Waivers from Article Standards (None) 1.1 NARRATIVE SUMMARY OF PROJECT The project is installation of approximately 450 kW AC photovoltaic panels (solar) on the existing processing building at Spring Born Farms on CR 331 south of Silt, Colorado. The existing commercial building was originally designed with the intention of installing solar panels on the roof of the building. The operations of Spring Born Farm have been temporarily suspended and are not anticipated to resume during the rooftop installation. Therefore, installation of the rooftop solar will have minimal impact upon Sp ring Born Farms and the community. Page 1 of 2 1.1.1 Miscellaneous Information Spring Born Farm Rooftop Solar Application 1.1.1 MISCELLANEOUS INFORMATION A. Airport – After discussions with Brian Condie, Rifle-Garfield County Airport Director, applicant contacted Armstrong Engineering regarding FAA Form 7 460. Applicant consulted with Paul Kastler, P.E. of Armstrong Engineering. Based upon the analysis conducted by Armstrong Engineering, no Form 7460 is necessary. See Attachment A hereto this section. B. Fire District – As stated in section B supra, the installation made the basis of this permit application is limited to rooftop solar panels and will not include Battery Electric Storage Systems (BESS). Therefore, no site/facility specific training as well as appropriate spacing to allow access to fight wildfires are required. In addition, the building including the clerestory is equipped with appropriate fire suppression systems. See Attachment B hereto this section. C. Interconnection Agreements with Utilities – The power generated through the introduction of the rooftop PV panels is intended to be used for operations on the subject property and not intended for interconnection with the utility companies. However, subsequent permit applications are intended for Communi ty Solar Garden distribution and/or be subject to interconnection agreements with utilities. D. Major Impact Land Use Change Permit – The Rooftop PV (solar) installation is approximately 450 kW AC. Further, the installation made the basis of this permit application will not include Battery Electric Storage Systems (BESS). Therefore, no Major Impact Land Use Change Permit is required. However, subsequent permit applications for ground mounted solar panels will be submitted to include this requirement. E. Industrial Setbacks – The Rooftop PV (solar) installation is not a “solar yard” as contemplated since it is mounted on the roof of an existing commercial building. However, subsequent permit applications for ground mounted PV will ensure that the 100 ft setback will be maintained. F. Wildlife Habitat – As the instant permit application pertains solely to rooftop PV panels, loss of wildlife habitat is inapplicable to the installation. Further, after discussions with Travis Bybee, District Wildlife Manager for the Rifle South District of Colorado Parks & Wildlife, subsequent phases of ground mounted solar yards have been modified to avoid impact upon wildlife habitats and/or migratory patterns. Such issues will be addressed in subsequent permit applications. Page 2 of 2 1.1.1 Miscellaneous Information Spring Born Farm Rooftop Solar Application G. Traffic During Construction – The operations of Spring Born Farm have been temporarily suspended and are not anticipated to resume during the rooftop installation. Further, all equipment and materials will be stored in the operations building of the facilities. No construction vehicles will be entering or exiting the building on a routine basis. Traffic patterns will not be disrupted during the installation of the rooftop solar panels. H. Grading and Drainage Plan – The location is currently subject to a grading and drainage plan. Further, no grading of the property will occur, and the installation of the rooftop panels will not affect drainage at the location. « OE/AAA Notice Criteria Tool - Desk Reference Guide V_2018.2.0 Notice Criteria Tool The requirements for filing with the Federal Aviation Administration for proposed structures vary based on a number of factors: height, proximity to an airport, location, and frequencies emitted from the structure, etc. For more details, please reference CFR Title 14 Part 77.9. You must file with the FAA at least 45 days prior to construction if: If you require additional information regarding the filing requirements for your structure, please identify and contact the appropriate FAA representative using the Air Traffic Areas of Responsibility map for Off Airport construction, or contact the FAA Airports Region / District Office for On Airport construction. GENERAL PROJECT DESCRIPTION The applicant is proposing an approximately 15 mW solar facility located on a 253 acre parcel that contains a commercial greenhouse facility. The current proposal would be located north of East/west portions CR 331 and CR 311 on either side of the north/south portion of CR 311. The proposed solar facility would provide power to the neighboring commercial greenhouse. Additional power would be sent into either XCEL or Holy Cross’s electric grid. The Applicant also discussed being a Community Garden Solar Project directing power to neighboring residents and businesses. Information related to the interconnection and agreements with local utility companies or similar items will need to be included. Battery storage (sodium ion) is also proposed. There have been complaints regarding the greenhouse’s light impacts on neighboring properties. Staff recommends addressing these concerns since the project will be providing electricity directly to the greenhouse facility. As such, the application should carefully address possible glare or other impacts on neighboring properties. Solar projects over 500 kW are considered Large Solar Energy Systems in the current Land Use and Development Code. In the Rural zone district, these systems require a Major Impact 2 Land Use Change Permit. These applications are heard at a public hearing before the planning commission who provides a recommendation to the Board of County Commissioners who will hear it at a separate hearing. Both hearings are public and must be noticed through mailings, postings, and publishing. Submittal requirements are listed below. Waiver of submittal requirements may be requested in the application. These