Patrick Rawley 400 Main St. Suite 203 Aspen, Co 8161-1 RE: Directors Decision Letter for Lot 12 St. Finnbar Farm Amended Final Plat: FPAA- 09-21-8860 Dear Mr. Rawley: This letter is sent to you as the authorized representative for the application FPAA-09-2t- 8860, St. Finnbar Farm Amended Final Plat of Lot 12. The application requested amendments to the lot's building envelope. The property is located at 12 St Finnbar Farm Rd, CarbondaÌe Co in Section 31, Township 7, Range 87. The property is further described in the St. Finnbar Farm Subdivision plat at Reception #57473t with Garfield County Clerk and Recorder's office. The Application has been reviewed in accordance with the Amended Final Plat and Administrative Review procedures contained in the Land Use and Development Code as amended. Said provisions require a decision by the Director of the Community Development Department on whether to approve, approve with conditions, or deny the request. The Director's Decision is hereby issued approving your Application with a finding that the Applicant has completed all pubtic notice requirements and that subject to compliance with conditions of approval the Amended Final Plat of Lot t2 of St, Finnbar Farm Subdivision, meets the requirements and standards of the Garfield County Land Use and Development Code including the Amended Plat Review Criteria contained in Section 5-305. The approval is subject to the following conditions of approval. L. That all representations contained in the Application submittals shall be conditions of approval, unless specifically amended or modified by the conditions contained herein. 2. Final edits to the proposed plaÇ including plat notes, certificates, and title, shall be submitted to the County for review and acceptance prior to submission for execution and recording. 3 . Prior to the submittal of the Final Plat for execution and recording all plat notes from the St. Finnbar Farm Subdivision's plat at Reception #57473I with the Galfield County Clerk and Recorder's Office will be included on the final plat, or the final plat shall include a plat note stating "All plat notes found on the St, Finnbar Farm Subdivision Plat at Reception #57 4737 remain in effect on this plat" 4. Prior to the submittal of the Final Plat for execution and recording, the Final Plat shall be updated to meet the requirements Section 5-402.F Final PIat including: a. Removal of improvements not required by the Section 5-402 Final Plat. 1 b. Include any floodplains or wetlands previously mapped by the St. Finnbar Subdivision, c, Include all certificates, notices, and statements as required. d. Shall arljusl all property lines to correspottrl to tltose otr the existittg plat nr provide information related to the technical correction of previous errors. 5. Prior to the submittal of the Final Plat for execution and recording, documentation of no impacts on the ditch or designs mitigating impacts on the ditch will be submitted. If the ditch is to be abandoned, a letter from the ditch operator document the ditch's abandonment shall be submitted and the ditch shall be removed from the Final Plat, a. Any ditch and associated easements still in existence shall be included on the Final Plat in accordance with Section 7-201.8. The Land Use and Development Code requires notification to the Board of County Commissioners for their review and potential call-up of the Director's Decision. The Board review is for a period of 10 calendar days commencing on the date of the Director's Decision. You may request the decision be called up to the Board during this period, The call-up period shall expire on November 2Stt'. The Amended Final Plat will be scheduled on the Board of County Commissioner's consent agenda after expiration of the call-up period and once all conclitions of approval have been satisfiecl inclucling ediLing of the plat and acquisition of all necessary signatures. Please note that you will have 90 days from the date of approval to submit a plat suitable for recording. Extensions of this time period may be requested prior to the expiration of the original time limit, Please contact the Community Development Department if you have any questions regarding the Director's Decision and the next steps for finaìizingyour amended plat.
