Rezoning Justification
BACKGROUND
The rezoning request involves Area Two of a concurrently processed Future Land Use Map Update. The
rezoning involves 11 Garfield County Assessor Parcels most recently transferred to the United States of
America by a Warranty Deed at reception #9624Q5. The legal descriptions include the riparian rights in
the bed of Sweetwater Lake. The following Garfield County Assessor Parcels are included:
186305400079, L86309200082,186308100075, 186309200080, 186309200003, 1-86309300083,
186309300076, 1-86309400081, 186309300084, 18630930OO77,186309400078. Sweetwater Lake itself
is an exempt parcel (County Assessor's office) with no parcel number or account number. The parcels
were purchased for long term conservation and management.
The properties are currently zoned Rural and staff proposes rezoning them to Public Lands. The Rural
zone district is intended to protect the existing character of the zone district from uncontrolled
residential, commercial, and industrial uses. However, it is typically used for privately owned lands.
According to the LUDC, the Public Lands zone district is intended to include all land owned by the
Federal and/orstategovernment.Anyfutureactivitybythestateintheseareasmaystill besubjectto
Location and Extent or 1041 review as appropriate.
SURROUNDING ZONING
Neighboring parcels (# 186720200951 and # L86311200951") are owned by the White River National
Forest and the Bureau of Land Management respectively. Both these parcels are zoned Public Lands.
Neighboring privately owned parcels are zoned Rural.
RESPONSE TO 4.113.C REZONING REVIEW CRITERIA
L) The proposed rezoning will create a consistent pattern of zoning across the public owned lands,
with updated zoning consistently zoning state owned property as Public Lands.
2) The change in ownership necessitates the rezoning of the lands.
3) The proposed rezoning will support the long-term conservation of the lands.
4) The rezoning is further supported by the Comprehensive Plans description of Public Lands.

The following maps provide a vlew of the locatlon of the proposed rezoning, current zonlng
designation, and current Future Land Use designation. A concurrent application is proposing updating
the FLUM designation to Public Lands with a Recreation overlay.