requests should respond to the criteria listed in 4-202. Detailed descriptions of submittal requirements can be found in 4-203. The application will also need to address Article 7 – Standards. Divisions 1-3 as well as 7-1101. Colorado River floodplains exist in the area. The application should provide information related to if there are floodplains on the property. The Grading and Drainage Plan, 4-203.E, will be particularly important due to the site’s location. Several submittal requirements, such as traffic, will need to address construction as well as conditions during normal operations. Several important wildlife habitats are located on or near the property. The application will need to address these topics in the impact analysis and in its response to article 7. CPW has expressed concern about the loss of habitat to solar facilities. The applicant indicated that they may raise the arrays to allow deer and elk to pass beneath the system. Staff recommends the applicant reach out to CPW on the project. Community Development has typically applied 100-foot industrial setbacks to utility scale solar yards located next to residential uses. Reductions of this setback through Wavier of Standards can be included in the application. Waiver of standard requests should respond to the review criteria of Section 4-118. Visual impacts are the primary concern, though the application should provide information related to any noise or similar nuisance that should be mitigated. Fire departments have requested site/facility specific training as well as appropriate spacing to allow access to fight wildfires. The site is within the Colorado River Fire Protection District. The Silt comprehensive plan map identifies the area as a combination of Natural Resource Extraction/Future Public Quasi-Public Parks & Open Space and Recreation Commercial. III. SUBMITTAL REQUIREMENTS As a convenience outlined below is a list of information typically required for this type of application. Table 4-201 outlines the specific application submittal criteria. The following list can function as a checklist for your submittal. Contractor (Aerocompact) shall be liable toward Principal only in cases of gross negligence (intent or gross negligence) except for personal injuries. The structural design encompasses the racking (substructure) only and does not include the PV modules for which approval by the manufacturer for the Aerocompact system in question is recommended. Anchor point attachments for solar flat roof solutions of Aerocompact are designed for Ultimate Limit States (strength) only. For the TR rail system, roof-parallel forces are passed to the roof beams via the fixations of the sandwich panels. Their load path does not include the fixations of the TR rail system. The sheet thickness of the roof covering must not be lower than 0.5mm in countries where the Eurocode governs the design of buildings and structures. Elsewhere, a different minimum for the permissible sheet thickness may apply. If not edited by the AeroTOOL user specific to the project, the default values for the Effective screw-in depth using CompactPITCH XW are 67mm with M10 hanger bolts and 100mm with M12 hanger bolts. Except for the TR rail system, all Aerocompact system solutions are designed assuming a non-flexible, rigid roof covering. The structural check of the roof covering and of the roof support structure is out of scope of the present design. If the structural design includes utilizations exceeding 100%, the overall safety of the structure as required by the governing code is reduced. In a worst-case scenario, exceeding the permitted utilization of 100% may cause failure of the fixations of the mounting system. 9. The Supplier is not responsible for the project-related structural soundness of the roof structure and the professional realization and installation. 10. The technical specifications are an integral part of the product. AEROCOMPACT® shall not be liable for damages caused by non-compliance with the installation instructions and particularly with the safety information and from the improper use of the products. The Site includes a portion of Dry Hollow Creek which flows along the Western edge of the property. The operations building of the grow house was designed with the intent to install rooftop solar at a future date. 2. A description of the geologic characteristics of the area including any potential natural or manmade hazards, and a determination of what effect such factors would have on the proposed use of the land. 1. The installation of the rooftop solar will not impact natural or manmade hazards. 2. The design contemplates all know hazards. 5. Groundwater and Aquifer Recharge Areas. Evaluation of the relationship of the subject parcel to Floodplains, the nature of soils and subsoils and their ability to adequately support waste disposal, the Slope of the land, the effect of sewage effluents, and the pollution of surface Runoff, stream flow, and groundwater. 6. Environmental Impacts. Determination of the existing environmental conditions on the parcel to be developed and the effects of development on those conditions, including: a. Determination of the long-term and short-term effect on flora and fauna; 1. No impacts on flora or fauna are present. b. Determination of the effect on designated environmental resources, including critical wildlife habitat; 1. The instillation of the rooftop solar on an existing commercial building will have no impact on environmental resources or wildlife habitat. c. Therefore, as the rooftop solar installation supports the existing conformance with the “Garfield County Comprehensive Plan and complies with any applicable intergovernmental agreement[s].” Section 7-103 – “The nature, scale, and intensity of the proposed use are compatible with adjacent land uses” as the rooftop solar system is flush- mounted and will support the ongoing operations of the existing agricultural operations. Section 7-104 – The rooftop mounted solar system will not require a source of water beyond the existing agricultural operation. Section 7-105 – The rooftop mounted solar system will neither require water nor wastewater distribution systems. Section 7-106 – The rooftop mounted solar system will eliminate the need for existing public electrical utilities and not require additional utility easements.
