Harmon Clerk of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2023 15 A RESOLUTION CONCERNED WITH THE APPROVAL OF A REZONING OF A 488.65 ACRE AREA TO PUBLIC LANDS WITH A RECREATION OVERLAY. THE PROPERTIES ARE OWNED BY THE UNITED STATES OF AMERICA AND ARE LOCATED ALONG COUNTY ROAD 150 IN SECTIONS 5, 8, 9, AND 16, TOWNSHIP 3 SOUTH, RANGE 87 WEST, 6TH P.M, COUNTY OF GARFIELD, COLORADO PARCELS NO 186305400079, 186309200082, 186308100075, 186309200080, 186309200003, 186309300083,186309300076,186309400081,186309300084,186309300077,186309400078. Recitals A. The Board of County Commissioners of Garfield County, Colorado, received a Zone District Map Amendment application from Garfield County Community Development for a 488.65-acre property located in Sections 5, 8, 9, and 16, Township 3 South, Range 87 West, 6s' P.M. Garfield County, Colorado. B. The Rezoning requests that the subject properties' zoning be changed from Rural with a Recreation Overlay to Public Lands with a Recreation Overlay. C. The subject property to be rezoned is legally described in a General Warranty Deed recorded at Reception Number 962405 in the records of the Garfield County Clerk and Recorder. D. A Public Hearing was held by the Garfield County Planning Commission on February 22, 2023, and continued to March 22, 2023 at which time the Planning Commission voted 9 mill NFAnMphW.vI1XV,C[ V11117h,j1111411II1 Receplicn#: 985499 25o©232.11 Rec FeeS$6.00ADoc Oe10n00 GARFIELD COUNTY co ' unanimously to forward a recommendation to the Board of County Commissioners to approve the requested rezoning. E. On April 10, 2023, the Board of County Commissioners opened a public hearing upon the question of whether the Rezoning should be approved, approved with changes, or denied at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Rezoning. F. The Board of County Commissioners closed the public hearing on April 10, 2023, to make a final decision. G. The Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determinations of fact: 1. That proper public notice was provided as required for the hearing before Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters, and issues were submitted or could be submitted and that all interested parties were heard at that meeting. 3. That for the reasons stated herein, the request to rezone the property is in the best interest of the health, safety, convenience, order, prosperity, and welfare of the citizens of Garfield County. 4. That the application has met the requirements of the Garfield County 2013 Land Use and Development Code, as amended. 5. That the application is in general conformance with Garfield County Comprehensive Plan 2030.
