HomeMy WebLinkAbout4.00 Director's Determination 07.08.2021Guffield County Community Development Department Iuly 8,2021 Chris Shaw 8102 Cr ll7 Glenwood Springs, Co 81601 Brent & Mary Ann Ritter 8106 Cr 117 Glenwood Springs, Co 81601 RE: Director's Decision Letter - Colodny Exemption Amended Final Plat Lots 3 & 4 (FEXA-A2-21-8829) Dear Brent Ritter, Mary Ann Ritter, and Chris Shaw: This letter is sent to you as the Applicants for the Amended Final Plat of Lots 3 and 4 of the Colodny Exemption. The Application requested moving the lot line to the center of 4 Mile Creek. The properties are located at 8102 and 8106 County Road I 17 in Section 26, T.7 S. R. 89 W. of the 6th P.M. The properties are further described on the plat recorded at Reception No. 450181 with the Garfield County Clerk and Recorder. The Application has been reviewed in accordance with the Administrative Review procedures contained in the Land Use and Development Code as amended. Said provisions require a decision by the Director of the Community Development Department on whether to approve, approve with conditions, or deny the request. The Director's Decision is hereby issued approving your Application with a flrnding that the Applicant has completed all public notice requirements and that subject to compliance with conditions of approval the Amended Final Plat of Lots 3 and 4 of the Colodny Exemption meets the requirements and standards of the Garfield County Land Use and Development Code including the Amended Plat Review Criteria contained in Section 5- 305. The approval is subject to the following conditions of approval. 1. That all representations contained in the Application submittals shall be condit¡ons of approval, unless specifically amended or modified by the conditions conta¡ned herein. 2. Final edits to the proposed plat shall be completed, reviewed, and accepted by the County, including County Attorney and Surveyor offices. These.shall include, but are not limited to: a. The Plat Title, notes, and certificates may be amended per the County Attorney's Office and may include specific reference to the original recording information for the plat. b. A purpose statement shall be added to the plat notes, indicating that the plat amendment is for the adjustment of the shared property line. 1 c. Ensure that easements identified by the title commitment are represented on the plat. d. All requirements from the County Surveyor's shall be addressed to the satisfaction of the County Surveyor prior to submittal of the plat for final execution. 3. The following corrections shall be made to the plat: a. Setbacks shall be included on both Lot 4 and Lot 3. b. The "Side Yard Setback" extending from the start of the proposed property line to the northwest corner lot 3 will be changed to a "Front Yard Setback." c. Any plat notes from previous plats shall be included on the Amended Plat or a statement indicating that previous plat notes remain in effect. d. All improvements shall be removed from the plat prior to submitting the mylar of the Final Plat. e. All owners of lots and their lienholders shall be required to sign/approve the amended final plat. f . Plat certificates shall be updating to reflect an amended final plat and not a boundary line adjustment. i. Certificate of Dedication and Ownership and Boundary Line Agreement should be replaced with the standard Certificate of Dedication and Ownership. The Land Use and Development Code requires notification to the Board of County Commissioners for their review and potential call-up of the Director's Decision. The Board review is for a period of 10 calendar days commencing on the date of the Director's Decision. The call-up period shall expire on July 19th. The Amended Final Plat will be scheduled on the Board of County Commissioner's consent agenda after expiration of the call-up period and once all conditions of approval have been satisfied including editing of the plat and acquisition of all necessary signatures. Please note that you will have 90 days from the date of approval to submit a plal suitable for recording. Extensions may be requested prior to the expiration of the original time limit.
