R.S., as amended. F.
