General Narrative - The Trofholz family has engaged SOCO Solar to install a roof mounted solar energy system approximately 25 kW in size. It would be mounted on an existing accessory structure. This level of system currently is defined as a Small Solar Energy System and requires an Administrative Review Land Use Change Permit in the Rural Zone District. As indicated below, we wish to utilize waiver of submittal requirements for grading/ drainage plans, landscape plans, full traffic study, water, and wastewater plans. These waiver requests fulfill the review criteria found in LUC Section 4- 202. This project is in line with the Garfield County Comprehensive Plan 2030 per Section 10: Renewable Energy. This project will contribute to “the development of renewable energy sources throughout the county … in appropriate locations.” The Comprehensive Plan 2030 vision of Section 10 further states, “County regulations should not be unduly burdensome or difficult to negotiate in regards to the development and location of new renewable energy resources.” Proof of ownership – attached. TROFHOLZ APPLICATION SOLAR SMALL Statement of Authority has been recorded on 8/23/17 with Garfield County (896486). A Letter of Authorization – attached. Names and mailing addresses of property owners within 200 ft. of the subject property from Assessor’s Office Records -attached. Mineral rights ownership for the subject property including mailing address and/or statement on mineral rights research – attached. Copy of the Preapplication Summary – attached. Vicinity Map – attached. Site Plan – attached as part of the solar installation design plan packet. Grading and Drainage Plan – requesting a waiver as a rooftop solar installation will not affect property grading or drainage. Landscape Plan – requesting a waiver as a rooftop solar installation will not affect property landscaping. Impact Analysis – This project includes the rooftop mounting of 63 solar panels on an existing structure. Due to the efficiency of solar panels currently, this system is over the 15kW threshold for Use By Right in Garfield County, thus requiring a Land Use Change Permit. This system is intended to offset the electrical usage consumed by the resident on this property and fits the Garfield County definition of Small Energy System solely due to the DC nameplate rating. This project will not change the nature, usage or zoning of the property or the surrounding properties. The greatest potential impact could be from the glare off the glass panels. However, the roof upon which the panels are to be mounted has a tilt of only 5 degrees, which will not reflect any sun glare in the direction of other homes. This project also meets all the standards listed in LUC section 7-1101 for Solar Energy Systems. We have a permit from the State Electrical Board and will have this system inspected and approved by a state inspector. This will ensure all signage requirements are met. This system will be installed as flush to the roof surface as possible, not exceeding the pitch of the roofline. Development agreement – not applicable. Improvement agreement – not applicable as no public improvements will be part of the project. Traffic Study – requesting a waiver as a rooftop solar installation will not affect traffic patterns. Water Supply/Distribution Plan – requesting a waiver as a rooftop solar installation will not change the water supply or distribution. Wastewater Management/Treatment Plan – requesting a waiver as a rooftop solar installation will not affect wastewater management or treatment. GENERAL PROJECT DESCRIPTION Garfield County’s Land Use and Development Code (LUDC) can be found here: https://www.garfield- county.com/community-development/land-use-code/ This preapplication conference was held and the summary prepared in concert with the Mendoza Small Solar Preapplication. The applicant is proposing a roof mounted solar energy system approximately 25 kW in size. It would be mounted on an existing accessory structure. This level of system currently is defined as a Small Solar Energy System and requires an Administrative Review Land Use Change Permit in the Rural Zone District. Staff anticipates the applicant will want to utilize waiver of submittal requirements for several standard submittal requirements. Section 4-202 of the LUDC provides the review criteria for the waiver requests. Section 7-1101 provides some specific standards for Solar Facilities, though most of the section concerns accessory solar energy uses. Specifically, waivers are typically requested for grading/drainage plans, landscape plans, full traffic study, water and wastewater plans. These waiver requests should fulfill the review criteria found in 4-202. It will be important for the application to address glare within the Impact Analysis. The application should also demonstrate that the roof mounted system will maintain compliance with Garfield 2 County’s wind and snow loads, as applicable for the structure. The application should also respond to Article 7 Standards. A full list of submittal requirements is provided below. A recorded SOA designating the managers of the trust the property is owned by will need to be provided, and they will need to either sign the application or provide a letter of authorization clearly designating the individual authorized to undertake the land use change permit. Staff reviewed available information related to the parcel’s construction. Though it is mapped as part of the Laura Lee subdivision, the parcel does not to have been included in the application or resolution for that subdivision. Staff is concerned that the parcel was not legally created. If not, a Basic Correction Exemption would be required. A title commitment is typically required with all applications and may provide evidence of legal creation. II. COMPREHENSIVE PLAN The property is within the Urban Growth Boundary of Silt. They would be used as a referral agency and additional weight placed on their comprehensive plan and any comments, though roof solar systems rarely are at odds with comprehensive plans. III. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS The following Sections of the Garfield Land Use and Development Code as amended apply to the Application: • Section 4-103 Administrative Review and Section 4-101 Common Review Procedures • Table 4-201 Submission Requirements and Section 4-203 Description of Submittal Requirements. • Section 4-118 and Section 4-202, as applicable. • Article 7 Standards , as applicable IV.
